नई दिल्ली | [कोर्ट बुलेटिन] | सरकारी स्कूलों में छात्राओं के लिए सैनिटरी नैपकिन (Sanitary Napkins) की सुविधा तत्काल बहाल करने की मांग वाली जनहित याचिका पर दिल्ली हाईकोर्ट ने सोमवार को दिल्ली सरकार से जवाब मांगा है। हाईकोर्ट ने कहा कि एक सामाजिक कार्य का केवल कॉन्ट्रैक्ट नहीं होने के कारण बंद होना सही नहीं है।

 

 

दिल्ली सरकार के वकील ने कार्यवाहक मुख्य न्यायाधीश विपिन सांघी की अध्यक्षता वाली बेंच को बताया कि इस सुविधा को जनवरी 2021 से बंद कर दिया गया था और गर्मियों की छुट्टी के बाद स्कूलों के फिर से खुलने के बाद इसके शुरू होने की संभावना है क्योंकि ताजा निविदा पहले ही निकाली जा चुकी है और जल्द ही इसके अंतिम रूप दिए जाने की संभावना है।

 

बेंच में जस्टिस सचिन दत्ता भी शामिल थे। बेंच ने सवाल किया कि अंतरिम व्यवस्था नहीं होने की स्थिति में आखिर इस तरह के कदम को क्यों रोका जाना चाहिए और कहा कि सरकार को हमेशा सरकारी ई-मार्केटप्लेस से अप्रूव्ड रेट्स पर सामान खरीदना होता है।

 

अदालत ने कहा कि दिल्ली सरकार को ऐसी स्थितियों से निपटने के लिए एक नीति बनाी चाहिए, जहां मौजूदा कॉन्ट्रैक्ट समय के साथ समाप्त हो जाते हैं। अदालत ने कहा कि केवल मौजदा अनुबंध की अनुपस्थिति ही इस तरह के सामाजिक कदम के बंद होने के लिए पर्याप्त नहीं होते हैं बल्कि जब मौजूदा अनुबंध समय के साथ समाप्त हो जाते हैं, तो दिल्ली सरकार को ऐसी स्थिति से निपटने के लिए एक नीति विकसित करनी चाहिए।

 

एनजीओ ‘सोशल ज्यूरिस्ट’ की याचिका में दावा किया गया है कि जनवरी 2021 से शिक्षा निदेशालय (डीओई) दिल्ली के सरकारी स्कूलों की छात्राओं को किशोरी योजना के तहत सैनिटरी नैपकिन उपलब्ध नहीं करा रहा है, जिससे उन्हें समस्या का सामना करना पड़ रहा है।

 

वकील अशोक अग्रवाल और कुमार उत्कर्ष के माध्यम से दायर याचिका में कहा गया है कि डीओई ने किशोरी योजना को अपनाया, जिसके तहत दिल्ली के सरकारी स्कूलों में पढ़ने वाली छात्राओं को उनकी व्यक्तिगत स्वच्छता और बेहतर स्वास्थ्य बनाए रखने तथा पढ़ाई में आने वाली बाधाओं को दूर करने के लिए सैनिटरी नैपकिन प्रदान किए जाने थे।

 

याचिका में कहा गया है कि सरकारी स्कूलों में छात्राओं के लिए सैनिटरी नैपकिन की सुविधा की बहाली उनकी व्यक्तिगत स्वच्छता के लिए बहुत महत्वपूर्ण और आवश्यक है।

 

इसने दलील दी कि सैनिटरी नैपकिन की सुविधा प्रदान नहीं करने के लिए डीओई की ओर से जो कार्रवाई की गई वह तर्कहीन, अनुचित, मनमाना और छात्राओं की शिक्षा के मौलिक अधिकार, संविधान के तहत दिए गए मुफ्त एवं अनिवार्य शिक्षा का अधिकार और दिल्ली स्कूल शिक्षा अधिनियम के प्रावधानों का उल्लंघन है। मामले की अगली सुनवाई 6 जुलाई 2022 को होगी।

The petition, filed through advocates Ashok Aggarwal and Kumar Utkarsh, said that the DoE adopted the Kishori scheme, under which girl students studying in Delhi government schools, to maintain their personal hygiene and good health and to remove obstacles in studies.
