प्रयागराज | [कोर्ट बुलेटिन] | योगी सरकार और अखिलेश यादव ने अपने कार्यकाल में 2-2अधिसूचनाएं जारी कर उत्तर प्रदेश में 18 OBC जातियों को अनुसूचित जाति में शामिल करने की बात कही थी। इलाहाबाद हाईकोर्ट ने उत्तर प्रदेश में 18 OBC जातियों को अनुसूचित जाति वर्ग में शामिल करने के संदर्भ में जारी सभी अधिसूचनाएं रद्द कर दी हैं। याची के अधिवक्ता राकेश गुप्ता ने आदेश की जानकारी देते हुए बताया कि इलाहाबाद हाईकोर्ट ने इन सभी अधिसूचनाओं के अमल पर पहले ही रोक लगा रखी थी।
गौरतलब है कि इससे पहले वर्ष 2005 में तत्कालीन मुलायम सिंह यादव सरकार ने भी डेढ़ दर्जन OBC जातियों को अनुसूचित जाति वर्ग की सूची में शामिल करने का फैसला किया था। इलाहाबाद हाईकोर्ट ने उस पर भी रोक लगा दी थी।
अधिसूचनाओं में शामिल OBC की 18 जातियां
ओबीसी की जिन जातियों को अनुसूचित जाति वर्ग में शामिल करने की अधिसूचनाएं जारी की गई थीं, उनमें मझवार, कहार, कश्यप, केवट, मल्लाह, निषाद, कुम्हार, प्रजापति, धीवर, बिंद, भर, राजभर, धीमान, बाथम, तुरहा, गोड़िया, मांझी और मछुआ शामिल हैं।
कोर्ट ने अपने आदेश में सरकारों के कामकाज को लेकर तल्ख टिप्पणी भी की है। कहा कि संवैधानिक अधिकार न होने के बावजूद यूपी में राजनीतिक लाभ के लिए बार-बार अनुसूचित जातियों की सूची में फेरबदल किया जा रहा था। कोर्ट ने कहा कि संविधान के अनुच्छेद 341 के तहत अनुसूचित वर्ग की सूची में बदलाव का अधिकार केवल देश की संसद को है। केंद्र व राज्य सरकारों को इस सूची में बदलाव का कोई अधिकार संविधान ने नहीं दिया है।
जनहित याचिकाओं की सुनवाई
एक खास बात यह भी कि राज्य सरकार ने कोर्ट में हलफनामा दाखिल कर कहा कि उसके पास यह अधिसूचना जारी रखने का कोई संवैधानिक अधिकार नहीं है। सरकार की ओर से प्रस्तुत इस दलील के आधार पर ही कोर्ट ने याचिकाएं मंज़ूर कर लीं। यह आदेश मुख्य न्यायमूर्ति राजेश बिंदल एवं न्यायमूर्ति जेजे मुनीर की खंडपीठ ने गोरखपुर के डॉ. भीमराव अंबेडकर ग्रंथालय एवं जन कल्याण समिति की दो जनहित याचिकाओं पर सुनवाई के बाद दिया है।
पहले भी लग चुकी है रोक
अखिलेश यादव सरकार ने 21 व 22 दिसंबर 2016 को चुनाव से ठीक पहले दो अधिसूचनाएं जारी कर 18 OBC जातियों को अनुसूचित जाति वर्ग में शामिल करने की बात कही थी। कोर्ट ने सभी अधिसूचनाएं रद्द कर दीं। 24 जून 2019 को वर्तमान सरकार ने हाईकोर्ट के एक फैसले का गलत संदर्भ लेते हुए अधिसूचना जारी की थी।
इसके तहत डेढ़ दर्जन OBC जातियों को अनुसूचित जाति वर्ग की सूची में शामिल करने का आदेश जारी किया था कुछ ही दिनों बाद हाईकोर्ट ने अखिलेश यादव सरकार की दोनों अधिसूचनाओं के अमल पर रोक लगा दी थी। वर्तमान प्रदेश सरकार के आदेश पर भी हाईकोर्ट से स्टे हो गया था।

18 castes of OBC included in the notifications
Among the OBC castes which were notified to be included in the Scheduled Castes category were Majhwar, Kahar, Kashyap, Kewat, Mallah, Nishad, Kumhar, Prajapati, Dhivar, Bind, Bhar, Rajbhar, Dhiman, Batham, Turha, Godiya. , fisherman and fisherman.
In its order, the court has also made strong remarks about the functioning of the governments. Said that despite not having constitutional rights, the list of Scheduled Castes was being reshuffled repeatedly for political gains in UP. The court said that only the Parliament of the country has the right to change the list of Scheduled Castes under Article 341 of the Constitution. The Constitution has not given any right to the Central and State Governments to change this list.

One special thing is that the state government has filed an affidavit in the court saying that it has no constitutional right to continue this notification. On the basis of this argument presented by the government, the court allowed the petitions. This order has been given by the division bench of Chief Justice Rajesh Bindal and Justice JJ Munir after hearing two public interest litigations of Dr. Bhimrao Ambedkar Library and Public Welfare Committee of Gorakhpur.

The Akhilesh Yadav government had issued two notifications on 21 and 22 December 2016, just before the elections, to include 18 OBC castes in the Scheduled Caste category. The court quashed all the notifications. On June 24, 2019, the present government had issued a notification taking a wrong reference to a decision of the High Court.
Under this, an order was issued to include one and a half dozen OBC castes in the list of Scheduled Castes, a few days later, the High Court had stayed the implementation of both the notifications of the Akhilesh Yadav government. On the orders of the present state government, the High Court was also stayed.
