नई दिल्ली | [कोर्ट बुलेटिन] | सीजेआई (प्रधान न्यायाधीश) के कार्यालय को आरटीआई (सूचना के अधिकार) कानून के दायरे में लाने संबंधी दिल्ली उच्च न्यायालय के फैसले को चुनौती देने वाली याचिकाओं पर उच्चतम न्यायालय बुधवार को 3-2 से फैसला सुनाया। फैसले के अनुसार ऑफिस ऑफ सीजेआई (प्रधान न्यायाधीश) आरटीआई के दायरे में आएगा। सुप्रीम कोर्ट ने दिल्ली हाईकोर्ट के फैसले को बरकरार रखते हुए कहा कि ‘ट्रांसपेरेंसी ज्यूडिशियल इंडिपेंडेंसी’ को कमतर नहीं आंकती है। हाईकोर्ट के फैसले में कहा गयाथी कि चीफ जस्टिस का पद सूचना के अधिकार के दायरे में आता है।
सीजेआई रंजन गोगोई के नेतृत्व वाली 5 न्यायाधीशों की संविधान पीठ ने आज अपराह्न दो बजे फैसला सुनाया। पीठ के अन्य सदस्य न्यायमूर्ति एन वी रमण, न्यायमूर्ति डी वाई चंद्रचूड़, न्यायमूर्ति दीपक गुप्ता और न्यायमूर्ति संजीव खन्ना हैं। फैसला सुनाए जाने का नोटिस मंगलवार अपराह्न उच्चतम न्यायालय की आधिकारिक वेबसाइट पर सार्वजनिक किया गया था। पांच न्यायाधीशों की संविधान पीठ ने उच्च न्यायालय और केंद्रीय सूचना आयोग (सीआईसी) के आदेशों के खिलाफ 2010 में शीर्ष अदालत के महासचिव और केंद्रीय लोक सूचना अधिकारी द्वारा दायर अपीलों पर गत चार अप्रैल को निर्णय सुरक्षित रख लिया था।

सीजेआई रंजन गोगोई ने पहले यह कहा था कि पारदर्शिता के नाम पर एक संस्था को नुकसान नहीं पहुंचाया जाना चाहिए। नवंबर 2007 में आरटीआई कार्यकर्ता सुभाष चंद्र अग्रवाल ने आरटीआई याचिका दाखिल कर सुप्रीम कोर्ट से जजों की संपत्ति के बारे में जानकारी मांगी थी जो उन्हें देने से इनकार कर दिया गया।
CJI’s office will come under RTI: Supreme Court
New Delhi | [Court Bulletin] | The Supreme Court on Wednesday delivered a 3-2 verdict on petitions challenging the Delhi High Court’s decision to bring the office of the CJI (Chief Justice) under the purview of the RTI (right to information) Act. According to the judgment, the Office of the CJI (Chief Justice) will come under the purview of RTI. The Supreme Court upheld the decision of the Delhi High Court, saying that ‘transparency does not undermine judicial independence’. In the High Court’s decision, it was said that the post of Chief Justice comes under the purview of Right to Information.
A 5-judge Constitution Bench headed by CJI Ranjan Gogoi delivered the verdict at 2 PM today. The other members of the bench are Justice NV Ramana, Justice DY Chandrachud, Justice Deepak Gupta and Justice Sanjiv Khanna. The notice for the pronouncement of the judgment was made public on the official website of the Supreme Court on Tuesday afternoon. A five-judge constitution bench had on April 4 reserved its judgment on appeals filed by the apex court’s general secretary and the Central Public Information Officer in 2010 against the orders of the high court and the Central Information Commission (CIC).

CJI Ranjan Gogoi had earlier said that an institution should not be harmed in the name of transparency. In November 2007, RTI activist Subhash Chandra Agrawal filed an RTI petition seeking information from the Supreme Court about the assets of judges, which was denied to him.
