लखनऊ | [कोर्ट बुलेटिन] | अयोध्या में बनने वाले श्रीराम एयरपोर्ट के लिए डॉ. राम मनेाहर लोहिया अवध विश्वविद्यालय की जमीन बिना विश्वविद्यालय की अनुमति के लेने पर केंद्र व राज्य सरकार समेत सभी सम्बंधित विभागों से हाईकोर्ट की लखनऊ बेंच ने जवाब तलब किया है। न्यायालय ने जवाब देने के लिए चार सप्ताह का समय दिया है। इसके साथ ही मामले की अगली सुनवाई जुलाई के दूसरे सप्ताह में नियत की है।

यह आदेश न्यायमूर्ति देवेंद्र कुमार उपाध्याय व न्यायमूर्ति सुभाष विद्यार्थी की खंडपीठ ने विश्वविद्यालय के एक छात्र ओम प्रकाश सिंह की ओर से दाखिल जनहित याचिका पर पारित किया। याची की ओर से दलील दी गई कि वह विश्वविद्यालय के हक की बात कर रहा है। उसका कहना था कि अयेाध्या में श्रीराम एयरपोर्ट बनना है। उसके लिए राज्य सरकार ने विश्वविद्यालय की काफी जमीन ले ली है लेकिन सरकार ने इसके लिए विश्वविद्यालय से कोई अनुमति भी नहीं ली।

कहा गया कि राज्य सरकार ने मात्र उच्च शिक्षा विभाग की अनुमति लेकर ऐसा कर लिया है। याची की ओर से तर्क दिया गया कि राज्य विश्वविद्यालय अधिनियम की धारा 21 के तहत विश्वविद्यालय की कार्य परिषद को ही जमीन प्रदान करने सम्बंधी केाई निर्णय लेने का अधिकार है। न्यायालय ने याचिका को सुनने के बाद प्रतिवादियों को चार सप्ताह में जवाबी हलफनामा दाखिल करने का आदेश दिया है।

Answer sought from the government on taking land for Shriram Airport

Lucknow | [Court Bulletin] | The Lucknow Bench of the High Court has summoned all the concerned departments, including the Central and State Governments, for taking the land of Dr. Ram Manehar Lohia Avadh University for the Shri Ram Airport to be built in Ayodhya without the permission of the University. The court has given four weeks to respond. With this, the next hearing of the case has been fixed in the second week of July.

This order was passed by a division bench of Justice Devendra Kumar Upadhyay and Justice Subhash Vidyarthi on a PIL filed by Om Prakash Singh, a student of the university. It was argued on behalf of the petitioner that he is talking about the rights of the university. He said that Shri Ram airport is to be built in Ayodhya. For this, the state government has taken a lot of land of the university, but the government did not even take any permission from the university for this.

It was said that the state government has done this only with the permission of the Higher Education Department. It was argued on behalf of the petitioner that under section 21 of the State University Act, only the Executive Council of the University has the right to take any decision regarding the grant of land. The court, after hearing the petition, has ordered the respondents to file counter-affidavits within four weeks.
