नई दिल्ली | [कोर्ट बुलेटिन] | वैवाहिक बलात्कार को जुर्म घोषित करने की मांग पर हाई कोर्ट ने बुधवार 11 मई 2022 को बंटा हुआ फैसला सुनाया। करीब 7 साल से लंबित इस मसले पर एक न्यायाधीश ने वैवाहिक दुष्कर्म को अपराध घोषित करने के पक्ष में फैसला दिया, जबकि दूसरे ने इसके विपक्ष में अपनी राय दी। हालांकि, दोनों ने पक्षकारों को सुप्रीम कोर्ट में अपील करने की छूट दे दी।

 

पीठ की अगुवाई कर रहे जस्टिस राजीव शकधर ने भारतीय दंड संहिता (IPC) की धारा 376बी व धारा 375 के अपवाद 2 को असंवैधानिक बताते हुए रद्द कर दिया। उन्होंने कहा कि पति या अलग रह रहे पति द्वारा 18 वर्ष से अधिक उम्र की पत्नी के साथ उसकी मर्जी के बगैर यौन संबंध बनाना, उसके संवैधानिक अधिकारों का हनन है।

 

वहीं, जस्टिस सी. हरि शंकर ने कहा, यह अपवाद असंवैधानिक नहीं है और एक समझदार अंतर पर आधारित है। RTI फाउंडेशन व अन्य ने कानून की वैधता को चुनौती दी है। कहा है कि यह उन विवाहित महिलाओं के साथ भेदभाव करती है, जिनके पति उनकी सहमति के बगैर यौन संबंध बनाते हैं।

 

दिल्ली उच्च न्यायालय ने वैवाहिक दुष्कर्म को अपराध घोषित करने की मांग पर खंडित फैसला देते हुए कहा है कि विवाहित महिलाओं के अधिकार को सम्मान और मान्यता देने की जरूरत है। मामले में अलग-अलग फैसला देते हुए जस्टिस राजीव शकधर ने कहा कि समाज में महिलाओं को सशक्त करने की जरूरत है। उन्होंने कहा कि यदि महिलाओं को सशक्त नहीं किया गया तो उन्हें देवी मानने का कोई मतलब नहीं है।

 

जस्टिस शकधर ने कहा कि ‘वे (महिलाएं) हमारे बराबर हैं। कुछ लोग खुशी-खुशी हमारी बेटर हाफ कहेंगे। उन्होंने कहा कि यह दुखद होगा यदि भारतीय दंड संहिता लागू होने के 162 साल बाद भी एक विवाहित महिला की न्याय की गुहार नहीं सुनी जाती है। न्यायाधीश ने कहा कि मेरे विचार से, आत्मविश्वासी और अच्छे लोगों को डरने की कोई बात नहीं है, यदि यह परिवर्तन कायम रहता है।

 

जस्टिस शकधर ने अपने फैसले में कानून में मौजूद अपवाद को रद्द करते हुए वैवाहिक दुष्कर्म को अपराध घोषित किया। उन्होंने फैसला सुनाते हुए कहा कि सभी तथ्यों पर विचार करने के बाद ‘जहां तक मेरा सवाल है, धारा 375 के अपवाद 2 और धारा 376 (ई)…, संविधान के अनुच्छेद 14, 19 (1) (ए) और 21 के तहत मिले अधिकारों का उल्लंघन करना है, इसलिए इसे रद्द किया जाता है। उन्होंने कहा कि यह फैसला तत्काल प्रभावी होगा।

 

उन्होंने कहा कि कानून को लैंगिक रूप से तटस्थ होना चाहिए। अनुमान के तौर पर जो लोग चाहते हैं कि वैवाहिक दुष्कर्म का अपवाद जारी रहे, शायद वही लोग तब इस कानून के रद्द होने के पक्ष में होंगे जब पीड़िता उनकी बहन, बेटी, मां या कोई अपनी हो।

 

असहमत रहे

 

जस्टिस सी हरि शंकर ने कहा कि ‘मैं अपने विद्वान भाई (न्यायाधीश) से सहमत नहीं हूं। उन्होंने फैसले में आगे कहा कि ये प्रावधान संविधान के अनुच्छेद 14, 19 (1) (ए) और 21 का उल्लंघन नहीं करते हैं। अदालतें लोकतांत्रिक रूप से निर्वाचित विधायिका के दृष्टिकोण के लिए अपने व्यक्तिपरक मूल्य निर्णय को प्रतिस्थापित नहीं कर सकती हैं और कानून में मौजूद अपवाद एक समझदार अंतर पर आधारित है। उन्होंने विधायिका की आवाज को लोगों की आवाज बताते हुए कहा कि यदि याचिकाकर्ताओं को लगता है कि एक पति अपनी पत्नी को उसकी इच्छा के खिलाफ यौन संबंध के लिए मजबूर करता है तो उसे संसद का दरवाजा खटखटाना चाहिए।

 

याचिका दाखिल करने वालों की ओर से पैरवी करने वाली अधिवक्ता करुणा नंदी ने कहा कि वे लोग फैसले के खिलाफ सुप्रीम कोर्ट जाएंगे।

 

इनकी याचिकाओं पर आया फैसला

 

न्यायालय ने गैर सरकारी संगठन आरआईटी फाउंडेशन, ऑल इंडिया डेमोक्रेटिक वीमेन्स एसोसिएशन, एक पुरुष और एक महिला द्वारा दायर जनहित याचिकाओं का निपटारा करते हुए यह खंडित फैसला दिया है। इन याचिकाओं में कानून के मौजूदा अपवाद को खत्म कर वैवाहिक दुष्कर्म को अपराध घोषित करने की मांग की गई थी। एक याचिका में इस कानून को बनाए रखने की मांग की गई थी।

 

150 देशों में वैवाहिक दुष्कर्म अपराध, भारत समेत 32 देशों में नहीं

 

संयुक्त राष्ट्र की रिपोर्ट के अनुसार, वर्ष 2019 तक के आंकड़ों से पता चलता है कि 150 देशों में वैवाहिक दुष्कर्म अपराध की श्रेणी में है। वहीं, भारत समेत दुनिया के 32 देश ऐसे हैं, जहां यह अपराध नहीं है। रिपोर्ट के अनुसार, दुनियाभर में पांच में से एक महिला जिसकी उम्र 15 से 49 वर्ष के बीच होती है वो पति द्वारा शारीरिक रूप से प्रताड़ित की जाती है।

 

भारत के साथ पाक, बांग्लादेश, चीन, अफगानिस्तान, मलेशिया, सिंगापुर, ओमान, यमन, बहरीन, कुवैत, हैती, लाओस, माली, म्यांमार, सेनेगल, तजाकिस्तान, बोत्सवाना, कांगो, इरान, लेबनान, युगांडा, अल्जीरिया, ब्रुनेई जैसे देशों में वैवाहिक दुष्कर्म अपराध नहीं है।

 

ऑस्ट्रिया में सरकार लड़ती है मुकदमा

 

ऑस्ट्रिया में वैवाहिक दुष्कर्म को वर्ष 1989 में अपराध घोषित किया गया था। वर्ष 2004 में सरकार ने इसे स्टेट ऑफेंस करार दे दिया। इसके तहत अगर पीड़िता शिकायत नहीं भी करती है तो भी सरकार इस केस को अदालत में लड़ेगी और पीड़िता को न्याय दिलाएगी।

 

अमेरिका में 10 से 14 विवाहिताओं से दुष्कर्म

 

अमेरिका ने पांच जुलाई 1993 को सभी राज्यों में वैवाहिक दुष्कर्म को अपराध घोषित किया गया था। अमेरिका में 10 से 14 फीसदी विवाहित महिलाओं के साथ वैवाहिक दुष्कर्म की घटनाएं होती हैं। एक तिहाई महिलाओं के साथ उनके पति बिना उनकी सहमति के शारीरिक संबंध बनाते हैं।

 

महिला कार्यकर्ताओं ने फैसले पर निराशा जताई

 

उच्च न्यायालय ने बुधवार को वैवाहिक दुष्कर्म को अपराध घोषित करने के मामले में अपना बंटा हुआ फैसला सुनाया। इसके बाद मामले से जुड़ी महिला कार्यकर्ताओं ने इस फैसले को निराशाजनक बताया। साथ ही, इस उम्मीद जताई कि सर्वोच्च न्यायालय इस मसले पर व्यापक और अधिक समझदारी वाला फैसला देगा।

 

महिला समूह सहेली ट्रस्ट की सदस्य वाणी सुब्रमण्यम ने फैसले को निराशाजनक बताया। उन्होंने सवाल उठाया कि यदि घरेलू हिंसा अपराध है तो वैवाहिक दुष्कर्म किस तरह से अपराध नहीं है। किसी महिला की शादी होने का मतलब यह नहीं है कि उसने हमेशा के लिए सहमति दे दी है।

 

दुष्कर्म के अपराध के खिलाफ आवाज उठाने वाली योगिता भयाना इस बात को लेकर संतुष्ट हैं कि कम से कम वैवाहिक दुष्कर्म के मसले पर चर्चा शुरू हो गई है। उन्होंने कहा कि मसले को शीर्ष न्यायालय भेज दिया गया है, इसलिए इस मामले पर विस्तृत चर्चा होगी और निष्पक्ष आदेश होगा।

 

अखिल भारतीय प्रगतिशील महिला संघ की सदस्य कविता कृष्णन ने कहा कहा कि उच्च न्यायालय का फैसला निराशाजनक और परेशान करने वाला है। उन्होंने कहा कि कानूनी मुद्दा काफी स्पष्ट है और यह दुष्कर्म पीड़ितों की एक श्रेणी – पत्नियों के खिलाफ भेदभावपूर्ण है। कृष्णन ने कहा कि मुझे उम्मीद है कि सर्वोच्च न्यायालय इस कानून को हटाने के लिए स्पष्ट फैसला देगा।

 

दिल्ली महिला आयोग की अध्यक्ष स्वाति मालीवाल ने मामले के संबंध में ट्वीट कर कहा कि वैवाहिक दुष्कर्म एक वास्तविकता है और इसके खिलाफ कार्रवाई करने का समय आ गया है।

Justice Rajiv Shakdher, who was heading the bench, struck down Exception 2 of Section 376B and Section 375 of the Indian Penal Code (IPC) as unconstitutional. He said that having sex with a wife who is above 18 years of age by the husband or the estranged husband without her consent is a violation of her constitutional rights.

 

At the same time, Justice C. Hari Shankar said, this exception is not unconstitutional and is based on a sensible distinction. The RTI Foundation and others have challenged the validity of the law. It is said that it discriminates against married women whose husbands have sex without their consent.

 

The Delhi High Court has given a fractured verdict on the demand to declare marital rape as an offence, saying that the right of married women needs to be respected and recognized. Giving separate judgments in the case, Justice Rajiv Shakdher said that there is a need to empower women in the society. He said that if women were not empowered then there is no point in treating them as goddesses.

 

Justice Shakdher said that ‘they (women) are equal to us’. Some would happily say our better half. He said it would be sad if the plea of ​​a married woman for justice is not heard even after 162 years of the implementation of the Indian Penal Code. The judge said that in my view, self-confident and good people have nothing to fear, if this change persists.

 

Justice Shakdher in his judgment declared marital rape a crime, setting aside the exception in the law. While pronouncing the verdict, he said that after considering all the facts, ‘as far as I am concerned, exceptions 2 to section 375 and section 376(e)…, articles 14, 19(1) (a) and 21 of the Constitution’ is infringing on the rights given under it, therefore it is canceled. He said the decision would be effective immediately.

 

He said the law should be gender neutral. Predictably, those who want the marital rape exception to continue may be in favor of repeal of the law if the victim is their sister, daughter, mother or someone else.

Justice C Hari Shankar said that ‘I do not agree with my learned brother (Judge)’. He further said in the judgment that these provisions do not violate Articles 14, 19 (1) (a) and 21 of the Constitution. Courts cannot substitute their subjective value judgment for the view of a democratically elected legislature and the exception to the law is based on a sensible distinction. Describing the voice of the legislature as the voice of the people, he said that if the petitioners feel that a husband forces his wife to have sex against her will, he should approach the Parliament.

 

Advocate Karuna Nandy, appearing for the petitioners, said that they would move the Supreme Court against the decision.

 Government fights lawsuit in Austria

 

In Austria marital rape was outlawed in 1989. In 2004, the government declared it a state offence. Under this, even if the victim does not complain, the government will fight the case in the court and bring justice to the victim.

 

10 to 14 married women raped in America

 

On July 5, 1993, the United States made marital rape a crime in all states. Marital rape accounts for 10 to 14 percent of married women in the US. One-third of women have physical relations with their husbands without their consent.

 

 Women activists expressed disappointment over the decision

 

The High Court on Wednesday gave its divided verdict in the matter of criminalizing marital rape. After this, the women activists associated with the case called this decision disappointing. At the same time, he hoped that the Supreme Court will give a comprehensive and more sensible decision on this issue.

 

Vani Subramaniam, a member of the women’s group Saheli Trust, described the decision as disappointing. He raised the question that if domestic violence is a crime, then how is marital rape not a crime. The marriage of a woman does not mean that she has given consent forever.

 

Yogita Bhayana, who has raised her voice against the crime of rape, is satisfied that at least the discussion has started on the issue of marital rape. He said that the matter has been referred to the apex court, so there will be a detailed discussion on the matter and there will be a fair order.

 

All India Progressive Women’s Association member Kavita Krishnan said the high court’s decision was disappointing and disturbing. He said the legal issue is quite clear and it is discriminatory against a category of rape victims – wives. Krishnan said that I hope that the Supreme Court will give a clear decision to remove this law.

 

Delhi Commission for Women chairperson Swati Maliwal tweeted regarding the matter and said that marital rape is a reality and the time has come to take action against it.
