नई दिल्ली | [कोर्ट बुलेटिन] | दिल्ली के जहांगीरपुरी इलाके में बगैर अनुमति लिए निकाले जा रहे हनुमान जयंती शोभा यात्रा पर हुई साम्प्रदायिक हिंसा के 8 आरोपियों को अदालत ने जमानत देने से इनकार कर दिया है। वहीं, अदालत ने दिल्ली पुलिस के रवैये पर भी सख्त टिप्पणी करते हुए कहा है कि इस दंगे की घटना में पुलिस ही कटघरे में खड़ी नजर आ रही है। जिस जुलूस के दौरान यह दंगा हुआ उसे निकालने के लिए अनुमति नहीं ली गई थी, लेकिन बावजूद इसके पुलिस इस जुलूस के साथ ही चल रही थी।
रोहिणी स्थित विशेष न्यायाधीश गगनदीप सिंह की अदालत ने अपने आदेश में कहा है कि पुलिस की एफआईआर ही बता रही है कि स्थानीय पुलिस जिसका नेतृत्व इंस्पेक्टर राजीव रंजन कर रहे थे। साथ ही पुलिस उपायुक्त (रिजर्व) खुद बगैर अनुमति लिए निकाले जा रहे इस जुलूस को रोकने की बजाय इसके साथ सुरक्षा देते हुए चल रहे थे, जबकि उनका कर्तव्य था कि बगैर इजाजत लिए अवैध जुलूस को निकालने की जानकारी मिलते ही उसे वहीं रोक देना चाहिए था। साथ ही भीड़ को भी वहां से हटा दिया जाना चाहिए था, जिससे इस घटना से बचा जा सकता था।
अदालत ने इस आदेश की कॉपी पुलिस कमिश्नर को भेजने के निर्देश देते हुए कहा है कि प्रथमदृष्टया इस मामले में अवैध जुलूस को रोकने में स्थानीय पुलिस की विफलता नजर आती है। ऐसा लगता है कि वरिष्ठ पुलिस अधिकारियों द्वारा अनुमति लेने संबंधी तथ्य को दरकिनार कर दिया गया था।
अदालत ने कहा कि इस संबंध में संबंधित अधिकारियों के दायित्व तय किए जाने की जरूरत है ताकि भविष्य में ऐसी कोई घटना ना हो और ऐसी घटनाओं को रोकने में सक्षम हो। अदालत ने यह भी कहा कि पुलिस का इस घटना के लिए दायित्व तय होने के लिए जांच होनी चाहिए।
ज्ञात रहे कि पुलिस की तरफ से अदालत को बताया गया कि 16 अप्रैल को हनुमान जयंती के मौके पर दो जुलूसों के निकलने की इजाजत ली गई थी, जबकि यह तीसरा जुलूस जिसके दौरान साम्प्रदायिक हिंसा हुई उसकी अनुमति नहीं ली गई थी। हालांकि, पुलिस की तरफ से कहा गया था कि वह तीसरे जुलूस को भी सुरक्षा दे रहे थे।
गवाह सामने आने से बच रहे हैं
हिंसा के 8 आरोपियों की जमानत याचिका खारिज करते हुए अदालत ने कहा है कि पुलिस के मुताबिक, यह आरोपी स्थानीय बदमाश हैं, जिनकी वजह से लोग सामने आकर गवाही देने को तैयार नहीं हैं। यहां तक की वीडियो फुटेज के आधार पर जिन लोगों को पकड़ा गया और जिन लोगों को गवाह बनाया गया। उन गवाहों को भी लगातार धमकियां मिल रही हैं। ऐसे में आरोपियों को जमानत दिया जाना उचित नहीं है। अदालत ने यह भी कहा कि अभी तक इस मामले में चार्जशीट दाखिल नहीं की गई है। मामले की जांच जारी है। 30 आरोपियों की गिरफ्तारी हुई है, जबकि तीन नाबालिग पकड़े गए हैं। पुलिस ने अदालत को बताया था कि घटना में 8 पुलिसकर्मी जख्मी हुए थे, जिनमें से एक को गोली लगी थी।
