कलकत्ता | [कोर्ट बुलेटिन] | पश्चिम बंगाल के मालदा में 2 महिलाओं ने कलकत्ता हाईकोर्ट में एक विशेष अनुमति याचिका दायर की है, जिसमें उनके पतियों के जबरन इस्लाम धर्म परिवर्तन का आरोप लगाया गया है। मामले का संज्ञान लेते हुए कलकत्ता हाईकोर्ट ने NIA और CBI को घटना की जांच के आदेश दिए हैं।
दोनों महिलाओं की ओर से दायर याचिका के मुताबिक, उनके पति पिछले साल 24 नवंबर को लापता हो गए थे। जब महिलाएं पुलिस थाने में शिकायत दर्ज कराने गईं, तो एक शख्स ने उनकी शिकायत को यह कहकर फाड़ दिया कि दोनों के पतियों ने इस्लाम धर्म कबूल कर लिया है। महिलाओं का आरोप है कि इसके बाद, उन्होंने मालदा के एसपी ऑफिस में शिकायत दर्ज कराई लेकिन उन्होंने भी कोई कार्रवाई नहीं की।
दरअसल, दोनों याचिकाकर्ता बहनें हैं और उनके पति भी आपस में भाई हैं। दोनों महिलाओं का आरोप है कि उनके पतियों ने विधानसभा चुनाव में किसी पार्टी के लिए काम किया था, जो चुनाव हार गई थी। 24 नवंबर 2021 को अपने पति के लापता होने के बाद याचिकाकर्ताओं ने मोथाबारी और कालियाचक पुलिस थानों में भी शिकायत दर्ज कराई थी।
हाईकोर्ट में सुनवाई के दौरान राज्य की ओर से पेश अधिवक्ता मोहम्मद गालिब ने कहा कि पारिवारिक विवादों के कारण याचिकाकर्ताओं के पति उन्हें छोड़कर मालदा के प्रतापपुर में रह रहे हैं। उन्होंने कहा कि 2 लोगों ने स्वेच्छा से इस्लाम धर्म अपना लिया है। यहां तक कि उन्होंने अपने घर लौटने से भी इनकार कर दिया है।
मोहम्मद गालिब ने अदालत को यह भी बताया कि उनके पतियों ने धारा 164 के तहत गवाही दी है कि उन्होंने स्वेच्छा से इस्लाम धर्म अपना लिया है।
दोनों पक्षों को सुनने के बाद न्यायमूर्ति राजशेखर मंथा की एकल पीठ ने मामले की जांच सीबीआई और एनआईए को सौंप दी है। साथ ही एसपी मालदा को मामले में सीबीआई और एनआईए को सहयोग देने का आदेश दिया। अदालत ने एजेंसियों को याचिकाकर्ताओं द्वारा जबरन धर्मांतरण, जाली नोट, हथियार जमा करने और सीमा पार से घुसपैठ के आरोपों की जांच करने का भी आदेश दिया है।
Forced conversion: Calcutta High Court handed over investigation to CBI and NIA
Calcutta | [Court Bulletin] | In Malda, West Bengal, two women have filed a special leave petition in the Calcutta High Court, alleging that their husbands were forcibly converted to Islam. Taking cognizance of the matter, the Calcutta High Court has ordered NIA and CBI to investigate the incident.
According to the petition filed by both the women, her husband had gone missing on November 24 last year. When the women went to the police station to file a complaint, a man tore their complaint saying that both the husbands had converted to Islam. The women allege that after this, they lodged a complaint with the SP office of Malda but they also did not take any action.
Actually, both the petitioners are sisters and their husbands are also brothers among themselves. Both the women allege that their husbands had worked for a party in the assembly elections, which lost the election. After the disappearance of her husband on 24 November 2021, the petitioners had also lodged complaints with the Mothabari and Kaliachak police stations.
During the hearing in the High Court, advocate Mohammad Ghalib, appearing for the state, said that due to family disputes, the husbands of the petitioners are leaving them and living in Pratappur, Malda. He said that 2 people have voluntarily converted to Islam. He has even refused to return to his home.
Mohammad Ghalib also told the court that their husbands have testified under section 164 that they have voluntarily converted to Islam.
After hearing both the sides, a single bench of Justice Rajasekhar Mantha handed over the investigation of the case to CBI and NIA. Also ordered SP Malda to cooperate with CBI and NIA in the case. The court has also ordered the agencies to probe allegations of forced conversions, counterfeit currency, arms hoarding and cross-border infiltration by the petitioners.
