प्रयागराज | [कोर्ट बुलेटिन] | डिक्री के निष्पादन से पहले इलाहाबाद हाईकोर्ट ने एसडीएम के आदेश पर एक परिवार को बेदखल कर मकान ध्वस्त करने को गम्भीरता से लिया है। साथ ही तल्ख टिप्पणी करते हुए कहा कि पुलिस लठैत की तरह काम न करे। यह आदेश न्यायमूर्ति सलिल कुमार राय ने मोहम्मद सईद की द्वितीय अपील पर सुनवाई करते हुए दिया है।
कोर्ट ने कहा कि पहले तो मजिस्ट्रेट ने दीवानी अदालत की शक्ति को मनमाने ढंग से हड़प लिया और अपीलार्थी को बेदखल कर मकान ध्वस्त करने का आदेश दिया और फिर पुलिस स्क्वायड ने तत्परता दिखाते हुए अवैध कार्रवाई अंजाम दे दी। उन्होंने अपने दायित्व का निर्वाह नहीं किया।
कोर्ट ने प्रदेश के पुलिस महानिदेशक व प्रमुख सचिव गृह को अधिकारियों को अपने कर्तव्य का पालन करने का प्रशिक्षण देने के कदम उठाने का निर्देश दिया है। कहा कि जिस पुलिस पर नागरिकों के जीवन संपत्ति की रक्षा का दायित्व है, उन्हीं पुलिस व प्रशासनिक अधिकारियों ने अपने कर्तव्य का पालन न कर मनमानी व अवैध कार्रवाई कर डाली।
कोर्ट ने डीएम बलिया व एसडीएम रसड़ा को तलब करते हुए आदेश के अनुपालन का हलफनामा मांगा है और जबरन ढहाए गये मकान की नवैयत में बदलाव न करने का निर्देश दिया है। कोर्ट ने विवादित संपत्ति पर किसी प्रकार के निर्माण पर रोक लगा दी है।
अपीलार्थी को मकान से बेदखल करने का दीवानी मुकदमा चल रहा था।एसडीएम रसड़ा ने बिना किसी डिक्री निस्पादन या अदालती आदेश के कोतवाली पुलिस को मकान खाली कराकर ध्वस्तीकरण का आदेश दे दिया।
हाईकोर्ट ने पुलिस की भूमिका पर अधिकारियों से व्यक्तिगत हलफनामा मांगा था। ट्रेनी सीओ/एसएचओ कोतवाली उस्मान, पुलिस चौकी उत्तरी के उप निरीक्षक रवींद्र कुमार पटेल व क्राइम इंस्पेक्टर राकेश कुमार सिंह ने बताया कि एसडीएम ने डिक्री का पालन करने का निर्देश दिया था, जिस पर मकान खाली कराकर ध्वस्तीकरण कार्रवाई की गई है।
मकान को नगर पालिका परिषद के अधिशासी अधिकारी ने चिह्नित किया था। जबकि एसपी बलिया की रिपोर्ट में बताया गया कि पुलिस जबरन घर में घुसी, गाली गलौज किया और अपीलार्थी के परिवार को बाहर निकाल दिया।
अधिशासी अधिकारी ने बताया कि उसे दरोगा ने कोतवाली बुलाया लेकिन उनके कोतवाली पहुंचने से पहले ध्वस्तीकरण कार्रवाई की जा चुकी थी। कोर्ट ने एसडीएम के आदेश को अवैध करार दिया है।

Prayagraj | [Court Bulletin] | Before the execution of the decree, the Allahabad High Court has taken seriously the demolition of the house by evicting a family on the orders of the SDM. At the same time, while making a scathing remark, said that the police should not act like a lait. This order was given by Justice Salil Kumar Rai while hearing the second appeal of Mohammad Sayeed.
The court said that first the magistrate arbitrarily usurped the power of the civil court and ordered the appellant to be evicted and demolished the house, and then the police squad acted swiftly and illegally. He did not fulfill his duty.
The court has directed the Director General of Police and Principal Secretary Home of the state to take steps to train the officers to perform their duty. Said that the police who have the responsibility of protecting the life and property of the citizens, the same police and administrative officers did not perform their duty and took arbitrary and illegal action.
The court has summoned DM Ballia and SDM Rasra and sought an affidavit of compliance of the order and directed not to change the Navayat of the forcibly demolished house. The court has banned any kind of construction on the disputed property.
The civil case was going on to evict the appellant from the house. SDM Rasda ordered the Kotwali police to vacate the house and demolish without any decree execution or court order.
The High Court had sought a personal affidavit from the officers on the role of the police. Trainee CO/SHO Kotwali Usman, Sub-Inspector Ravindra Kumar Patel and Crime Inspector Rakesh Kumar Singh told that the SDM had instructed to follow the decree, on which demolition action has been taken by vacating the house.
The house was marked by the executive officer of the Nagar Palika Parishad. Whereas in the report of SP Ballia it was told that the police forcibly entered the house, abused and threw out the family of the appellant.
The executive officer told that he was called by the inspector to the Kotwali but the demolition action had been taken before he reached the Kotwali. The court has declared the order of the SDM illegal.
