लखनऊ | [कोर्ट बुलेटिन] | अयोध्या के विवादित ढांचा विध्वंस मामले में सत्र अदालत के फैसले को चुनौती देते हुए, हाईकोर्ट की लखनऊ बेंच में दाखिल पुनरीक्षण याचिका पर अगली सुनवाई 18 जुलाई को होगी। याचिका में सभी 32 अभियुक्तों को दोषी करार दिये जाने की भी मांग की गई है।
न्यायमूर्ति दिनेश कुमार सिंह की एकल पीठ के समक्ष अयोध्या निवासी हाजी महबूब अहमद व सैयद अखलाक अहमद की ओर से दाखिल उक्त याचिका सोमवार को सुनवाई के लिए पेश हुई। हालांकि याचियों की ओर से मामले को किसी अन्य दिन सुने जाने का अनुरोध किया गया।
इस पर न्यायालय ने 18 जुलाई की तिथि नियत करते हुए, यह भी स्पष्ट किया है कि अगली तारीख पर मामले की सुनवाई टाली नहीं जाएगी। साथ ही याचिका को शुरू के दस मामलों में ही सूचीबद्ध करने का भी निर्देश दिया है।
उल्लेखनीय है कि विशेष अदालत, अयोध्या प्रकरण ने 30 सितम्बर 2020 को निर्णय पारित करते हुए, विवादित ढांचा विध्वंस मामले में पूर्व उप प्रधानमंत्री लालकृष्ण आडवाणी, पूर्व केंद्रीय मंत्री मुरली मनोहर जोशी, पूर्व राज्यपाल कल्याण सिंह, पूर्व मुख्यमंत्री उमा भारती, लोक सभा सदस्यों साक्षी महाराज, लल्लू सिंह व बृजभूषण शरण सिंह समेत सभी अभियुक्तों को बरी कर दिया था। वर्तमान याचिका में कहा गया है कि दोनों याची उक्त मामले में न सिर्फ गवाह थे बल्कि घटना के पीड़ित भी हैं।
उन्होंने विशेष अदालत के समक्ष प्रार्थना पत्र दाखिल कर खुद को सुने जाने की मांग भी की थी लेकिन विशेष अदालत ने उनके प्रार्थना पत्र को खारिज कर दिया। याचियों का यह भी कहना है कि केंद्र की बीजेपी सरकार के दबाव में सीबीआई ने सत्र अदालत के फैसले के विरुद्ध अपील नहीं दाखिल की जबकि कई मुस्लिम संगठनों ने सीबीआई को अपील दाखिल करने के लिए अनुरोध किया था।

The petition also demanded the conviction of all the 32 accused.
The said petition filed by Haji Mehboob Ahmed and Syed Akhlaq Ahmed, residents of Ayodhya, appeared for hearing on Monday before a single bench of Justice Dinesh Kumar Singh. However, it was requested by the petitioners to hear the matter on some other day.
On this, while fixing the date of July 18, the court has also made it clear that the hearing of the case will not be postponed to the next date. Along with this, the petition has also been directed to be listed in the first ten cases only.
It is noteworthy that the Special Court, Ayodhya Case, passing the decision on 30 September 2020, in the disputed structure demolition case, former Deputy Prime Minister LK Advani, former Union Minister Murli Manohar Joshi, former Governor Kalyan Singh, former Chief Minister Uma Bharti, Lok Sabha members Sakshi All the accused including Maharaj, Lallu Singh and Brij Bhushan Sharan Singh were acquitted. It is stated in the present petition that both the petitioners were not only witnesses in the said case but also the victims of the incident.
He had also filed an application before the special court seeking to be heard himself, but the special court rejected his application. The petitioners also contend that the CBI did not file an appeal against the sessions court’s decision under pressure from the BJP government at the Centre, while several Muslim organizations had requested the CBI to file an appeal.
