हरिद्वार | [कोर्ट बुलेटिन] | झारखंड अंतर्गत दुमका के द्वितीय अपर जिला एवं सत्र न्यायाधीश राकेश कुमार मिश्रा की अदालत ने पति को बंधक बनाकर पत्नी से गैंगरेप के मामले में 10 दोषियों को 25-25 साल सश्रम कारावास की सजा सुनाई है। अदालत ने आरोपियों पर 3.10 लाख रुपए का जुर्माना भी लगाया है। जुर्माने की राशि अदा नहीं करने पर सभी रेपिस्टों को ढाई-ढाई साल अतिरिक्त कारावास की सजा भुगतनी होगी।
इसके साथ ही कोर्ट ने धारा 354 के तहत 5 वर्ष के कारावास और 5 हजार रुपए का जुर्माना अदा करने की भी सजा सुनायी। जुर्माना की राशि अदा नहीं करने पर एक साल अतिरिक्त कारावास की सजा भुगतनी होगी। कोर्ट ने धारा 342 के तहत दोषी पाकर सभी दोषियों को 1 साल की कारावास और 1 हजार रुपए जुर्माने की भी सजा सुनायी है। जुर्माने की राशि अदा नहीं करने पर 1 माह के अतिरिक्त साधारण कारावास की सजा भुगतनी होगी। सभी सजाएं साथ-साथ चलेंगी।
इस मामले में सरकार की ओर से प्रभारी लोक अभियोजक चंपा कुमारी और बचाव पक्ष की ओर से वरीय अधिवक्ता सोमा गुप्ता ने पैरवी की और बहस में हिस्सा लिया। अभियोजन पक्ष की ओर से कोर्ट में दस गवाह पेश किए गए थे, जिनका प्रतिपरीक्षण कराया गया।
जिन लोगों को सजा सुनाई गई है उनमें घासीपुर निवासी मंगल मोहली उर्फ मामू, संतोष हेंब्रम उर्फ संतोष मोहली, बोदी लाल मोहली, मनोज हांसदा उर्फ मोहली, विकास हांसदा उर्फ मोहली, अंद्रियस मोहली उर्फ बाबू, मिथुन टुडू उर्फ मोहली, नुनूलाल मुर्मू उर्फ मोहली, उज्ज्वल हांसदा उर्फ मोहली, मनोज हांसदा शामिल हैं।
8 दिसंबर 2020 में हुई थी घटना
सामूहिक दुष्कर्म की यह घटना घासीपुर गांव में 8 दिसंबर 2020 को हुई थी। महिला अपने पति के साथ घासीपुर हाट से घर लौट रही थी। वापस लौटने के दौरान अंधेरा होने पर युवकों ने दंपति को एक सुनसान क्षेत्र में पकड़ कर पति को बंधक बना लिया। पति की आंखों के सामने युवकों ने पत्नी से गैंगरेप किया था।
इस मामले में 16-17 अज्ञात युवकों के खिलाफ प्राथमिकी दर्ज की गई थी। जांच में 12 युवकों की संलिप्तता सामने आई थी, जिसमें 2 आरोपी नाबालिग मिले। दोनों नाबालिग का मामला जेजेबी कोर्ट में अलग से चल रहा है।
महिला आयोग ने लिया था संज्ञान
दर्ज प्राथमिकी के अनुसार पीड़िता काठीकुंड थाना क्षेत्र की रहनेवाली है और वह अपने पति व अपने बच्चों के साथ घटना के कुछ दिनों पूर्व से घासीपुर गांव में रह रही थी। घटना के दूसरे दिन 9 दिसंबर 2020 को पीड़िता ने मुफस्सिल थाना पहुंच कर सामूहिक दुष्कर्म की प्राथमिकी दर्ज कराई थी। इस चर्चित मामले पर राष्ट्रीय महिला आयोग ने स्वतः संज्ञान लेते हुए राज्य के डीजीपी को समयबद्ध ढंग से जांच कर कार्रवाई का निर्देश दिया था। पुलिस ने मामले में त्वरित कार्रवाई करते हुए घटना में संलिप्त सभी चिह्नित 12 आरोपियों को गिरफ्तार कर लिया था। इसमें से 2 नाबालिग थे।
वीडियो कॉन्फ्रेंसिंग से सुनाई गई सजा
सामूहिक दुष्कर्म कांड की सजा सुरक्षा के दृष्टिकोण से वीडियो कॉन्फ्रेंसिंग के माध्यम से सुनाई गई। दोषियों को सशरीर अदालत में पेश नहीं किया गया था। अदालत में दोषियों के परिजनों की भीड़ लगी हुई थी। सजा सुनाने के वक्त परिजनों की निगाहें कोर्ट पर ही टिकी हुई थीं। सजा सुनने के साथ ही आरोपियों के परिजनों के चेहरों पर मायूसी छा गई थी। परिजनों को उम्मीद थी कि सभी की रिहाई हो जाएगी, पर ऐसा हुआ नहीं।
10 rapists imprisoned for 25-25 years for gang-raping wife by taking husband hostage
Haridwar | [Court Bulletin] | The court of Second Additional District and Sessions Judge Rakesh Kumar Mishra of Dumka under Jharkhand has sentenced 10 convicts to 25 years of rigorous imprisonment in the case of gang-rape of the wife by taking her husband hostage. The court also imposed a fine of Rs 3.10 lakh on the accused. In default of payment of fine, all the rapists will have to undergo further imprisonment for two and a half years.
Along with this, the court also sentenced to 5 years imprisonment under section 354 and to pay a fine of Rs. In default of payment of fine, he shall undergo further imprisonment for one year. The court, found guilty under section 342, has also sentenced all the culprits to one year’s imprisonment and a fine of one thousand rupees. In default of payment of fine, he shall undergo simple imprisonment for a term which may extend to one month. All the sentences will run concurrently.
In this case, public prosecutor in-charge Champa Kumari on behalf of the government and senior advocate Soma Gupta on behalf of the defense argued and participated in the debate. Ten witnesses were presented in the court on behalf of the prosecution, who were cross-examined.
Those who have been sentenced are Mangal Mohali alias Mamu, Santosh Hembram alias Santosh Mohali, Bodi Lal Mohali, Manoj Hansda alias Mohali, Vikas Hansda alias Mohali, Andreas Mohali alias Babu, Mithun Tudu alias Mohali, Nunulal Murmu alias Mohali, residents of Ghasipur. Ujjwal Hansda aka Mohali, Manoj Hansda.
The incident happened on 8 December 2020
This incident of gang rape took place on 8 December 2020 in Ghasipur village. The woman was returning home from Ghasipur Haat with her husband. On their return, when it was dark, the youths caught the couple in a secluded area and took the husband hostage. The youth had gang-raped the wife in front of the husband’s eyes.
An FIR was registered against 16-17 unidentified youths in this case. The involvement of 12 youths was revealed in the investigation, in which 2 accused were found minors. The case of both the minors is going on separately in JJB court.
Women’s commission had taken cognizance
According to the FIR lodged, the victim is a resident of Kathikund police station area and she was living with her husband and their children in Ghasipur village since a few days before the incident. On the second day of the incident, on 9 December 2020, the victim reached the Mufassil police station and lodged an FIR of gang rape. Taking suo motu cognizance of this popular matter, the National Commission for Women had directed the state DGP to investigate and take action in a time bound manner. Taking quick action in the matter, the police arrested all the 12 accused involved in the incident. Of these, 2 were minors.
Sentenced through video conferencing
The punishment for the gang rape case was pronounced through video conferencing from the point of view of security. The convicts were not produced in the court bodily. There was a crowd of relatives of the convicts in the court. At the time of sentencing, the eyes of the family were fixed on the court itself. After hearing the sentence, the faces of the family members of the accused were saddened. The family had hoped that everyone would be released, but it did not happen.
