नई दिल्ली | [कोर्ट बुलेटिन] | सुप्रीम कोर्ट ने अधिक जनसंख्या की समस्या को लेकर दायर एक याचिका की सुनवाई करते हुए शुक्रवार को केंद्र सरकार को एक नोटिस जारी किया है। याचिका में अधिक जनसंख्या की समस्या को प्रभावी ढंग से कम करने के वास्ते नियम, कानून और दिशानिर्देश बनाने के लिए केंद्र सरकार को निर्देश देने की मांग की गई थी। इसी को लेकर अब सुप्रीम कोर्ट ने केंद्र को नोटिस भेज है। जस्टिस केएम जोसेफ और हृषिकेश रॉय की पीठ ने सरकार से जवाब मांगा और मामले को इसी तरह की अन्य लंबित याचिकाओं के साथ जोड़ दिया है।

 

याचिकाकर्ता ने कहा कि सरकार बढ़ती आबादी को रोजगार नहीं दे पा रही है। न ही भोजन, पानी जैसी बुनियादी जरूरतों को पूरा कर पा रही है। यही वजह है कि इन जरूरी आवश्यकताओं को पूरा करने के लिए जनसंख्या नियंत्रण कानून पर खास ध्यान दिया जाना चाहिए। उन्होंने यह भी कहा कि अगर जनसंख्या कानून जल्दी नहीं लाया जाता, तो देश ‘टूट’ की तरफ बढ़ सकता है।

 

अखिल भारतीय संत समिति के महासचिव दांडी स्वामी जीतेंद्रानंद सरस्वती द्वारा दायर याचिका में कहा गया है कि हर साल जनसंख्या बढ़ रही है लेकिन प्राकृतिक संसाधन सीमित हैं और बढ़ती आबादी को जारी नहीं रख सकते हैं। जनहित याचिका में कहा गया है कि जब बेरोजगारी और गरीबी बढ़ती है, खाद्य आपूर्ति और स्वास्थ्य देखभाल सुविधाओं आदि में भारी वृद्धि होती है, तो राष्ट्र फिर कोई और काम नहीं कर पाता है।

 

जनहित याचिका में अधिक जनसंख्या की समस्या के कारण भारत के लाखों नागरिकों के मौलिक अधिकारों की रक्षा के लिए प्रभावी नियम, कानून और दिशानिर्देश तैयार करने के लिए केंद्र सरकार को निर्देश देने की मांग की गई है।

 

याचिका में कहा गया है कि अधिक जनसंख्या सबसे महत्वपूर्ण कारकों में से एक है जो लाखों भारतीय नागरिकों के जीवन की गुणवत्ता को प्रतिकूल रूप से प्रभावित करने वाली कई गंभीर समस्याओं को जन्म देती है।

 

याचिका में सरकार को अधिक जनसंख्या के बारे में जागरूकता फैलाने और ईडब्ल्यूएस व बीपीएल परिवारों को पोलियो के टीके के साथ गर्भनिरोधक गोलियों, कंडोम, टीकों आदि के वितरण के लिए हर महीने के पहले रविवार को ‘स्वास्थ्य दिवस’ के रूप में घोषित करने के लिए निर्देश देने की भी मांग की गई।

 

याचिकाकर्ता ने कहा कि उन्होंने महसूस किया है, “मानव गरिमा के साथ जीने का अधिकार, स्वच्छ हवा का अधिकार, पीने के पानी का अधिकार, स्वास्थ्य का अधिकार, आश्रय का अधिकार, आजीविका का अधिकार और शिक्षा का अधिकार जैसे बुनियादी मौलिक अधिकार संविधान के तहत गारंटीकृत हैं।

 

जब तक प्रतिवादी (सरकार) अधिक जनसंख्या की समस्या को कम करने के लिए संविधान (एनसीआरडब्ल्यूसी) के कामकाज की समीक्षा के लिए राष्ट्रीय आयोग द्वारा किए गए प्रस्तावों पर उचित विचार नहीं करते, तब तक यह अधिकार पूरी तरह से हमें नहीं मिलेंगे।”

New Delhi | [Court Bulletin] | The Supreme Court, while hearing a petition filed regarding the problem of overpopulation, has issued a notice to the Central Government on Friday. The petition sought a direction to the central government to frame rules, regulations and guidelines to effectively mitigate the problem of overpopulation. Now the Supreme Court has sent a notice to the Center regarding this. A bench of Justices KM Joseph and Hrishikesh Roy sought the government’s response and has clubbed the matter with other similar pending petitions.

 

The petitioner said that the government is not able to provide employment to the growing population. Nor is it able to meet basic needs like food, water. This is the reason why special attention should be given to population control law to meet these essential requirements. He also said that if the population law is not brought soon, the country may move towards ‘broken’.

 

The petition, filed by Dandi Swami Jitendranand Saraswati, general secretary of Akhil Bharatiya Sant Samiti, said that the population is increasing every year but the natural resources are limited and cannot sustain the growing population. The PIL states that when unemployment and poverty rise, there is a huge increase in the food supply and health care facilities etc., the nation can no longer function.

 

The PIL has sought a direction to the Central Government to frame effective rules, laws and guidelines to protect the fundamental rights of millions of citizens of India due to the problem of overpopulation.

 

The petition states that overpopulation is one of the most important factors which give rise to many serious problems adversely affecting the quality of life of millions of Indian citizens.

 

The petition urged the government to declare the first Sunday of every month as ‘Health Day’ to spread awareness about overpopulation and for distribution of contraceptive pills, condoms, vaccines, etc. along with polio vaccine to EWS and BPL families. Instructions were also sought.

 

The petitioner said that he has realized, “The basic fundamental rights like the right to live with human dignity, the right to clean air, the right to drinking water, the right to health, the right to shelter, the right to livelihood and the right to education are enshrined in the Constitution.” guaranteed under.

 

Unless the Respondent (Government) gives due consideration to the proposals made by the National Commission to Review the Working of the Constitution (NCRWC) to mitigate the problem of overpopulation, these rights will not be fully available to us.”
