जबलपुर | [कोर्ट बुलेटिन] | OBC category को 27% आरक्षण देने के मामले पर आज मध्य प्रदेश हाईकोर्ट में सुनवाई हुई। सुनवाई के दौरान जबलपुर हाईकोर्ट ने सरकार को स्पष्ट रूप से कह दिया कि किसी की भी अनुपस्थिति में अब सुनवाई नहीं टाली जाएगी। हर हाल में 1 अगस्त से 27% OBC category पर नियमित तौर पर सुनवाई होगी और हर बार सुनवाई के लिए 1 घंटे तय किया जाएगा।
दरअसल जबलपुर हाईकोर्ट में सुनवाई के दौरान राज्य सरकार की ओर से कहा गया कि सरकार का पक्ष रखने के लिए सॉलिसिटर जनरल ऑफ इंडिया तुषार मेहता उपस्थित नहीं हो पाएंगे। लिहाजा सुनवाई के लिए अगली तारीख दी जाए।
इस पर हाईकोर्ट ने नाराजगी जाहिर की और कहा कि मध्य प्रदेश में ओबीसी आरक्षण के मामले पर सुप्रीम कोर्ट ने आदेश दिया है कि इस मामले पर नियमित तौर पर सुनवाई की जाए और जल्द से जल्द फैसला सुनाया जाए। अब आगे से किसी भी पक्षकार की अनुपस्थिति से सुनवाई नहीं टाली जाएगी।
इसके साथ ही हाईकोर्ट में सुनवाई के दौरान एमपीपीएससी की ओर से एक अंतरिम आवेदन भी दिया गया। जिसमें कहा गया कि 27 अप्रैल को हाईकोर्ट में जो आदेश दिया था उसमें बदलाव कर नए सिरे से आदेश दिया जाए। ताकि एमपीपीएससी चयन प्रक्रिया पूरी कर सके।
इस पर हाईकोर्ट ने एमपीपीएससी को फटकार लगाते हुए कहा कि हाईकोर्ट ने कभी भी चयन प्रक्रिया पर रोक लगाने का आदेश नहीं दिया है। एमपीपीएससी चाहे तो 14% आरक्षण के हिसाब से चयन प्रक्रिया आगे बढ़ा सकती है।
एमपीपीएससी पर नाराजगी जाहिर करते हुए हाईकोर्ट ने कहा एमपीपीएससी हमारे कंधे पर बंदूक रखकर ना चलाएं। चयन प्रक्रिया 14% आरक्षण के हिसाब से पूरी की जा सकती है। बहरहाल अब हाईकोर्ट में ओबीसी आरक्षण के मामले पर अगली सुनवाई 1 अगस्त को होगी।

In fact, during the hearing in the Jabalpur High Court, it was said on behalf of the state government that Solicitor General of India Tushar Mehta would not be able to appear for the government’s side. Therefore, the next date for hearing should be given.
On this, the High Court expressed displeasure and said that on the issue of OBC reservation in Madhya Pradesh, the Supreme Court has ordered that the matter should be heard regularly and the decision should be pronounced at the earliest. From now onwards, the hearing will not be postponed due to the absence of any of the parties.
Along with this, an interim application was also given by the MPPSC during the hearing in the High Court. In which it was said that the order given in the High Court on April 27 should be changed and ordered afresh. So that MPPSC can complete the selection process.
On this, the High Court reprimanded the MPPSC and said that the High Court has never ordered a stay on the selection process. MPPSC can proceed with the selection process on the basis of 14% reservation.
Expressing displeasure over MPPSC, the High Court said that MPPSC should not run with a gun on our shoulders. The selection process can be completed on the basis of 14% reservation. However, now the next hearing on the OBC reservation case in the High Court will be held on August 1.
