नई दिल्ली | [कोर्ट बुलेटिन] | केंद्र सरकार की एक अनिवार्य अधिसूचना नहीं होने की वजह से 2 राज्यों में विवाह संबंधी विवादों के शीघ्र निपटारे के लिए स्थापित पारिवारिक न्यायालयों के अधिकार क्षेत्र पर प्रश्नचिह्न लग गया है। आधिकारिक सूत्रों ने बताया कि कानूनी मुश्किल को दूर करने के लिए, केंद्र सरकार हिमाचल प्रदेश और नगालैंड की पारिवारिक अदालतों में न्यायिक अधिकारियों और अदालत के कर्मचारियों की नियुक्ति को पूर्व तिथि से वैध ठहराने में मदद करने के लिए एक विधेयक लाने वाली है।

 

आगामी 18 जुलाई से शुरू हो रहे संसद के मॉनसून सत्र में पारिवारिक न्यायालय (संशोधन) विधेयक, 2022 लाए जाने की संभावना है। पारिवारिक न्यायालयों की स्थापना और उनके कामकाज, संबंधित उच्च न्यायालयों के परामर्श से राज्य सरकारों के अधिकार क्षेत्र में आते हैं।

 

पारिवारिक न्यायालय अधिनियम, 1984 में राज्य सरकार द्वारा उच्च न्यायालय के परामर्श से पारिवारिक अदालत (फैमिली कोर्ट) की स्थापना का प्रावधान है ताकि सुलह को बढ़ावा दिया जा सके और विवाह और पारिवारिक मामलों से संबंधित विवादों का त्वरित निपटारा सुनिश्चित किया जा सके।

 

नागालैंड, हिमाचल के लिए अधिसूचना जारी नहीं

 

जिन राज्यों में ऐसी अदालतें स्थापित हैं, उनमें 1984 के कानून के प्रावधानों को लागू करने के लिए केंद्र सरकार की अधिसूचना आवश्यक है। लेकिन ऐसी तीन अदालतों को संचालित करने वाले हिमाचल प्रदेश के मामले में ऐसी अधिसूचना जारी नहीं की गई है। नगालैंड में इस तरह की दो अदालत है। हिमाचल प्रदेश में पारिवारिक न्यायालयों की वैधता को केंद्र सरकार की अधिसूचना के अभाव का हवाला देते हुए पिछले साल राज्य हाई कोर्ट में चुनौती दी गई थी।

 

पारिवारिक न्यायालय अधिनियम में चूंकि केंद्र सरकार की अधिसूचना पूर्व तिथि से जारी करने का कोई प्रावधान नहीं है, इसलिए केंद्रीय कानून मंत्रालय द्वारा संशोधन विधेयक की योजना बनाई गई।

 

 

Monsoon session: Center preparing to bring bill in 2 states for family courts

 

 

New Delhi | [Court Bulletin] | In the absence of a mandatory notification of the Central Government, the jurisdiction of the Family Courts set up for speedy settlement of marriage disputes in two states has been questioned. Official sources said that to remove the legal hassle, the central government is about to bring a bill to help retrospectively legalize the appointment of judicial officers and court staff in the family courts of Himachal Pradesh and Nagaland.

 

The Family Courts (Amendment) Bill, 2022 is likely to be brought in the Monsoon Session of Parliament starting from July 18. The establishment and functioning of Family Courts, in consultation with the respective High Courts, fall under the jurisdiction of the State Governments.

 

The Family Courts Act, 1984 provides for the establishment of Family Courts (Family Courts) by the State Government in consultation with the High Court to promote conciliation and ensure speedy settlement of disputes relating to marriage and family matters.

 

 Notification not issued for Nagaland, Himachal

 

In the states where such courts are established, notification of the central government is necessary to implement the provisions of the 1984 Act. But such notification has not been issued in the case of Himachal Pradesh which has three such courts. There are two such courts in Nagaland. The legality of family courts in Himachal Pradesh was challenged in the state high court last year citing lack of notification from the central government.

 

Since there is no provision to issue retrospective notification of the Central Government in the Family Court Act, the amendment bill was planned by the Union Law Ministry.
