नई दिल्ली | [कोर्ट बुलेटिन] | डॉक्टरों के एक संघ की उस अपील को दिल्ली उच्च न्यायालय ने खारिज कर दिया जिसमें उसने एफएमजीई (विदेशी चिकित्सा स्नातक परीक्षा) के ‘स्क्रीनिंग टेस्ट’ को कोविड-19 महामारी के चलते टालने के अनुरोध वाली अपनी याचिका अदालत द्वारा खारिज करते हुए लगाये गए जुर्माने और प्रतिकूल टिप्पणी को चुनौती दी थी। अदालत ने इसके साथ ही चिकित्सकों के संघ पर 25 हजार रुपये का और जुर्माना लगा दिया। आपको बता दें कि ऐसे छात्र जो विदेश से एमबीबीएस करते हैं, उन्हें भारत में डॉक्टरी करने का लाइसेंस हासिल करने के लिए एफएमजीई परीक्षा अनिवार्य तौर पर पास करनी होती है।
कार्यवाहक मुख्य न्यायाधीश विपिन सांघी और न्यायमूर्ति नवीन चावला की पीठ ने कहा कि एसोसिएशन ऑफ एमडी फिजिशियंस की अपील में कोई दम नहीं है, जो एकल न्यायाधीश के फैसले के खिलाफ दायर की गई है। पीठ ने साथ ही निर्देश दिया कि जुर्माना दिल्ली राज्य विधिक सेवा प्राधिकरण के पास जमा कराया जाए।
अदालत ने 23 मई के अपने आदेश में कहा, ”हम वर्तमान अपील में कोई दम नहीं पाते हैं। इसे 25,000 रुपये का जुर्माना लगाये जाने के साथ खारिज किया जाता है। उक्त जुर्माना दिल्ली राज्य विधिक सेवा प्राधिकरण के पास जमा कराया जाए।”
अदालत ने कहा कि अपीलकर्ता एक ही परीक्षा के संबंध में दो अलग-अलग याचिकाएं नहीं दायर सकता था – एक उच्चतम न्यायालय के समक्ष और दूसरी उच्च न्यायालय के समक्ष। किसी रिट अधिकार क्षेत्र के तहत, किसी भी पक्षकार को भौतिक तथ्यों को छुपाना नहीं चाहिए और कानूनी कार्यवाही के लिए समानांतर रास्ता नहीं अख्तियार करना चाहिए।
अपीलकर्ता संघ ने एकल न्यायाधीश के 11 जून, 2021 के उस आदेश को चुनौती देते हुए अर्जी दायर की थी जिसमें 18 जून, 2021 को होने वाली परीक्षा को स्थगित करने के अनुरोध वाली याचिका को खारिज करते हुए 25,000 रुपये का जुर्माना लगाया गया था और कुछ टिप्पणी की गई थी।
अपीलकर्ता संघ ने दलील दी थी कि उच्चतम न्यायालय और उच्च न्यायालय के समक्ष मांगी गई राहत अलग थी क्योंकि एकल न्यायाधीश के समक्ष डॉक्टरों ने परीक्षा स्थगित करने का अनुरोध किया था और उच्चतम न्यायालय में अंतरिम राहत के लिए उनका अनुरोध सभी राज्यों को यह निर्देश देने का था कि कोविड-19 महामारी के दौरान कार्यबल में विदेशी चिकित्सा स्नातकों को शामिल किया जाए।
राष्ट्रीय आयुर्विज्ञान आयोग का प्रतिनिधित्व अधिवक्ता टी. सिंहदेव और अभिजीत चक्रवर्ती ने किया और राष्ट्रीय परीक्षा बोर्ड का प्रतिनिधित्व वकील कीर्तिमान सिंह ने किया।

The court also imposed a further fine of Rs 25,000 on the association of doctors. Let us tell you that such students who do MBBS from abroad, they have to compulsorily clear the FMGE exam to get a license to do medicine in India.
A bench of Acting Chief Justice Vipin Sanghi and Justice Navin Chawla observed that there is no merit in the appeal of the Association of MD Physicians, which has been filed against the single judge’s decision. The bench also directed that the fine be deposited with the Delhi State Legal Services Authority.
The court in its order dated May 23 said, “We find no merit in the present appeal. It is dismissed with the imposition of a fine of Rs 25,000. The said fine should be deposited with the Delhi State Legal Services Authority.
The court held that the appellant could not have filed two separate petitions in respect of the same examination – one before the Supreme Court and the other before the High Court. Under a writ jurisdiction, neither party should withhold material facts and should not take parallel course of legal proceedings.
The appellant’s association had filed the application challenging the order of the Single Judge dated June 11, 2021, while dismissing the petition seeking postponement of the examination to be held on June 18, 2021, imposing a fine of Rs 25,000 and some Comment was made.
The appellant’s association had contended that the relief sought before the Supreme Court and the High Court was different as the doctors before a single judge had requested for postponement of the examination and their request for interim relief in the Supreme Court was to direct all the states. was to include foreign medical graduates in the workforce during the COVID-19 pandemic.
National Medical Commission was represented by Advocates T. Singhdeo and Abhijit Chakraborty and National Board of Examination was represented by Advocate Kirtiman Singh.
