लखनऊ | [कोर्ट बुलेटिन] | पीलीभीत के वर्ष 1991 के 10 सिखों के तथाकथित एनकाउंटर में मारे जाने के मामले में 34 पुलिसकर्मियों के जमानत प्रार्थना पत्रों को एकसाथ सुनवाई करते हुए हाईकोर्ट की लखनऊ बेंच ने खारिज कर दिया है। इसके साथ ही न्यायालय ने उनकी अपीलों पर अंतिम सुनवाई के लिए 25 जुलाई 2022 की तिथि नियत की है।
यह आदेश न्यायमूर्ति रमेश सिन्हा और न्यायमूर्ति बृजराज सिंह की खंडपीठ ने देवेंद्र पांडेय व अन्य की ओर से दाखिल जमानत प्रार्थना पत्रों को खारिज करते हुए पारित किया।
अपीलार्थियों की ओर से दलील दी गई थी कि मृतकों में कई का लम्बा आपराधिक इतिहास था। यही नहीं वे खालिस्तान लिब्रेशन फ्रंट नामक आतंकी संगठन के सदस्य थे। इस बिंदु पर न्यायालय ने अपने आदेश में कहा है कि मृतकों में से कुछ का कोई आपराधिक इतिहास नहीं था, ऐसे में सभी को आतंकी मानकर उन्हें उनके पत्नियों और बच्चों से अलग कर के मार देना किसी भी तरह से जायज नहीं ठहराया जा सकता।
न्यायालय ने आगे कहा कि मृतकों में से कुछ यदि असमाजिक गतिविधियों में शामिल भी थे व उनका आपराधिक इतिहास था, तब भी विधि की प्रक्रिया को अपनाना चाहिए था। इस प्रकार के बर्बर और अमानवीय हत्याएं उन्हें आतंकी बताकर नहीं करनी चाहिए थी।
क्या था मामला मामला
अभियोजन कथानक के अनुसार कुछ सिख तीर्थयात्री 12 जुलाई 1991 को पीलीभीत से एक बस से तीर्थयात्रा के लिए जा रहे थे। इस बस में बच्चे और महिलाएं भी थीं। बस को रोक कर 11 लोगों को उतार लिया गया। इनमें से 10 की पीलीभीत के न्योरिया, बिलसांदा और पूरनपुर थानाक्षेत्रों के क्रमशः धमेला कुंआ, फगुनिया घाट व पट्टाभोजी इलाके में एनकाउंटर दिखाकर हत्या कर दी गई। आरोप है कि 11वां शख्स एक बच्चा था जिसका अब तक कोई पता नहीं चला।
अपीलार्थियों की ओर से दलील दी गई कि मारे गए 10 में से बलजीत सिंह उर्फ पप्पू, जसवंत सिंह उर्फ ब्लिजी, हरमिंदर सिंह उर्फ मिंटा तथा सुरजान सिंह उर्फ बिट्टू खालिस्तान लिब्रेशन फ्रंट के आतंकी थे, इसके साथ ही उन पर हत्या, डकैती, अपहरण व पुलिस पर हमले जैसे जघन्य अपराध के मामले दर्ज थे।

रमेश चंद्र भारती, वीरपाल सिंह, नत्थु सिंह, धनी राम, सुगम चंद, कलेक्टर सिंह, कुंवर पाल सिंह, श्याम बाबू, बनवारी लाल, दिनेश सिंह, सुनील कुमार दीक्षित, अरविंद सिंह, राम नगीना, विजय कुमार सिंह, उदय पाल सिंह, मुन्ना खान, दुर्विजय सिंह पुत्र टोडी लाल, महावीर सिंह, गयाराम, दुर्विजय सिंह पुत्र दिलाराम, हरपाल सिंह, रामचंद्र सिंह, राजेंद्र सिंह, ज्ञान गिरी, लखन सिंह, नाजिम खान, नारायन दास, कृष्णवीर, करन सिंह, राकेश सिंह, नेमचंद्र, शमशेर अहमद, सतिंदर सिंह व बदन सिंह।
इस मामले के 12 अभियुक्तों को हाईकोर्ट से पूर्व में ही उनकी बीमारियों को देखते हुए, जमानत मंजूर हो चुकी है। इन सभी अभियुक्तों को सीबीआई कोर्ट लखनऊ ने 4 अप्रैल 2016 को दोषसिद्ध करार देते हुए, उम्र कैद की सजा सुनाई थी।

Lucknow | [Court Bulletin] | The Lucknow Bench of the High Court, while hearing the bail applications of 34 policemen together in the case of the so-called encounter of 10 Sikhs in Pilibhit in 1991, has been dismissed. Along with this, the court has fixed 25 July 2022 for the final hearing on their appeals.
This order was passed by the division bench of Justice Ramesh Sinha and Justice Brijraj Singh while rejecting the bail applications filed by Devendra Pandey and others.
It was argued on behalf of the appellants that many of the deceased had a long criminal history. Not only this, he was a member of a terrorist organization called Khalistan Liberation Front. On this point, the court, in its order, said that some of the dead had no criminal history, so treating them as terrorists and killing them by separating them from their wives and children cannot be justified in any way.
The court further observed that even if some of the deceased were involved in anti-social activities and had criminal history, the process of law should have been followed. Such barbaric and inhuman killings should not have been done by calling them terrorists.
what was the matter
According to the prosecution plot, some Sikh pilgrims were on a bus from Pilibhit on 12 July 1991 for pilgrimage. There were also children and women in this bus. The bus was stopped and 11 people were taken off. Of these, 10 were killed by showing encounters in Dhamela Kuan, Faguniya Ghat and Pattabhoji areas of Nioria, Bilsanda and Puranpur police station areas of Pilibhit respectively. It is alleged that the 11th person was a child, which has not been traced till now.
It was argued on behalf of the appellants that out of the 10 killed, Baljit Singh alias Pappu, Jaswant Singh alias Bliji, Harminder Singh alias Minta and Surjan Singh alias Bittu were terrorists of Khalistan Liberation Front, besides they were accused of murder, dacoity, kidnapping and murder. Cases of heinous crimes like assault on police were registered.

Ramesh Chandra Bharti, Veerpal Singh, Nathu Singh, Dhani Ram, Sugam Chand, Collector Singh, Kunwar Pal Singh, Shyam Babu, Banwari Lal, Dinesh Singh, Sunil Kumar Dixit, Arvind Singh, Ram Nagina, Vijay Kumar Singh, Udai Pal Singh, Munna Khan, Durvijay Singh son Todi Lal, Mahavir Singh, Gayaram, Durvijay Singh son Dilaram, Harpal Singh, Ramchandra Singh, Rajendra Singh, Gyan Giri, Lakhan Singh, Nazim Khan, Narayan Das, Krishnaveer, Karan Singh, Rakesh Singh, Nemchandra, Shamsher Ahmed, Satinder Singh and Badan Singh.
The 12 accused in this case have already been granted bail by the High Court in view of their ailments. All these accused were convicted and sentenced to life imprisonment by the CBI Court, Lucknow on 4 April 2016.
