नैनीताल | [कोर्ट बुलेटिन] | राज्य लोक सेवा आयोग उत्तराखंड की ओर से सम्मिलित सिविल अधीनस्थ सेवा परीक्षा उत्तराखंड में उत्तराखंड मूल की महिलाओं को अनारक्षित श्रेणी में 30 प्रतिशत आरक्षण देने को हाईकोर्ट में चुनौती दी गई है। हाईकोर्ट ने राज्य सरकार और राज्य लोक सेवा आयोग को नोटिस जारी कर जवाब दाखिल करने के निर्देश दिए हैं। अगली सुनवाई 22 अगस्त को होगी।
बुधवार को मुख्य न्यायाधीश न्यायमूर्ति विपिन सांघी और न्यायमूर्ति रमेश चंद्र खुल्बे की खंडपीठ में हरियाणा के भिवानी निवासी पवित्रा चौहान व अन्य की याचिका पर सुनवाई हुई। महिला अभ्यर्थियों का कहना है कि आयोग ने पिछले साल दस अगस्त को विज्ञापन जारी किया था। 26 मई 2022 को प्रारंभिक परीक्षा का परिणाम आया।
परीक्षा में अनारक्षित श्रेणी की दो कट ऑफ लिस्ट निकाली गईं। उत्तराखंड मूल की महिला अभ्यर्थियों की कट ऑफ 79 थी। याचिकाकर्ता महिलाओं का कहना था कि उनके अंक 79 से अधिक थे, मगर उन्हें अयोग्य करार दे दिया गया। याचिकाकर्ता ने अदालत को बताया कि शासनादेश के अनुसार, उत्तराखंड मूल की महिलाओं को 30 प्रतिशत क्षैतिज आरक्षण दिया जा रहा है, जो असंवैधानिक है।
आवास के आधार पर राज्य नहीं दे सकते आरक्षण
याचिकाकर्ता के अधिवक्ता कार्तिकेय हरिगुप्ता ने कोर्ट को बताया कि 18 जुलाई 2001 और 24 जुलाई 2006 के शासनादेश के अनुसार, उत्तराखंड मूल की महिलाओं को 30 प्रतिशत क्षैतिज आरक्षण दिया जा रहा है, जो असंवैधानिक है।
संविधान के अनुच्छेद-16 के अनुसार आवास के आधार पर कोई राज्य आरक्षण नहीं दे सकता, यह अधिकार केवल संसद को है। राज्य केवल आर्थिक रूप से कमजोर व पिछले तबके को आरक्षण दे सकता है। कोर्ट ने मामले को सुनने के बाद राज्य सरकार व राज्य लोक सेवा आयोग को नोटिस जारी कर जवाब दाखिल करने के निर्देश दिए हैं।
30 percent women reservation challenged in High Court, State Public Service Commission exam case
Nainital | [Court Bulletin] | State Public Service Commission Uttarakhand has challenged in the High Court to give 30 percent reservation to women of Uttarakhand origin in the unreserved category in the Combined Civil Subordinate Services Examination, Uttarakhand. The High Court has issued notices to the State Government and the State Public Service Commission and directed them to file their replies. The next hearing will be on August 22.
On Wednesday, the division bench of Chief Justice Justice Vipin Sanghi and Justice Ramesh Chandra Khulbe heard the petition of Pavitra Chauhan, resident of Bhiwani, Haryana and others. Women candidates say that the commission had issued the advertisement on August 10 last year. The result of the preliminary examination came on 26 May 2022.
Two cut off lists for unreserved category were drawn in the exam. The cut off for women candidates of Uttarakhand origin was 79. The petitioner women submitted that their marks were more than 79, but they were disqualified. The petitioner told the court that as per the mandate, 30 percent horizontal reservation is being given to women of Uttarakhand origin, which is unconstitutional.
States cannot give reservation on the basis of accommodation
The petitioner’s advocate Kartikeya Harigupta told the court that as per the mandate dated 18 July 2001 and 24 July 2006, 30 percent horizontal reservation is being given to women of Uttarakhand origin, which is unconstitutional.
According to Article 16 of the Constitution, no state can give reservation on the basis of housing, only Parliament has this right. The state can give reservation only to the economically weaker and backward sections. After hearing the matter, the court has issued notice to the state government and the state public service commission and directed them to file a reply.
