नई दिल्ली | [कोर्ट बुलेटिन] | संतान पैदा करने के लिए हाईकोर्ट ने कुछ समय पहले उम्रकैद की सजा काट रहे एक कैदी को 15 दिनों का पैरोल दिया था। अब राजस्थान की गहलोत सरकार ने हाईकोर्ट के इस फैसले के खिलाफ सुप्रीम कोर्ट का दरवाजा खटखटाया है। राज्य सरकार की तरफ से यह मामला चीफ जस्टिस एनवी रमन्ना के समक्ष रखा गया है। चीफ जस्टिस को बताया गया है कि हाईकोर्ट के इस आदेश को आधार बनाकर अब कई कैदी पैरोल की डिमांड कर रहे हैं। राज्य के नियमों के मुताबिक, पैरोल के लिए यह कोई शर्त नहीं है।

 

राज्य सरकार की तरफ से सुप्रीम कोर्ट में कहा गया है कि राज्य के नियम के मुताबिक, संतान पैदा करने के लिए पैरोल दी जाए इसको लेकर स्पष्ट नियम नहीं है। जिसके बाद इस आदेश की वजह से दिक्कतें हो रही हैं। ऐसे आवेदनों की बाढ़ आ गई है। बहरहाल अब सुप्रीम कोर्ट अब इस मामले में 29 जुलाई को सुनवाई करेगी।

 

बता दें कि इसी साल अप्रैल में राजस्थान हाईकोर्ट की जोधपुर बेंच ने उम्रकैद की सजा काट रहे एक कैदी को अपनी पत्नी से संबंध बनाने और संतान पैदा करने के लिए पैरोल दिया था। उस फैसले में अदालत ने कहा था कि गर्भधारण करने के लिए संबंध बनाने की इजाजत नहीं देना पत्नी के अधिकारों का हनन होगा।

 

दरअसल 34 साल के नंदलाल भीलवाड़ा को सेशंस कोर्ट ने साल 2019 में एक मामले में उम्र कैद की सजा दी थी। उसके बाद से वह अजमेर की जेल में बंद है। उसकी पत्नी रेखा ने अजमेर की डिस्ट्रिक्ट पैरोल कमेटी के अध्यक्ष को आवेदन देकर यह मांग की थी कि उसके पति को पैरोल दी जाए, जिससे वह मां बन सके।

 

इस बीच यह मामला राजस्थान हाई कोर्ट पहुंच गया। वहां 2 जजों की बेंच ने यह कहा कि भले ही राज्य के पैरोल से जुड़े नियमों- ‘राजस्थान प्रिजनर्स रिलीज ऑन पैरोल रूल्स’ में पत्नी से संबंध बनाने के लिए कैदी की रिहाई का कोई स्पष्ट प्रावधान नहीं है, लेकिन महिला के अधिकार को देखते हुए हम कैदी को पैरोल देने का आदेश देते हैं।

 

महिला के कैदी पति को पैरोल देते वक्त अदालत ने पैरोल नियमों पर भी ध्यान दिया था। अदालत ने कहा था पैरोल के नियमों में ऐसा कोई रूल नहीं है, लेकिन महिला को राहत देते हुए अदालत ने कहा था कि पत्नी की यौन इच्छा और इमोशनल जरूरतें वैवाहिक जीवन से जुड़ी हुई है। जो इन नियमों की वजह से प्रभावित होंगी।

After which there are problems due to this order. There is a flood of such applications. However, now the Supreme Court will now hear the matter on July 29.

 

Let us tell you that in April this year, the Jodhpur Bench of the Rajasthan High Court had granted parole to a prisoner serving a life sentence for having a relationship with his wife and having children. In that judgment, the court had said that not allowing intercourse to conceive would amount to a violation of the rights of the wife.

 

In fact, 34-year-old Nandlal Bhilwara was sentenced to life imprisonment by the Sessions Court in a case in the year 2019. Since then he is lodged in Ajmer jail. His wife Rekha had applied to the chairman of the District Parole Committee of Ajmer, demanding that her husband should be given parole so that he could become a mother.

 

Meanwhile, the matter reached the Rajasthan High Court. There the two-judge bench said that even though there is no clear provision for the release of a prisoner for having a relationship with a wife in the state’s parole rules – ‘Rajasthan Prisoner’s Release on Parole Rules’, but in view of the woman’s right We order parole to the prisoner.

 

While granting parole to the prisoner husband of the woman, the court had also taken note of the parole rules. The court had said that there is no such rule in the parole rules, but while giving relief to the woman, the court had said that the sexual desire and emotional needs of the wife are related to married life. who will be affected by these rules.
