नई दिल्ली | [कोर्ट बुलेटिन] | कुतुब मीनार परिसर में पूजा के अधिकार को लेकर हिंदुओं और जैनियों की याचिका पर गुरुवार को दिल्ली की साकेत कोर्ट ने फैसला टाल दिया है। कोर्ट का कहना है कि इस मामले में नए सिरे से एक याचिका दाखिल की गई है। कोर्ट इसे देखेगा और सुनेगा। जिसकी वजह से आज इस मामले पर कोई फैसला नहीं सुनाया गया।

 

इससे पहले 24 मई को, अदालत ने अपना आदेश सुरक्षित रख लिया था क्योंकि एएसआई (भारतीय पुरातत्व सर्वेक्षण) ने कोर्ट में कहा था कि कुतुब मीनार परिसर के अंदर हिंदू मूर्तियों के अस्तित्व से इनकार नहीं किया जा सकता है लेकिन यह एक विश्व धरोहर है जहां पूजा करने के मौलिक अधिकार का दावा नहीं किया जा सकता।

 

कोर्ट ने मुकदमों पर एएसआई की आपत्तियों को रिकॉर्ड में लिया और कहा कि वह 9 जून 2021 (गुरुवार) को फैसला सुनाएगी। अदालत ने यह जानना चाहा कि क्या याचिकाकर्ता पूजा के किसी कानूनी या मौलिक अधिकार का दावा कर सकते हैं। यह मानते हुए कि लगभग 800 साल पहले यहां 27 मंदिर मौजूद थे।

 

अतिरिक्त जिला न्यायाधीश निखिल चोपड़ा ने 24 मई को मामले के याचिकाकर्ताओं में से एक, अधिवक्ता हरि शंकर जैन से कहा था कि भगवान पिछले 800 सालों से बिना पूजा के हैं तो उन्हें वैसे ही रहने दीजिए।

 

चोपड़ा ने यह प्रमाणित करने के लिए कानूनी तर्क मांगा कि क्या कुतुब मीनार परिसर में यथास्थिति रहने देने से याचिकाकर्ताओं के अधिकार का हनन होता है। जज ने कहा था, ‘यदि यह मान लिया जाए कि यहां हिंदू और जैन धार्मिक संरचनाओं को ध्वस्त करके उनके ऊपर मस्जिद का निर्माण किया गया था… मुस्लिमों ने मस्जिद के तौर पर इसका प्रयोग नहीं किया। ऐसे में जो प्रश्न सबसे महत्वपूर्ण हो जाता है वह यह है कि आप यहां किस आधार पर पूजा को बहाल करने का दावा कर रहे हैं?’

 

एक हलफनामे में, एएसआई ने पूजा बहाली की दलीलों का विरोध किया था। एएसआई ने तर्क देते हुए कहा कि जब से यह एक संरक्षित स्मारक है, तब से किसी भी समुदाय ने कुतुब मीनार या परिसर के अंदर कहीं भी पूजा नहीं की है।

 

एजेंसी ने कोर्ट में कहा, ‘जमीन पर किसी भी स्थिति के उल्लंघन में मौलिक अधिकार का लाभ नहीं उठाया जा सकता है। संरक्षण/सुरक्षा का मूल सिद्धांत संरक्षित स्मारक के रूप में घोषित और अधिसूचित स्मारक में किसी भी नई प्रथा को शुरू करने की अनुमति नहीं देना है।’

 

कोर्ट में एएसआई ने माना था कि कुतुब मीनार परिसर का निर्माण करने के लिए हिंदू और जैन देवताओं के वास्तुशिल्प और छवियों का दोबारा इस्तेमाल किया गया था। मगर यह प्राचीन और संरक्षित इमारत है। जैन देवता तीर्थंकर भगवान ऋषभ देव और हिंदू देवता भगवान विष्णु की ओर से दायर केस में दावा किया गया है कि मोहम्मद गौरी की सेना में जनरल कुतुबुद्दीन ऐबक ने 27 मंदिरों को ध्वस्त करके उस सामग्री से कुव्वत-उल-इस्लाम मस्जिद का निर्माण किया था।

 

याचिकाकर्ताओं ने कोर्ट से केंद्र को विवादित स्थल पर मंदिर बहाल करने, एक ट्रस्ट बनाने और मंदिरों का प्रबंधन उस ट्रस्ट को सौंपने का आदेश देने का आग्रह किया था।

 

 

Qutub Minar worship case: Decision on plea of ​​Hindus, Jains deferred

The court says that a fresh petition has been filed in this matter. Court will see and hear it. Due to which no decision has been given on this matter today.

 

Earlier on 24 May, the court had reserved its order as the ASI (Archaeological Survey of India) had told the court that the existence of Hindu idols inside the Qutub Minar complex cannot be denied but it is a world heritage site. The fundamental right to worship cannot be claimed.

 

The court took on record the ASI’s objections to the cases and said that it would pronounce the verdict on June 9, 2021 (Thursday). The court wanted to know whether the petitioners can claim any legal or fundamental right of worship. Considering that 27 temples existed here around 800 years ago.

 

Additional District Judge Nikhil Chopra had on May 24 told advocate Hari Shankar Jain, one of the petitioners in the case, that if God is without worship for the last 800 years, then let him remain as it is.

 

Chopra sought legal arguments to establish whether the status quo in the Qutub Minar complex violates the rights of the petitioners. The judge had said, “If it is assumed that the Hindu and Jain religious structures here were demolished and a mosque was built over them… the Muslims did not use it as a mosque.” So the question that becomes most important is that on what basis are you claiming to restore worship here?’

 

In an affidavit, the ASI had opposed the pleas for resumption of worship. The ASI argued that since it is a protected monument, no community has worshiped Qutub Minar or anywhere inside the complex.

 

The agency said in the court, “The fundamental right cannot be availed of in violation of any condition on the ground.” The basic principle of conservation/protection is not to allow any new practice to be introduced in a monument declared and notified as a protected monument.’

 

In the court, the ASI had held that the architecture and images of Hindu and Jain deities were re-used to build the Qutub Minar complex. But it is an ancient and preserved building. The case, filed by Jain deity Tirthankar Lord Rishabh Dev and Hindu deity Lord Vishnu, claimed that General Qutbuddin Aibak in Mohammad Ghori’s army built the Quwwat-ul-Islam mosque from that material by demolishing 27 temples.

 

The petitioners had urged the court to order the Center to restore the temple at the disputed site, form a trust and hand over the management of the temples to that trust.
