नई दिल्ली | [कोर्ट बुलेटिन] | भारत के चीफ जस्टिस एम वी रमना Chief Justice of India MV Ramana ने न्यायपालिका और विधायिका पर बड़ी टिप्पणी की है। उन्होंने कहा कि सत्तारूढ़ दलों का मानना है कि सरकारी कार्रवाई न्यायिक समर्थन के हकदार हैं और विपक्षी दल उम्मीद करते हैं कि यह उनके कारण का समर्थन करेगा लेकिन यह समझना जरूरी है कि न्यायपालिका केवल संविधान के प्रति जवाबदेह है। उन्होंने कहा कि देश ने अभी भी संविधान द्वारा प्रत्येक संस्थान को सौंपी गई भूमिकाओं की पूरी तरह से सराहना करना नहीं सीखा है।
शनिवार को सैन फ्रांसिस्को में एसोसिएशन ऑफ इंडियन अमेरिकन्स द्वारा आयोजित एक सम्मान समारोह में बोलते हुए सीजेआई एम वी रमना ने कहा, “जैसा कि हम इस वर्ष स्वतंत्रता के 75 वें वर्ष का जश्न मना रहे हैं और जब हमारा गणतंत्र 72 वर्ष का हो गया है, तो कुछ अफसोस के साथ, मुझे यहां यह जोड़ना चाहिए कि हमने अभी भी संविधान द्वारा प्रत्येक संस्थान को सौंपी गई भूमिकाओं और जिम्मेदारियों की पूरी तरह से सराहना करना नहीं सीखा है। सत्ताधारी पार्टी का मानना है कि हर सरकारी कार्रवाई न्यायिक समर्थन की हकदार है। विपक्षी दलों को उम्मीद है कि न्यायपालिका अपने राजनीतिक पदों और कारणों को आगे बढ़ाएगी। जबकि न्यायपालिका केवल संविधान के प्रति जवाबदेह है।”
सीजेआई ने कहा, “यह आम जनता के बीच बड़ी अज्ञानता है जो ऐसी ताकतों की सहायता कर ही, जिनका एकमात्र उद्देश्य न्यायपालिका को खत्म करना है। मैं इसे स्पष्ट कर दूं, हम केवल और केवल संविधान के प्रति जवाबदेह हैं। ”
उन्होंने कहा कि “संविधान में परिकल्पित नियंत्रण और संतुलन को लागू करने के लिए हमें भारत में संवैधानिक संस्कृति को बढ़ावा देने की आवश्यकता है। हमें व्यक्तियों और संस्थानों की भूमिकाओं और जिम्मेदारियों के बारे में जागरूकता फैलाने की जरूरत है। लोकतंत्र सभी की भागीदारी के बारे में है”।
संयुक्त राज्य अमेरिका का उदाहरण देते हुए सीजेआई ने “भारत सहित दुनिया में हर जगह” समावेशिता को सम्मानित करने की आवश्यकता पर जोर दिया और आगाह किया कि “एक गैर-समावेशी दृष्टिकोण आपदा के लिए एक निमंत्रण है”।
भारतीय समुदाय की उपलब्धियों की सराहना करते हुए सीजेआई ने कहा, “यह अमेरिकी समाज की सहनशीलता और समावेशी प्रकृति है जो दुनिया भर से सर्वश्रेष्ठ प्रतिभाओं को आकर्षित करने में सक्षम है, जो बदले में इसके विकास में योगदान दे रही है। व्यवस्था में समाज के सभी वर्गों के विश्वास को बनाए रखने के लिए विविध पृष्ठभूमि से योग्य प्रतिभाओं को सम्मानित करना भी आवश्यक है।”
सरकार के साथ बदलती है नीतियां
सीजेआई ने कहा कि “दीर्घकालिक विकास के लिए बनी इस तरह की नींव को कभी भी बाधित नहीं किया जाना चाहिए। पूरी दुनिया में सरकार बदलने के साथ नीतियां बदलती हैं। लेकिन कोई भी समझदार, परिपक्व और देशभक्त सरकार नीतियों में इस तरह से बदलाव नहीं करेगी जो उसके अपने क्षेत्र के विकास को धीमा या रोक दे। उन्होंने खेद व्यक्त किया कि “दुर्भाग्य से, जब भी सरकार में कोई परिवर्तन होता है, हम भारत में ऐसी संवेदनशीलता और परिपक्वता को अक्सर नहीं देखते हैं”।

He said that “We need to promote constitutional culture in India to implement the checks and balances envisaged in the Constitution. We need to spread awareness about the roles and responsibilities of individuals and institutions. Democracy is about participation of all. is in”.
Citing the example of the United States, the CJI stressed the need to honor inclusivity “everywhere in the world including India” and cautioned that “a non-inclusive approach is an invitation for disaster”.
Appreciating the achievements of the Indian community, the CJI said, “It is the tolerant and inclusive nature of American society that has been able to attract the best of talent from around the world, which in turn is contributing to its growth. It is also necessary to honor deserving talents from diverse backgrounds to maintain the faith of all sections of the society in the system.”
Policies change with the government
The CJI said that such a foundation built for long-term development should never be disrupted. Policies change with the change of government all over the world. But no sensible, mature and patriotic government will change the policies in such a way that it slows or stops the development of its own region. He regretted that “unfortunately, whenever there is a change in government, we do not often see such sensitivity and maturity in India”.
