अहमदाबाद | [कोर्ट बुलेटिन] | स्कूलों में भगवद् गीता को प्रार्थना कार्यक्रम और अन्य गतिविधियों में श्लोक पाठ के रूप में प्रस्तुत करने के प्रस्ताव को चुनौती देने वाली याचिका पर गुजरात हाई कोर्ट ने सोमवार को राज्य सरकार को नोटिस जारी किया। हाई कोर्ट ने हालांकि इस प्रस्ताव पर रोक लगाने से इनकार कर दिया और राज्य सरकार से 18 अगस्त तक जवाब मांगा।
मुख्य न्यायाधीश न्यायमूर्ति अरविंद कुमार और न्यायमूर्ति आशुतोष शास्त्री की खंडपीठ ने जमीयत उलमा-ए-हिंद द्वारा दायर एक जनहित याचिका पर नोटिस जारी किया।
याचिका में स्कूलों में इस शैक्षिक वर्ष से श्रीमद्भगवद् गीता को प्रार्थना और श्लोकों आदि के पाठ जैसी गतिविधियों के रूप में प्रस्तुत करने के प्रस्ताव को चुनौती दी गई थी। जमीयत उलमा-ए-हिंद ने संवैधानिक वैधता के आधार पर प्रस्ताव को चुनौती दी और दावा किया कि यह राष्ट्रीय शिक्षा नीति का उल्लंघन है।
केंद्र सरकार को भी बनाया गया है प्रतिवादी
पीठ ने याचिकाकर्ता के वकील को सहायक सॉलिसिटर जनरल को जनहित याचिका की एक प्रति देने का भी निर्देश दिया, क्योंकि केंद्र सरकार को भी प्रतिवादी बनाया गया है।
गुजरात के शिक्षा मंत्री ने इस साल मार्च में गुजरात के स्कूलों में भगवद् गीता को प्रार्थना और श्लोकों आदि के पाठ जैसी गतिविधियों के रूप में प्रस्तुत करने की घोषणा की थी।
High Court refuses to ban the recitation of Bhagavad Gita in schools, notice to the government
Ahmedabad | [Court Bulletin] | The Gujarat High Court on Monday issued notice to the state government on a petition challenging the proposal to introduce Bhagavad Gita in the form of shloka lessons in prayer programs and other activities in schools. The High Court, however, refused to stay the proposal and sought a response from the state government by August 18.
A division bench of Chief Justice Arvind Kumar and Justice Ashutosh Shastri issued the notice on a PIL filed by Jamiat Ulama-e-Hind.
The petition challenged the proposal to introduce Shrimad Bhagavad Gita in the form of activities like prayer and recitation of shlokas etc. in schools from this academic year. Jamiat Ulama-e-Hind challenged the proposal on grounds of constitutional validity and claimed that it was in violation of the National Education Policy.

The bench also directed the counsel for the petitioner to give a copy of the PIL to the Assistant Solicitor General, as the Central Government has also been made the respondent.
Gujarat’s education minister had in March this year announced the introduction of activities like recitation of Bhagavad Gita in the form of prayers and recitation of shlokas etc. in Gujarat schools.
