नई दिल्ली | [कोर्ट बुलेटिन] | धर्म संसद को लेकर भाजपा शासित हिमाचल प्रदेश और उत्तराखंड की सुप्रीम कोर्ट ने मंगलवार को जमकर खिंचाई की। न्यायालय ने उत्तराखंड के मुख्य सचिव को निर्देश दिया कि वह अदालत में सार्वजनिक रूप से यह कहें कि रुड़की में निर्धारित ‘धर्म संसद’ में कोई अप्रिय बयान नहीं दिया जाएगा। कार्यक्रम बुधवार को होना है। इसके अलावा शीर्ष अदालत ने हिमाचल प्रदेश से भी सवाल पूछा।

 

एक अलग सुनवाई में, सुप्रीम कोर्ट ने इस महीने की शुरुआत में एक कार्यक्रम पर हिमाचल प्रदेश सरकार से भी तीखे सवाल किए। इस कथित धर्म संसद में मुसलमानों के खिलाफ नफरत भरे भाषण दिए गए थे और हिंदुओं को हिंसा का सहारा लेने का आह्वान किया गया था।

 

शीर्ष अदालत ने हिमाचल की भाजपा सरकार से पूछा कि उसने आग लगाने वालों के खिलाफ तुरंत कार्रवाई क्यों नहीं की। अदालत ने कहा, “सरकार को इस तरह की गतिविधि को रोकना होगा। राज्य सरकार को हमें बताना होगा कि क्या कोई निवारक उपाय किए गए थे या नहीं।”

 

9 मई को फिर से सुनवाई के लिए मामले को सूचीबद्ध करते हुए कहा, “सरकार को 7 मई तक एक हलफनामा दाखिल करना होगा और हमें बताना होगा कि ऐसी घटनाओं को रोकने के लिए क्या कदम उठाए गए।” न्यायाधीशों ने कहा, “ये घटनाएं अचानक नहीं होती हैं। वे रातोंरात नहीं होती हैं। ये पहले से घोषित की जाती हैं। आपने तुरंत कार्रवाई क्यों नहीं की? सुप्रीम कोर्ट के दिशानिर्देश पहले से ही मौजूद हैं।”

 

कहिए कि ‘धर्म संसद’ में कोई अप्रिय बयान नहीं दिया जाएगा: न्यायालय

 

सुप्रीम कोर्ट ने उत्तराखंड के मुख्य सचिव को निर्देश दिया कि वह अदालत में सार्वजनिक रूप से यह कहें कि रुड़की में निर्धारित ‘धर्म संसद’ में कोई अप्रिय बयान नहीं दिया जाएगा। यह कार्यक्रम बुधवार को होना है।

 

न्यायमूर्ति ए एम खानविलकर की अध्यक्षता वाली तीन न्यायाधीशों की पीठ ने उत्तराखंड सरकार द्वारा दिए गए इस आश्वासन पर गौर किया कि अधिकारियों को विश्वास है कि आयोजन के दौरान कोई अप्रिय बयान नहीं दिया जाएगा और इस अदालत के फैसले के अनुसार सभी कदम उठाए जाएंगे।

 

पीठ में न्यायमूर्ति अभय एस ओका और न्यायमूर्ति सी टी रविकुमार भी शामिल हैं। पीठ ने कहा, “हम उत्तराखंड के मुख्य सचिव को उपरोक्त आश्वासन सार्वजनिक रूप से कहने और सुधारात्मक उपायों से अवगत कराने का निर्देश देते हैं।”

 

पिछले साल दिसंबर में हरिद्वार में आयोजित तीन दिवसीय ‘धर्म संसद’ के संबंध में प्राथमिकी दर्ज की गई थी, जहां एक समुदाय के सदस्यों को निशाना बनाकर नफरत भरे भाषण दिए गए थे।

In a separate hearing, the Supreme Court also took sharp questions from the Himachal Pradesh government over a program earlier this month. Hate speeches against Muslims were made in this alleged religion parliament and Hindus were called upon to resort to violence.

 

The top court asked the BJP government in Himachal why it did not take immediate action against those who set the fire. “The government has to stop such activity. The state government has to tell us whether any preventive measures were taken or not,” the court said.

 

Listing the matter for hearing again on May 9, it said, “The government will have to file an affidavit by May 7 and tell us what steps were taken to prevent such incidents.” The judges said, “These incidents do not happen suddenly. They do not happen overnight. They are announced in advance. Why didn’t you act immediately? The Supreme Court guidelines are already in place.”

 

  Say no obnoxious statement will be made in ‘Dharma Sansad’: SC

 

The Supreme Court directed the Chief Secretary of Uttarakhand to publicly state in the court that no obnoxious statement would be made in the ‘Dharma Sansad’ set up in Roorkee. The event is to be held on Wednesday.

 

A three-judge bench headed by Justice AM Khanwilkar took note of the assurance given by the Uttarakhand government that the authorities are confident that no obnoxious statement will be made during the event and that all steps will be taken as per the decision of this court.

 

The bench also includes Justice Abhay S Oka and Justice CT Ravikumar. “We direct the Chief Secretary of Uttarakhand to state the above assurances publicly and apprise him of the corrective measures,” the bench said.

 

The FIR was registered in connection with the three-day ‘Dharma Sansad’ held in Haridwar in December last year, where hate speeches were made targeting members of a community.
