बिलासपुर | [कोर्ट बुलेटिन] | छत्तीसगढ़ हाईकोर्ट में ढाबे को लेकर आए मामले में रविवार अवकाश के दिन भी कोर्ट खोला गया। जस्टिस पीसेम कोशी के सिंगल बेंच ने अर्जेंट सुनवाई करते हुए याचिकाकर्ता को अंतरिम राहत दी है।
दरअसल बिलासपुर-रायपुर नेशनल हाईवे के बीच नांदघाट पुल के पास गोस्वामी फ़ैमिली ढाबा है। याचिकाकर्ता के अधिवक्ता शैलेंद्र बाजपेयी ने कोर्ट को बताया कि याचिकाकर्ता विवेक शुक्ला की जमीन ग्राम खैरा में थी।
सन 1951 में सड़क निर्माण के लिए एक एकड़ के क़रीब इनकी जमीन ली गई और बदले में सड़क के किनारे में जमीन दी गई। पिछले 35 वर्षों से संचालित ढाबे को कब्ज़ा बताते हुए 26 अप्रैल को नवागढ़ तहसीलदार ने एक नोटिस जारी किया और 30 अप्रैल को कब्ज़ा हटाने का आदेश जारी कर दिया। इसके खिलाफ़ ढाबा संचालक ने एसडीएम नवागढ़ के समक्ष अपील की, जिसे एडीएम ने 16 जून को ख़ारिज कर दिया।
एकतरफा बिना सुनवाई के कार्यवाई के खिलाफ याचिकाकर्ता ने शनिवार की देर रात अर्जेंट याचिका दायर की थी। जिसे कोर्ट ने स्वीकार करते हुए रविवार अवकाश के दिन कोर्ट का दरवाजा खोला। साथ ही इस मामले पर सुनवाई करते हुए कोर्ट ने तहसीलदार द्वारा जारी कब्ज़ा हटाने और तोडफोड़ की कार्रवाई पर अगली सुनवाई तक रोक लगा दी है। साथ ही याचिकाकर्ता को एसडीएम के समक्ष दस्तावेज प्रस्तुत करने का निर्देश भी दिए हैं।
अचानक 35 सालों बाद जागा प्रशासन
याचिकाकर्ता का कहना है कि करीब 35 सालों से उनका ढाबा चल रहा है। इसके पहले कोई आपत्ति नहीं जताई गई है। याचिकाकर्ता का यह भी कहना है कि प्रशासन की तरफ से आनन फानन में यह कार्रवाई की गई है। उन्होंने कहा कि 26 अप्रैल को नवागढ़ तहसीलदार ने एक नोटिस जारी किया और 30 अप्रैल को कब्ज़ा हटाने का आदेश जारी कर दिया। हालांकि अब कोर्ट ने तोड़फोड़ की कार्रवाई पर रोक लगा दी है। साथ ही दस्तावेज प्रस्तुत करने का आदेश दिया है।
Urgent petition filed in Chhattisgarh High Court late on Saturday, hearing on Sunday

Actually there is a Goswami family dhaba near Nandghat bridge between Bilaspur-Raipur National Highway. Petitioner’s advocate Shailendra Bajpai told the court that petitioner Vivek Shukla’s land was in village Khaira.
In 1951, for the construction of the road, about one acre of their land was taken and in return land was given on the side of the road. On 26 April, the Nawagarh Tehsildar issued a notice stating that the dhaba operated for the last 35 years was in possession and on 30 April issued an order to remove the possession. Against this, the Dhaba operator appealed before the SDM Nawagarh, which was rejected by the ADM on 16 June.
Against the unilateral action without hearing, the petitioner had filed an urgent petition late on Saturday night. Accepting which the court opened the door of the court on Sunday holiday. Also, while hearing this matter, the court has stayed the action of demolition and demolition issued by the Tehsildar till the next hearing. Along with this, the petitioner has also been directed to present the documents before the SDM.
Suddenly the administration woke up after 35 years
The petitioner says that his dhaba is running for about 35 years. No objection has been raised before this. The petitioner also says that this action has been taken by the administration in a hurry. He said that on 26 April the Nawagarh Tehsildar issued a notice and on 30 April issued an order to remove the possession. However, now the court has stayed the sabotage action. Along with this, the documents have been ordered to be submitted.
