रायपुर | [नेशनल बुलेटिन] | आधुनिक युग में भी एकलव्य का “अंगुठा” काटे जाने का मामला प्रकाश में आया है। रेलवे में हो रहे निजीकरण को लेकर एक रेल कर्मचारी ने आरटीआई के तहत 5 बिंदुओं में जानकारी मांगे जाने और पूछे गए प्रश्न को पत्रिका समाचार पत्र द्वारा प्रकाशित किए जाने से छुब्ध रेल प्रशासन ने एक दलित रेल कर्मचारी पर बर्खास्तगी की गाज गिरा दी है। इतना ही नहीं रेलवे ने एकतरफा कार्रवाई करते हुए रेल इस “एकलव्य” और उसके परिवार के गुजर-बसर का आखिरी सहारा पेंशन तक छीन लिया है।
छत्तीसगढ़ की राजधानी रायपुर में दक्षिण पूर्व मध्य रेलवे का वैगन रिपेयर शॉप है। इस वैगन रिपेयर शॉप में टेक्निशियन पद पर नरेश कुमार कोशले कार्यरत हैं। टेक्निशियन नरेश कुमार कोशले द्वारा सूचना के अधिकार के तहत 13 अक्टूबर 2021 को 5 बिन्दुओं में जानकारी मांगी। बताया जाता है कि रेल कर्मचारी नरेश कुमार कोशले ने निजीकरण से संबंधित जानकारी सूचना के अधिकार के तहत रेलवे से मांगी थी।
5 बिंदुओं में रेलकर्मी नरेश कुमार कोशले ने रेलवे से सवाल पूछा था कि …
1. यह कि भारत सरकार द्वारा रेलवे बोर्ड को किस वर्ष ठेकेदारी पर काम होने हेतु आदेश जारी किया व जानकारी सत्यापित छायाप्रति उपलब्ध कराएं,
2. यह कि भारत सरकार द्वारा जारी निगमीकरण करने का था पर रेलवे द्वारा तो निजीकरण कर रहा है। इस आदेश की सत्यापित छायाप्रति उपलब्ध कराई जाए,
3. यह कि वर्तमान रेलवे कारखाना अधिनियम के अंतर्गत रेल कारखाना में भर्ती की योग्यता 10वीं पास + संबंधित ट्रेड में आई टी आई अनिवार्य होता है, जबकि ठेका मजदूरों की योग्यता व पुलिस वैरिफिकेशन की जानकारी सत्यापित छायाप्रति उपलब्ध कराई जाए,
4. यह कि वर्तमान रेलवे कारखाना अधिनियम के अंतर्गत कोई भी व्यक्ति 3 माह से अधिक एक जगह पर कार्य करता है तो उसे नियमित किया जाता है। वर्तमान में ठेका मजदूरों के साथ ऐसा नहीं हो रहा है। रेलवे द्वारा आदेश की जानकारी की सत्यापित छायाप्रति उपलब्ध कराई जाए।
5वां. यह कि रेलवे द्वारा ठेका मजदूरों को कितना मजदूरी देने का प्रावधान है, की आदेश की जानकारी की सत्यापित छायाप्रति उपलब्ध कराई जाए।
आरटीआई के तहत मांगी गई उपर्युक्त जानकारी के जवाब में 30 अक्टूबर 2021 को दयानंद साहू उप मुख्य यांत्रिक पहले सवाल पर कहते हैं, जानकारी उपलब्ध नहीं है, दूसरे सवाल पर कोई जानकारी नहीं है, तीसरे सवाल के जवाब में भी कोई जानकारी नहीं है, चौथे सवाल के जवाब में भी कोई जानकारी नहीं होने और पांचवे व अंतिम सवाल के जवाब में ठेका मजदूरों को रेलवे द्वारा सीधे वेतन देने का प्रावधान नहीं होने की जानकारी दी गई।
चूंकि मामला रेलकर्मचारियों के हितों से जुड़ा था और आरटीआई की जानकारी सभी रेलकर्मचारियों को उपलब्ध कराई गई थी, ऐसे में किसी शख्स के माध्यम से उक्त आरटीआई पत्रिका समाचार पत्र तक पहुंच गई और इस खबर का प्रकाशन “ रेलवे कारखाना में निजीकरण : कोलकाता की कंपनी का दबदबा, मचा हड़कंप ” शीर्षक के साथ 28 जनवरी 2022 को की गई। इस खबर में यह भी बताया गया कि उक्त कारखाने 2200 कर्मचारी में कार्यरत हैं जिनमें अब 600 कर्मचारी निजी कंपनी के रख लिए गए हैं।
पहले ट्रांसपोर्ट सेक्शन, मशीन शॉप, एयब्रेक सेक्शन और स्टोर सेक्शन में ठेके पर आए कर्मचारी काम कर रहे है। इसके अलावा इस खबर में यह भी खुलासा कर दिया गया कि इन कर्मचारियों में से केवल 95 का पुलिस वैरिफिकेशन कराया गया है। इस खबर के सामने आने के बाद रेलवे में हड़कंप मच गया।
चूंकि आरटीआई के तहत जानकारी मांगने वाला रेलकर्मचारी अनुसूचित जाति वर्ग से था और उसने अपनी शिक्षा का उपयोग करते हुए रेलवे से जानकारी मांगने का दु:साहस कर लिया था, ऐसे में कार्रवाई होना भी लाजमी था।
मामले पर गंभीरता दिखाते हुए वर्कशॉप के प्रबंधक महेश कुमार एक करण बताओ नोटिस जारी करते हुए रेलवे नियमावली की 1996 की धारा 9 आदि का उल्लंघन होना बताते हुए 7 दिन के अंदर जवाब मांगा। संतोषजनक जवाब नहीं दिए जाने पर अनुशासनात्मक कार्रवाई की बात कही।
रेल कर्मचारी नरेश कुमार कोशले कारण बताओ नोटिस का जवाब अनुशासनात्मक रूप से देते हुए लिखते हैं कि “इस अधिनियम के तहत जो सूचनाएं गोपनीय हो वह देने से आप मना कर सकते थे। आपने ऐसी कोई सूचना दी ही नहीं जो गोपनीयता के दायरे में आती हो। आपने सभी बिन्दुओं के जवाब में मुझे कोई जानकारी नहीं होने की बात कही है”।

There is a wagon repair shop of South East Central Railway in Raipur, the capital of Chhattisgarh. Naresh Kumar Koshle is working as a technician in this wagon repair shop. On 13 October 2021, under the Right to Information by Technician Naresh Kumar Koshale, sought information in 5 points. It is said that railway employee Naresh Kumar Koshale had sought information related to privatization from the Railways under the Right to Information Act.
Railway worker Naresh Kumar Koshle had asked the railways in 5 points that …
1. In which year the Government of India issued an order to the Railway Board to work on the contract and provide the information attested photocopy,
2. That the corporatisation issued by the Government of India It was meant to be done but is being privatized by the Railways. Attested photocopy of this order should be provided.
3. That under the current Railway Factory Act, the qualification for recruitment in Railway Factory is 10th pass + ITI in the relevant trade is mandatory, while the information of qualification and police verification of contract laborers should be provided attested photocopy,
4. That under the existing Railway Factories Act, if any person works in one place for more than 3 months, then he is made regular. At present this is not happening with the contract workers. Attested photocopy of the order information should be provided by the Railways.
5th. That the attested photocopy of the information of the order should be made available to the contract laborers by the Railways.
In response to the above information sought under RTI, on 30 October 2021, Dayanand Sahu Deputy Chief Mechanical says on the first question, the information is not available, there is no information on the second question, there is no information in the answer to the third question, fourth There was no information in the answer to the question and in the answer to the fifth and last question, there was no provision of direct salary to the contract laborers by the Railways.
Since the matter was related to the interests of the railway employees and the RTI information was made available to all the railway employees, the said RTI magazine reached the newspaper through a person and published this news “Privatization in Railway Workshop: Domination of Kolkata Company”. It was released on 28 January 2022 with the title, Macha Hadakamp. It was also told in this news that the said factory employs 2200 employees, out of which 600 employees have now been kept for private companies.
Earlier, contract workers are working in Transport Section, Machine Shop, Airbrake Section and Store Section. Apart from this, it was also disclosed in this news that police verification of only 95 of these employees has been done. After this news came to the fore, there was a stir in the railways.
Since the railway employee seeking information under RTI belonged to the Scheduled Castes category and using his education had the audacity to seek information from the Railways, action was bound to be taken.
Showing the seriousness of the matter, Mahesh Kumar, the manager of the workshop, issued a show-cause notice and sought a reply within 7 days stating that there was a violation of section 9 of the Railway Rules, 1996, etc. If a satisfactory answer is not given, disciplinary action has been taken.
Railway employee Naresh Kumar Koshale, while responding to the show cause notice disciplinary, writes that “You could have refused to give information which is confidential under this Act. You have not given any such information which falls within the ambit of confidentiality. You have told me that I am not aware of all the points.
