नई दिल्ली | [नेशनल बुलेटिन] | यौन उत्पीड़न के एक मामले में अदालत ने पिछले हफ्ते 74 वर्षीय लेखक सिविक चंद्रन को जमानत देते की गई टिप्पणियों को लेकर विवाद खड़ा हो गया है। दरअसल सिविक चंद्रन को अग्रिम जमानत देते हुए, केरल में कोझीकोड जिला सत्र अदालत ने कहा कि पहली नजर में अभियुक्त पर अनुसूचित जाति और अनसूचित जनजाति उत्पीड़न कानून के तहत मामला नहीं बनता। कोर्ट ने कहा कि यह बहुत अविश्वसनीय प्रतीत होता है कि वह (आरोपी सिविक चंद्रन) पीड़िता के शरीर को पूरी तरह यह जानते हुए भी छूएगा कि वह अनुसूचित जाति (SC) की सदस्य है। कोझीकोड जिला सत्र अदालत ने आगे कहा, “अधिनियम के तहत अपराध को सिद्ध करने के लिए, यह स्थापित करना होगा कि आरोपी को इस बात की जानकारी थी कि पीड़िता एससी/एसटी की सदस्य है।”

 

इस साल 74 वर्षीय लेखक सिविक चंद्रन के खिलाफ 2 यौन उत्पीड़न के मामले दर्ज किए गए थे और दोनों में उन्हें अग्रिम जमानत दी गई। पहले मामले में एक दलित लेखिका ने 17 जुलाई को पुलिस में शिकायत की थी कि चंद्रन ने 17 अप्रैल को उनकी गर्दन पर किस करने की कोशिश की और लज्जा भंग की।

 

वहीं, दूसरा मामला एक अन्य युवा लेखिका ने दर्ज कराया था, जिसने फरवरी 2020 में शहर में एक पुस्तक प्रदर्शनी के दौरान चंद्रन द्वारा यौन उत्पीड़न का आरोप लगाया था। कोझीकोड की जिला अदालत ने उन्हें पहले मामले में 2 अगस्त को अग्रिम जमानत दे दी।

 

12 अगस्त को दूसरे मामले में चंद्रन को अग्रिम जमानत देते हुए भी कोर्ट ने कुछ टिप्पणी की थीं जिसको लेकर विवाद खड़ा हो गया है। केरल में जिला सत्र अदालत ने एक मामले में कहा कि जब एक महिला ने ‘‘यौन भावनाएं भड़काने वाली ड्रेस’’ पहन रखी थी तो इससे प्रथम दृष्टया यौन उत्पीड़न का मामला नहीं बनता। उसकी इस टिप्पणी को लेकर विवाद पैदा हो गया है और राज्य महिला आयोग ने इसकी कड़ी निंदा की है।

 

अदालत ने कहा था कि जमानत अर्जी के साथ आरोपी द्वारा पेश की गई शिकायतकर्ता की तस्वीर यह स्पष्ट कर रही थी कि वह खुद ऐसी पोशाक पहने हुए है जो कुछ यौन भावनाएं भड़काने वाली है। साथ ही, अदालत ने कहा कि यह विश्वास करना असंभव है कि 74 वर्षीय एवं दिव्यांग व्यक्ति ने शिकायकर्ता को जबरन अपनी गोद में बिठाया तथा उसका यौन उत्पीड़न किया।

 

अदालत ने कहा, ‘‘आरोपी द्वारा जमानत अर्जी के साथ पेश की गई तस्वीर यह खुलासा कर रही थी कि शिकायतकर्ता ने खुद ऐसी पोशाक पहन रखी थी जो कुछ यौन भावनाएं उकसाती हैं। इसलिए आरोपी के खिलाफ धारा 354ए लगाने का प्रथम दृष्टया मामला नहीं बनता है। दलित लेखिका की शिकायत से संबंधित अग्रिम जमानत आदेश में, सत्र न्यायाधीश के कृष्ण कुमार ने कहा कि उपलब्ध सामग्री से पता चलता है कि “यह समाज में आरोपी की स्थिति को खराब करने का एक प्रयास है”।

 

 

‘Touching a Scheduled Caste girl feels unbelievable’, controversy over Court’s remarks on Civic Chandran’s bail

 

 

New Delhi | [National Bulletin] | A controversy has erupted over the remarks made by a court last week granting bail to 74-year-old writer Civic Chandran in a sexual harassment case. In fact, while granting anticipatory bail to Civic Chandran, the Kozhikode District Sessions Court in Kerala observed that prima facie the accused does not have a case under the Scheduled Castes and Scheduled Tribes Atrocities Act. The court said that it appears very unbelievable that he (accused Civic Chandran) would touch the victim’s body even knowing fully that she was a member of Scheduled Caste (SC). The Kozhikode District Sessions Court further said, “In order to establish an offense under the Act, it has to be established that the accused was aware that the victim was a member of SC/ST.”

 

This year two sexual assault cases were registered against 74-year-old writer Civic Chandran and he was granted anticipatory bail in both. In the first case, a Dalit writer had complained to the police on 17 July that Chandran tried to kiss her on her neck on 17 April and outraged her modesty.

 

At the same time, the second case was filed by another young writer who alleged sexual harassment by Chandran during a book exhibition in the city in February 2020. The district court of Kozhikode granted him anticipatory bail on August 2 in the first case.

 

On August 12, while granting anticipatory bail to Chandran in the second case, the court had also made some remarks about which a controversy has arisen. The District Sessions Court in Kerala said in a case that prima facie a case of sexual harassment was not made out when a woman was wearing a “dress that incites sexual feelings”. Controversy has arisen over her remark and the State Women’s Commission has strongly condemned it.

 

The court had said that the photograph of the complainant, produced by the accused along with the bail application, was making it clear that she herself was wearing a dress which was provoking certain sexual feelings. Also, the court said that it is impossible to believe that the 74-year-old and handicapped man forcibly made the complainant sit on his lap and sexually assaulted her.

 

The court said, “The photograph produced by the accused along with the bail application was disclosing that the complainant himself was dressed in a dress which incites certain sexual feelings. Therefore, there is no prima facie case for imposition of section 354A against the accused. In the anticipatory bail order related to the complaint of the Dalit writer, Sessions Judge K Krishna Kumar said the material available shows that “it is an attempt to malign the status of the accused in the society”.
