बिलासपुर | [कोर्ट बुलेटिन] | राजद्रोह व आय से अधिक संपत्ति के केस में 120 दिनों से जेल में बंद IPS जीपी सिंह को छत्तीसगढ़ हाईकोर्ट से सशर्त जमानत मिल गई है। 120 दिनों से जेल में बंद जीपी ने जमानत के लिए सुप्रीम कोर्ट का दरवाजा खटखटाया था। सुप्रीम कोर्ट ने हाईकोर्ट को जमानत याचिका पर शीघ्र सुनवाई करने का आदेश दिया था। गुरुवार को हाईकोर्ट में सुनवाई के बाद उन्हें सशर्त जमानत दी है। इस आदेश के साथ ही जीपी सिंह के जेल से रिहा होने का रास्ता साफ हो गया है।

हाईकोर्ट में IPS जीपी सिंह की जमानत पर सुनवाई के दौरान अधिवक्ता ने FIR दर्ज करने और गिरफ्तारी पर सवाल उठाए। उन्होंने कहा कि प्रदेश के एक सीनियर IPS को नियम विरुद्ध केस दर्ज कर गिरफ्तार किया गया है। प्रावधान के अनुसार किसी भी IPS अफसर के खिलाफ केस दर्ज करने से पहले केंद्र सरकार से अनुमति लेना आवश्यक है लेकिन, उनके मामले में ऐसा नहीं किया गया।

उन्होंने कोर्ट से कहा कि अभियोजन की स्वीकृति नहीं हुई है, बावजूद उन्हें 120 दिन से जेल में बंद रखा गया है। चार्जशीट पेश होने के बाद जमानत किसी भी आरोपी का मौलिक अधिकार माना जाता है। सुप्रीम कोर्ट ने भी उनके केस की जल्दी सुनवाई करने का आदेश दिया है। 3 माह से ज्यादा समय से जमानत याचिका लंबित है। उनकी दलीलों को सुनने के बाद जस्टिस दीपक तिवारी ने जीपी सिंह को सशर्त जमानत देने का आदेश दिया है।

 ACB ने हरियाणा से किया था गिरफ्तार

छत्तीसगढ़ राज्य की एंटी करप्शन ब्यूरो और आर्थिक अपराध ब्यूरो की टीम ने उन्हें 11 जनवरी को हरियाणा के गुरुग्राम से गिरफ्तार किया था। 18 जनवरी को उन्हें विशेष अदालत में पेश किया गया। इसके बाद से जीपी सिंह जेल बंद में है।

निचली अदालत से जमानत अर्जी खारिज होने के बाद उनके वकील ने हाईकोर्ट में जमानत अर्जी लगाई थी। इस दौरान जमानत देने के लिए उन्होंने अंतरिम राहत की मांग की थी, जिसे हाईकोर्ट ने ठुकरा दिया था। जस्टिस दीपक तिवारी ने जमानत पर नंबर आने पर ही सुनवाई के निर्देश दिए थे। तब से उनकी जमानत पर सुनवाई लंबित थी।

सुप्रीम कोर्ट से हाईकोर्ट पहुंचा जमानत केस

हाईकोर्ट में जीपी सिंह की जमानत याचिका लंबित होने के बाद उनके वकील ने सुप्रीम कोर्ट की दौड़ लगाई, जिसके बाद सुप्रीम कोर्ट ने शीघ्र सुनवाई करने का आदेश दिया था। जीपी सिंह के वकील ने बताया कि 4 मई को सुप्रीम कोर्ट ने उनकी जमानत अर्जी पर हाईकोर्ट में ही सुनवाई करने का आदेश दिया है।

इस दौरान 9 मई को केस हाईकोर्ट के जस्टिस गौतम भादुड़ी की बेंच में लगा था। उन्होंने इस मामले को एप्रोपिएट बेंच में रखने के निर्देश दिए थे। 10 मई को जस्टिस दीपक तिवारी की बेंच में उनकी बेल पर नंबर नहीं आ पाया था।

IPS GP Singh, jailed for 120 days in sedition case, got bail from the High Court

During the hearing on the bail of IPS GP Singh in the High Court, the advocate raised questions on the registration of FIR and arrest. He said that a senior IPS of the state has been arrested after registering a case against the rules. According to the provision, it is necessary to take permission from the central government before registering a case against any IPS officer, but in their case it was not done.

He told the court that the prosecution has not been sanctioned, yet he has been kept in jail for 120 days. After the production of the charge sheet, bail is considered a fundamental right of any accused. The Supreme Court has also ordered an early hearing of his case. The bail application is pending for more than 3 months. After hearing their arguments, Justice Deepak Tiwari has ordered conditional bail to GP Singh.

ACB arrested from Haryana

The team of Anti-Corruption Bureau and Economic Offenses Bureau of Chhattisgarh state had arrested him on January 11 from Gurugram in Haryana. He was produced in a special court on 18 January. Since then GP Singh is in jail.

After the bail application was rejected by the lower court, his lawyer had applied for bail in the High Court. During this, he had sought interim relief to grant bail, which was turned down by the High Court. Justice Deepak Tiwari had given instructions for hearing only when the number came on bail. Since then his bail hearing was pending.

 Bail case reached from Supreme Court to High Court

After GP Singh’s bail plea was pending in the High Court, his lawyer rushed to the Supreme Court, after which the Supreme Court had ordered an early hearing. GP Singh’s lawyer told that on May 4, the Supreme Court has ordered to hear his bail application in the High Court itself.

During this, on May 9, the case was engaged in the bench of Justice Gautam Bhaduri of the High Court. He directed to place the matter in the Appropriate Bench. On May 10, the number on his bail could not come in the bench of Justice Deepak Tiwari.
