कोच्चि | [कोर्ट बुलेटिन] | एक दलित महिला के यौन शोषण के मामले में सामाजिक कार्यकर्ता और लेखक सिविक चंद्रन को जमानत देने के सत्र न्यायालय के फैसले को केरल सरकार ने हाई कोर्ट में चुनौती दी है। केरल सरकार की ओर से दायर याचिका में कहा गया है कि निचली अदालत का फैसला अवैधता और त्रुटियों से ग्रस्त है। इसके साथ-साथ सरकार ने यह भी कहा कि निचली अदालत का फैसला अपराध को रोकने के लिए बनाए गए कानून की भावनाओं के खिलाफ है।

 

मामले में चंद्रन को जमानत देते हुए, कोझीकोड सत्र न्यायालय के न्यायाधीश एस कृष्णकुमार ने 2 अगस्त को अपने आदेश में कहा था कि आरोपी एक सुधारवादी है, और जाति व्यवस्था के खिलाफ है और ऐसे में यह विश्वास करने योग्य नहीं है कि वह शरीर को छूएंगा वो भी यह जानते हुए कि पीड़िता अनुसूचित जाति (एससी) से संबंधित है। कोर्ट ने आगे कहा कि विधान के तहत प्रथम दृष्टया उनके खिलाफ मामला नहीं बनता है क्योंकि वह वह जाति व्यवस्था के खिलाफ लड़ाई लड़ रहे हैं।

 

सरकार बोली- फैसला कानून की भावना के खिलाफ

 

अपनी अपील में, राज्य सरकार ने तर्क दिया है कि सत्र न्यायालय की ओर से पारित आदेश पूरी तरह से अस्थिर है और अत्याचारों की रोकथाम के लिए बनाए गए कानून की भावना के खिलाफ है, इसलिए इसे रद्द किया जा सकता है। सरकार ने कहा कि सत्र अदालत ने आदेश में यह कहते हुए गंभीर गलती की कि आरोपी के खिलाफ प्रथम दृष्टया कोई मामला नहीं बनता है। पीड़ित के बयान और अब तक की गई जांच के नतीजों से आरोपी की मिलीभगत का पता चला और पर्याप्त सबूत भी हैं।

 

राज्य सरकार ने कहा कि अदालत ने इस तथ्य पर विचार करने से इंकार कर दिया कि आरोपी के खिलाफ कथित अपराध एक महिला की ईच्छा के खिलाफ है जो कि गंभीर प्रकृति का है। सरकार ने सत्र न्यायाधीश पर गिरफ्तारी पूर्व जमानत के आवेदन पर आकस्मिक और बेतरतीब ढंग से विचार करने का आरोप लगाते हुए कहा कि न्यायिक अधिकारी ने एक बहुत ही गंभीर मामले में असंवेदनशील और अकल्पनीय तरीके से गलत डायरेक्शन का इस्तेमाल किया है।

 

उत्तेजक पोशाक का दिया था हवाला

 

इसी न्यायाधीश ने 12 अगस्त को इसी आरोपी को यौन उत्पीड़न के एक मामले में जमानत देते हुए अपनी टिप्पणी में कहा था कि चूंकि महिला ने उत्तेजक पोशाक पहन रखी थी इसलिए प्रथम दृष्टया यौन उत्पीड़न का मामला नहीं बनता है। कोझिकोड सत्र अदालत ने टिप्पणी की थी कि जमानत अर्जी के साथ आरोपी द्वारा पेश की गई शिकायतकर्ता की तस्वीर यह स्पष्ट करेगी कि उसने उत्तेजक पोशाक पहन रखी थी और यह मानना असंभव है कि 74 वर्षीय दिव्यांग व्यक्ति शिकायतकर्ता को जबरन अपनी गोद में बिठा सकता है और उसका यौन उत्पीड़न किया।

The petition, filed on behalf of the Kerala government, said that the trial court’s decision is plagued with illegality and errors. Along with this, the government also said that the decision of the lower court is against the spirit of the law made to prevent crime.

 

While granting bail to Chandran in the case, Kozhikode Sessions Court Judge S Krishnakumar, in his order on August 2, held that the accused is a reformist, and is against the caste system and as such it is not credible that he will touch the body. That too knowing that the victim belongs to Scheduled Caste (SC). The court further said that prima facie case against him is not made out under the legislation as he is fighting a fight against the caste system.

 

 Government bid – decision against the spirit of the law

 

In its appeal, the State Government has argued that the order passed by the Sessions Court is completely untenable and against the spirit of the law made for the prevention of atrocities, hence it can be set aside. The government said that the sessions court made a grave mistake in the order saying that prima facie no case is made out against the accused. The statement of the victim and the results of the investigation conducted so far revealed the complicity of the accused and there is sufficient evidence.

 

The state government said that the court refused to consider the fact that the alleged offense against the accused was against the will of a woman which was serious in nature. The government accused the Sessions Judge of considering the pre-arrest bail application in a haphazard and haphazard manner, saying the judicial officer had used insensitive and unimaginable wrong direction in a very serious matter.

On August 12, the same judge, while granting bail to the same accused in a sexual harassment case, had observed that since the woman was wearing a provocative dress, prima facie a case of sexual harassment does not make out. The Kozhikode Sessions Court had observed that the photograph of the complainant produced by the accused along with the bail application would make it clear that he was dressed in provocative attire and it was impossible to believe that a 74-year-old disabled person could forcibly make the complainant sit on his lap and sexually assaulted her.
