जोधपुर | [कोर्ट बुलेटिन] | एक एईएन को 200 रुपये रिश्वत लेने के मामले में 40 साल की लंबी न्यायिक प्रक्रिया के बाद जोधपुर राजस्थान हाई कोर्ट ने बरी किया है। हालांकि, एईएन को 1 साल की सजा अधीनस्थ न्यायालय ने दी थी लेकिन सजा के खिलाफ अपील की सुनवाई से लेकर हाई कोर्ट में सुनवाई के 40 साल बाद एईएन को रिश्वत लेने के आरोप से बरी कर दिया गया।

 

दरसअल चित्तौड़गढ़ जिले के गंगरार कस्बे में तत्कालीन राजस्थान राज्य विद्युत मंडल के सहायक अभियंता प्रकाश मणिहार को भ्रष्टाचार निरोधक ब्यूरो ने 5 मार्च 1982 को 200 रुपये की रिश्वत लेते रंगे हाथ गिरफ्तार किया था। करीब 9 साल की लंबी ट्रायल के बाद विशिष्ट न्यायालय भ्रष्टाचार निवारण की अदालत ने 2 दिसंबर 1991 को दो धाराओं में सहायक अभियंता प्रकाश मणिहार को एक 1 साल की सजा सुनाई।

 

एसीबी कोर्ट से मिली सजा के खिलाफ उसी साल एईएन प्रकाश ने राजस्थान हाई कोर्ट याचिका दायर किया। राजस्थान हाई कोर्ट में एईएन की अपील याचिका पर 32 साल की लंबी सुनवाई के बाद आखिरकार एईएन प्रकाश को बरी कर दिया गया।

 

राजस्थान हाईकोर्ट में अपील की सुनवाई करते हुए सहायक अभियंता के अधिवक्ता मोती सिंह राजपुरोहित ने कहा कि भ्रष्टाचार के मामलों को साबित करने में अभियोजन पक्ष विफल रहा है। मोती सिंह राजपुरोहित ने हाईकोर्ट में कहा कि भ्रष्टाचार के मामलों को साबित करने से पहले रिश्वत की मांग और फिर वसूली स्थापित होना आवश्यक है। अभियोजन पक्ष रिश्वत की मांग को साबित भी नहीं कर पाया। इसके बावजूद अधीनस्थ अदालत ने विधिक तथ्यों की अनदेखी करते हुए सहायक अभियंता को 1 साल की सजा सुना दी।

 

एसीबी कोर्ट में 200 रुपये की रिश्वत बरामदगी तो साबित होती है लेकिन रिश्वत की मांग का पहलू संदिग्ध है। उन्होंने कहा की एसीबी के पास सहायक अभियंता के रिश्वत मांगने का ना कोई टेप रिकॉर्डिंग है और ना ही गवाह मौजूद है जो सहायक अभियंता को 200 रुपये रिश्वत लेते प्रमाणित कर सके। लिहाजा हाई कोर्ट ने अभियोजन पर रिश्वत लेने के प्रमाण साबित नहीं करने का लाभ देते हुए सहायक अभियंता को बरी कर दिया।

 

राजस्थान हाई कोर्ट ने सुप्रीम कोर्ट का फैसला दोहराते हुए कहा कि आरोपी को दोषी ठहराने से पहले रिश्वत की मांग और वसूली दोनों तथ्यों को स्पष्ट रूप से साबित करना जाना चाहिए। हाई कोर्ट ने सहायक अभियंता के रिश्वत लेने की मांग साबित नहीं होने का लाभ देते हुए उन्हें बरी कर दिया।

 

Accused of taking bribe of two hundred rupees, acquitted from court after fighting for 40 years

Although AEN was sentenced to one year by the subordinate court, AEN was acquitted of bribery charges after 40 years of hearing in the High Court from the hearing of the appeal against the sentence.

 

The then Rajasthan State Electricity Board’s assistant engineer Prakash Manihar was arrested red-handed by the Anti-Corruption Bureau on March 5, 1982, while accepting a bribe of Rs 200 in Gangrar town of Darsal Chittorgarh district. After a long trial of about 9 years, the Special Court, the Court of Prevention of Corruption, on 2 December 1991, sentenced Assistant Engineer Prakash Manihar to one year in two sections.

 

In the same year, AEN Prakash filed a petition in the Rajasthan High Court against the sentence awarded by the ACB Court. AEN Prakash was finally acquitted after a 32-year-long hearing on the appeal petition of AEN in the Rajasthan High Court.

 

While hearing the appeal in the Rajasthan High Court, Assistant Engineer’s advocate Moti Singh Rajpurohit said that the prosecution has failed to prove the corruption cases. Moti Singh Rajpurohit said in the High Court that before proving cases of corruption, it is necessary to establish demand for bribe and then recovery. The prosecution could not even prove the demand for bribe. Despite this, the subordinate court, ignoring the legal facts, sentenced the assistant engineer to one year’s imprisonment.

 

The recovery of a bribe of Rs 200 is proved in the ACB court but the aspect of demanding bribe is doubtful. He said that the ACB does not have any tape recording of the assistant engineer demanding bribe and there is no witness to prove that the assistant engineer was taking a bribe of Rs 200. Therefore, the High Court acquitted the Assistant Engineer, giving the benefit of not proving the evidence of taking bribe on the prosecution.

 

The Rajasthan High Court, while reiterating the Supreme Court’s decision, said that both the demand for and the recovery of bribe must be clearly proved before convicting the accused. The High Court acquitted the Assistant Engineer, giving the benefit of not proving his demand for taking bribe.
