नई दिल्ली | [कोर्ट बुलेटिन] | रोहिणी स्थित एमएसीटी न्यायाधीश सिद्धार्थ माथुर की अदालत ने सड़क दुर्घटना के एक मामले में महत्वपूर्ण फैसला सुनाया है। अदालत ने दुर्घटना में जान गंवाने वाले युवक की अविवाहित बड़ी बहन को मुआवजा पाने का हकदार माना है। अदालत ने अपने आदेश में कहा है कि युवक अपने माता-पिता का इकलौता बेटा था। वह पिता का घर चलाने में भी सहायक था। ऐसे में अविवाहित बड़ी बहन भी उस पर निर्भर थी।
रोहिणी स्थित एमएसीटी न्यायाधीश सिद्धार्थ माथुर की अदालत ने मामले में 27 लाख 13 हजार 929 रुपये का मुआवजा पीड़ित परिवार को देने का निर्देश दिया है।
अदालत ने इस राशि को 3 अलग-अलग हिस्सों में 6 फीसदी सालाना ब्याज के साथ परिवार के तीनों सदस्यों माता-पिता व बहन को देने के निर्देश दिए हैं। हालांकि, दुर्घटना में प्रयुक्त वाहन का बीमा करने वाली कंपनी ने बहन का मुआवजा देने का विरोध किया। बीमा कंपनी का कहना था कि बड़ी बहन अपने छोटे भाई पर निर्भर कैसे हो सकती है।
इस पर अदालत ने संयुक्त परिवार की प्रथा का हवाला देते हुए कहा कि घर की बेटी परिवार के हर सदस्य की जिम्मेदारी होती है। सामाजिक ताने-बाने के अनुसार, पिता व भाई के लिए अविवाहित बेटी की शादी व अन्य खर्च उठाना सामान्य व्यवहार की बात है।
मृतक पेशे से था ड्राइवर
मां के अनुसार, उनका 22 साल का बेटा ड्राइवर था। वह पिता के साथ घर खर्च चलाने की पूरी जिम्मेदारी निभा रहा था। उसकी मासिक आय 19 हजार रुपये थी। वह अपनी बेटी की शादी की तैयारी कर रहे थे। इसके लिए पिता व भाई ज्यादा से ज्यदा रकम जुटाना चाहते थे, लेकिन इसी बीच उनका जवान बेटा सड़क हादसे का शिकार हो गया। इससे पूरा परिवार बुरी तरह टूट गया है। इकलौते बेटे की मौत कई तरह परिवार को तोड़ गई है।
मोटरसाइकिल को टैंकर ने मारी थी टक्कर
यह घटना 27 जुलाई 2018 को कराला गांव के नजदीक हुई थी। मृतक राहुल अपने दोस्त बादाम सिंह के साथ मोटरसाइकिल पर सुबह साढ़े 5 बजे जिम जा रहा था, तभी उलटी दिशा से आ रहे टैंकर ने मोटरसाइकिल को टक्कर मार दी। राहुल की मौके पर ही मौत हो गई, जबकि बादाम सिंह को मामूली चोट आई।
इस मामले में अदालत ने बादाम सिंह को इलाज पर खर्च आए 5 हजार रुपये देने के आदेश बीमा कंपनी को दिए हैं।

The court, in its order, said that the youth was the only son of his parents. He was also helpful in running the father’s house. In such a situation, the unmarried elder sister was also dependent on him.
The court of MACT Judge Siddharth Mathur at Rohini has directed to pay compensation of Rs 27 lakh 13 thousand 929 to the victim’s family in the case.
The court has directed to pay this amount in three different parts with interest of 6 per cent per annum to the three members of the family, parents and sister. However, the company insuring the vehicle used in the accident objected to the compensation of the sister. The insurance company said that how can the elder sister be dependent on her younger brother.
On this, the court, referring to the practice of joint family, said that the daughter of the house is the responsibility of every member of the family. According to the social fabric, it is normal practice for a father and brother to bear the wedding and other expenses of an unmarried daughter.
The deceased was a driver by profession
According to the mother, her 22-year-old son was the driver. He was taking full responsibility of running the household expenses with his father. His monthly income was 19 thousand rupees. He was preparing for his daughter’s wedding. For this, the father and brother wanted to raise as much money as possible, but in the meantime their young son became a victim of a road accident. The whole family is badly broken by this. The death of the only son has broken the family in many ways.
The tanker hit the motorcycle
The incident took place on July 27, 2018 near Karala village. The deceased Rahul, along with his friend Badam Singh, was going to the gym at 5.30 am on a motorcycle, when a tanker coming from the opposite direction hit the motorcycle. Rahul died on the spot, while Badam Singh suffered minor injuries.
In this case, the court has given orders to the insurance company to pay Rs 5 thousand for the treatment of Badam Singh.
