बिलासपुर | [कोर्ट बुलेटिन] | प्रदेश के निजी अस्पतालों में मरीजों को डॉक्टरों द्वारा जेनेरिक दवाइयां नहीं लिखे जाने का मामला छत्तीसगढ हाईकोर्ट में पहुंच गया है। चीफ जस्टिस की डबल बेंच ने याचिकाकर्ता की पूरी व्यथा सुनी, जिसके बाद केंद्र और राज्य सरकार को नोटिस जारी कर 10 हफ्ते के अंदर जवाब मांगा है। जनहित याचिका में यह भी बताया गया कि मेडिकल काउंसिल ऑफ इंडिया ने डॉक्टरों को जेनेरिक दवा लिखना अनिवार्य किया है, बावजूद इस आदेश का पालन नहीं किया जा रहा है।

कोरबा के RTI कार्यकर्ता लक्ष्मी चौहान ने अधिवक्ता के माध्यम से हाईकोर्ट में जनहित याचिका दायर की है, जिसकी सुनवाई हाईकोर्ट के चीफ जस्टिस अरूप कुमार गोस्वामी और जस्टिस आरसीएस सामंत की डिवीजन बेंच में हुई। याचिका में बताया गया है कि केंद्र सरकार के निर्देश पर मेडिकल काउंसिल ऑफ इंडिया ने 2016 में डॉक्टरों को जेनेरिक दवाइयों की अनिवार्यता के संबंध में दिशानिर्देश जारी किया है।

21 अप्रैल 2017 को इसका नोटिफिकेशन जारी किया था, जिसके अनुसार सभी शासकीय और निजी अस्पताल के डॉक्टरों को सिर्फ जेनेरिक दवाइयां ही लिखने का प्रावधान है। निजी अस्पतालों व डॉक्टरों को जेनेरिक दवाइयां उपयोग करने के निर्देश दिए गए हैं, लेकिन राज्य के सरकारी और प्राइवेट अस्पताल के डॉक्टर प्रिस्क्रिप्शन में जेनेरिक दवाइयों की जगह ब्रांडेंड महंगी दवाइयां लिख रहे हैं।

प्रदेश में नियम का नहीं हो रहा पालन

याचिका में बताया गया है कि MCI के नोटिफिकेशन के अनुसार फिजिशियन को कैपिटल लेटर में सिर्फ जेनेरिक दवाओं का नाम ही लिखना है, लेकिन, प्रदेश में इसका पालन नहीं किया जा रहा है। याचिका में MCI की गाइडलाइन का पालन कराने व छत्तीसगढ़ में जेनेरिक दवाइयों को अनिवार्य करते हुए राज्य शासन को आदेशित करने की मांग की गई है।

डॉक्टरों का लाइसेंस रद्द किया जाए

RTI एक्टिविस्ट ने बताया कि मेडिकल काउंसिल ऑफ इंडिया ने नोटिफिकेशन में स्पष्ट किया है कि जेनेरिक दवाइयों का नाम नहीं लिखना पेशेवर कदाचरण, शिष्टाचार नैतिकता नियम 2002 के खिलाफ है। लिहाजा, इस तरह से कदाचरण करने वाले डॉक्टरों पर कार्रवाई की जाए और उनका लाइसेंस निरस्त किया जाए, ताकि मेडिकल काउंसिल के दिशा निर्देशों का पालन हो सके।

कमीशन का लालच इसलिए नहीं लिखते

याचिकाकर्ता ने कोर्ट में बताया कि जेनेरिक दवाइयां काफी सस्ती है। जबकि, ब्रांडेड कंपनी की दवाइयां काफी महंगी है। ऐसे में डॉक्टरों की मनमानी और नियमों के पालन नहीं करने के कारण प्रदेश की गरीब जनता को सस्ती दवाइयों के बजाए महंगी दवाइयां खरीदनी पड़ रही है। आरोप है कि डॉक्टरों को ब्रांडेड कंपनी की दवाइयां लिखने के लिए कमीशन मिलता है। यही वजह है कि डॉक्टर जानबुझकर जेनेरिक दवाइंया नहीं लिखते हैं।

Bilaspur | [Court Bulletin] | The matter of doctors not prescribing generic medicines to patients in private hospitals of the state has reached the Chhattisgarh High Court. The double bench of the Chief Justice heard the entire grievance of the petitioner, after which the Central and the State Government have been issued notices and sought their response within 10 weeks. It was also mentioned in the PIL that the Medical Council of India has made it mandatory for doctors to prescribe generic medicine, yet this order is not being followed.

RTI activist Laxmi Chauhan of Korba has filed a public interest litigation in the High Court through advocate, which was heard in the Division Bench of High Court Chief Justice Arup Kumar Goswami and Justice RCS Samant. It has been told in the petition that on the instructions of the Central Government, the Medical Council of India has issued guidelines regarding the mandatory requirement of generic medicines to doctors in 2016.

Its notification was issued on 21 April 2017, according to which doctors of all government and private hospitals have a provision to prescribe only generic medicines. Instructions have been given to private hospitals and doctors to use generic medicines, but doctors of government and private hospitals of the state are prescribing branded expensive medicines instead of generic medicines in the prescription.

 Rules are not being followed in the state

It has been told in the petition that according to the notification of MCI, the physician has to write only the name of generic medicines in capital letter, but, it is not being followed in the state. In the petition, a demand has been made to order the state government to follow the guidelines of MCI and make generic medicines mandatory in Chhattisgarh.

 Doctors license should be canceled

The RTI activist said that the Medical Council of India has clarified in the notification that not writing the names of generic medicines is against the professional misconduct, etiquette ethics rules 2002. Therefore, action should be taken against the doctors who misbehave in this way and their license should be revoked, so that the guidelines of the Medical Council can be followed.

Don’t write because of the greed of commission

The petitioner told the court that generic medicines are very cheap. Whereas, branded company medicines are very expensive. In such a situation, due to the arbitrariness of doctors and not following the rules, the poor people of the state have to buy expensive medicines instead of cheap medicines. It is alleged that doctors get commission for prescribing branded company medicines. This is the reason why doctors do not deliberately prescribe generic medicines.
