नई दिल्ली | [कोर्ट बुलेटिन] | हाईकोर्ट ने पड़ोसियों के आपसी विवाद में महिलाओं से छेड़छाड़ और मान-सम्मान को ठेस पहुंचाने के आरोपों में मुकदमा दर्ज कराने की प्रवृत्ति पर दिल्ली हाईकोर्ट ने चिंता व्यक्त की है। कोर्ट ने इसे गंभीरता से लेते हुए कहा है कि इस प्रवृत्ति पर तत्काल रोक लगाने की जरूरत है।
जस्टिस स्वर्णकांता शर्मा ने आरोपी और शिकायतकर्ता के बीच में हुए समझौते के आधार पर दर्ज मुकदमे को खारिज करते हुए यह टिप्पणी की है। दोनों पक्षों ने हाईकोर्ट को बताया था कि गलतफहमी के चलते विवाद हो गया था और अब समझौता हो गया है, ऐसे में दर्ज मुकदमे को खारिज कर दिया जाए।
कोर्ट ने कहा है कि पड़ोसियों के बीच विवादों को निपटाने के लिए महिलाओं के खिलाफ होने वाले अपराध यानी आईपीसी की धारा 354 और 509 के तहत मामले दर्ज करने की प्रवृत्ति बढ़ रही है। कोर्ट ने कहा है कि यह चिंता की बात है और इस पर तत्काल लगाम लगाने की जरूरत है।
कोर्ट ने कहा है कि मामले में चार्जशीट दाखिल की जा चुकी है और पक्षकारों ने आपसी सहमति से मामले का निपटारा करने और अदालत आने में देर कर दी है। कोर्ट ने सभी पक्षों को सुनने के बाद वर्ष 2017 में बाबा हरिदास नगर थाने में दर्ज मुकदमे को रद्द कर दिया। हालांकि, इस मामले के प्रत्येक आरोपी पर दस-दस हजार रुपये का जुर्माना लगाया गया है।
हाईकोर्ट ने आरोपियों को जुर्माने की रकम एक सप्ताह के भीतर तीस हजारी कोर्ट स्थित अधिवक्ता कल्याण कोष में जमा कराने का आदेश दिया है।
Ban on the tendency to file a case of molestation in the quarrel of neighbors
New Delhi | [Court Bulletin] | The Delhi High Court has expressed concern over the tendency of filing cases on charges of molesting women and hurting the honor and dignity of women in mutual disputes between neighbors. Taking this seriously, the court said that this trend needs to be stopped immediately.
Justice Swarnakanta Sharma made this observation while dismissing the case registered on the basis of the settlement between the accused and the complainant. Both the parties had told the High Court that the dispute had arisen due to misunderstanding and now the settlement has been reached, in such a situation the registered case should be quashed.
The court has said that there is an increasing trend of registering cases against women i.e. sections 354 and 509 of the IPC to settle disputes between neighbours. The court has said that this is a matter of concern and it needs to be curbed immediately.
The court has said that the charge sheet has been filed in the case and the parties have delayed in coming to the court to settle the matter by mutual consent. After hearing all the parties, the court quashed the case registered at Baba Haridas Nagar police station in the year 2017. However, a fine of ten thousand rupees has been imposed on each of the accused in this case.
The High Court has ordered the accused to deposit the fine amount in the Advocates Welfare Fund at Tis Hazari Court within a week.
