तिरुवनंतपुरम | [कोर्ट बुलेटिन] | कॉमर्शियल बिल्डिंग गिराकर नमाज स्थल बनाने की याचिका केरल हाई कोर्ट ने शुक्रवार को खारिज कर दी। जज ने मामले में फैसला सुनाते हुए कहा कि अगर इस तरह से जगह-जगह पूजा स्थल बनाने लगे तो लोगों के लिए रहने के जगह कम पड़ जाएगी। मामले में नूरुल इस्लाम ने याचिका दायर की थी। इसकी सुनवाई केरल हाई कोर्ट में जस्टिस पीवी कुन्हीकृष्णन की बेंच कर रही थी। याचिकाकर्ता ने एक कॉमर्शियल बिल्डिंग को गिराकर वहां पर नमाज के लिए स्थान बनाने की अपील की थी।

 

नीलांबुर के थोटेक्कड़ के रहने वाले इस शख्स ने याचिका में मल्लपुरम जिला कलेक्टर, एसएसपी, स्थानीय थानाध्यक्ष, ग्राम पंचायत और स्थानीय निवासियों को भी पक्षकार बनाया था।

 

घरों से ज्यादा मस्जिदें

 

मामले की सुनवाई करते हुए जज ने कहा कि 2011 की जनगणना के मुताबिक केरल में पहले ही विभिन्न समुदायों के लिए पर्याप्त धार्मिक स्थल हैं। जहां तक इस याचिका का सवाल है, याचिकाकर्ता द्वारा बताई गई जगह से 5 किमी के दायरे में करीब 36 मस्जिदें हैं। उन्होंने कहा कि यहां तो गांवों से 10 गुना ज्यादा पूजास्थल हैं। ऐसे में यहां एक और प्रार्थना स्थल क्यों होना चाहिए यह एक बड़ा सवाल है।

 

जज ने कुरान का हवाला देते हुए कहा कि इस पवित्र किताब में मुस्लिम समुदाय के लिए मस्जिद की महत्ता बताई गई है। लेकिन यह भी नहीं कहा गया है कि हर गली-कूचे में मस्जिद होनी चाहिए। इसके साथ ही जज ने केरल के मुख्य सचिव को आदेश दिया कि वह किसी भी बिल्डिंग के धार्मिक स्थल में बदलाव का आदेश न दिया जाए।

 

इस तरह का कोई भी आदेश देने से पहले संबंधित अधिकारियों से रिपोर्ट ली जानी चाहिए। उन्होंने कहा कि मुख्य सचिव इस तरह का कोई भी प्रार्थना पत्र लेते वक्त इस बात का ध्यान रखें कि उसमें नजदीकी धर्मस्थल की दूरी का जिक्र जरूर हो।

 

भगवान तो सभी जगह

 

जज ने आगे कहा कि भगवान तो सभी जगहों पर हैं। अगर मुस्लिम समुदाय के लोग मस्जिद में ही नमाज पढ़ना चाहते हैं तो उन्हें इसके लिए नए पूजास्थल की मांग करने के बजाए नजदीक की किसी मस्जिद में जाना चाहिए। इंडियन एक्सप्रेस के मुताबिक जज ने कहा कि इस समय में हर किसी के पास वाहन हैं। आने-जाने के लिए साइकिलें भी उपलब्ध हैं।

 

इससे भी बड़ी बात कि मस्जिद की तरफ जाने पर अनुयायियों के कद में इजाफा होगा और उनके पाप नष्ट होंगे। जज ने कहा कि नमाज के लिए घर से 10 या 100 मीटर की दूरी पर ही नमाज स्थल का होना जरूरी नहीं है। पैगंबर मोहम्मद को दिल से मानने वाले मस्जिद में जाकर खुशी से नमाज पढ़ते हैं।

The petition was filed by Noorul Islam in the matter. It was being heard by a bench of Justice PV Kunhikrishnan in the Kerala High Court. The petitioner had appealed to demolish a commercial building and make a place for Namaz there.

 

The man, a resident of Thotekkad in Nilambur, had also made the Mallapuram district collector, SSP, local police station head, gram panchayat and local residents party in the petition.

Hearing the matter, the judge said that Kerala already has enough religious places for different communities as per the 2011 census. As far as this petition is concerned, there are about 36 mosques within a radius of 5 km from the place mentioned by the petitioner. He said that there are 10 times more places of worship here than in the villages. So why should there be another place of prayer here is a big question.

 

The judge cited the Quran and said that the importance of the mosque for the Muslim community has been told in this holy book. But it is also not said that there should be a mosque in every street. Along with this, the judge ordered the Chief Secretary of Kerala not to order any change in the religious place of any building.

 

A report should be taken from the concerned authorities before giving any such order. He said that while taking any such application, the Chief Secretary should keep in mind that the distance of the nearest shrine must be mentioned in it.

The judge further said that God is everywhere. If the people of the Muslim community want to offer Namaz in the mosque itself, then instead of demanding a new place of worship for it, they should go to a nearby mosque. According to the Indian Express, the judge said that everyone has vehicles at this time. Bicycles are also available for commuting.

 

More importantly, on going towards the mosque, the followers will increase in stature and their sins will be destroyed. The judge said that it is not necessary for the place of prayer to be at a distance of 10 or 100 meters from the house for Namaz. Those who believe in the heart of Prophet Muhammad go to the mosque and offer Namaz happily.
