बिलासपुर | [कोर्ट बुलेटिन] | हिन्दू विधवा के भरण-पोषण मामले में छत्तीसगढ़, बिलासपुर हाईकोर्ट ने महत्वपूर्ण फैसला दिया है। हाईकोर्ट ने कहा कि यदि हिन्दू विधवा अपनी आय या अन्य संपत्ति से जीवन जीने में असमर्थ है तो वह अपने ससुर से भरण-पोषण का दावा कर सकती है। जस्टिस गौतम भादुड़ी व जस्टिस दीपक कुमार तिवारी की डिवीजन बेंच में मामले की सुनवाई हुई। छत्तीसगढ़ हाईकोर्ट ने कहा कि पति की मौत के बाद ससुर अपनी बहू को घर से निकाल देता है या महिला अलग रहती है तो भी वह कानूनी रूप से भरण-पोषण की हकदार होगी। हाईकोर्ट ने ससुर की याचिका को खारिज भी कर दिया। हिन्दू विवाह अधिनियम के तहत यह फैसला आगे नजीर बनेगा।

 

फैमिली कोर्ट के निर्देश को एक महिला के ससुर ने हाईकोर्ट में चुनौती दी थी। सभी पक्षों को सुनने के बाद हाईकोर्ट ने फैमिली कोर्ट के निर्णय को सही ठहराया। फैमिली कोर्ट के 2500 रुपये भरण-पोषण देने के आदेश में बदलाव करते हुए हाईकोर्ट ने 4000 रुपये प्रतिमाह बहू को देने का आदेश दिया है।

 

याचिका के मुताबिक कोरबा की रहने वाली युवती का विवाह साल 2008 में जांजगीर- चांपा जिले के बिर्रा निवासी युवक से हुआ था। 2012 में महिला के पति की मृत्यु हो गई। ससुराल पक्ष ने महिला को घर निकाल दिया, जिसके बाद वह अपने मायके में रहने लगी।

 

विधवा ने 2015 में जांजगीर फैमिली कोर्ट में परिवाद दायर कर ससुराल पक्ष से भरण पोषण राशि मांगी। कोर्ट ने विधवा महिला के पक्ष में भरण-पोषण देने का फैसला दिया था।

 

फैमिली कोर्ट के फैसले को हाईकोर्ट में चुनौती

 

विधवा महिला के ससुर ने फैमिली कोर्ट के आदेश को छत्तीसगढ हाईकोर्ट में चुनौती दी थी। उन्होंने निर्णय को अवैधानिक बताते हुए वकील के माध्यम से कहा कि हिंदू विवाह अधिनियम के तहत कोई भी महिला अपने पति से भरण पोषण का दावा कर सकती है, लेकिन ससुरालवालों पर दावा नहीं बनता। मैंने अपनी बहू को घर से नहीं निकाला, बल्कि वह खुद ही अपने मायके चली गई। अत: फैमिली कोर्ट के आदेश को खारिज किया जाए।

 

हाईकोर्ट की डिवीजन बेंच ने दोनों पक्षों को सुनने के बाद स्पष्ट किया है कि हिंदू विवाह अधिनियम के तहत महिला के पति की मौत के बाद बहू की जिम्मेदारी ससुर व ससुराल वालों पर होती है। ऐसे में बहू के अलग रहने या घर से निकाल देने पर भी वह भरण पोषण की हकदार है।

The High Court said that if a Hindu widow is unable to live by her own income or other assets, she can claim maintenance from her father-in-law. The matter was heard in the Division Bench of Justice Gautam Bhaduri and Justice Deepak Kumar Tiwari. The Chhattisgarh High Court said that after the death of the husband, the father-in-law removes his daughter-in-law from the house or the woman lives separately, she will be legally entitled to maintenance. The High Court also dismissed the father-in-law’s petition. Under the Hindu Marriage Act, this decision will become a precedent.

 

The direction of the family court was challenged in the High Court by the father-in-law of a woman. After hearing all the parties, the High Court upheld the decision of the Family Court. Modifying the order of the family court to give maintenance of Rs 2500, the High Court has ordered to pay Rs 4000 per month to the daughter-in-law.

 

According to the petition, the girl, a resident of Korba, was married in the year 2008 to a youth resident of Birra in Janjgir-Champa district. The woman’s husband died in 2012. The in-laws drove the woman home, after which she started living in her maternal home.

 

The widow filed a complaint in the Janjgir Family Court in 2015 and sought maintenance from the in-laws’ side. The court had given a decision to give maintenance in favor of the widowed woman.

 

 Family Court’s decision challenged in High Court

 

The father-in-law of the widow had challenged the order of the family court in the Chhattisgarh High Court. Describing the decision as illegal, he said through the lawyer that under the Hindu Marriage Act, any woman can claim maintenance from her husband, but the in-laws do not have a claim. I did not take my daughter-in-law out of the house, but she herself went to her maternal home. Therefore, the order of the Family Court should be set aside.

 

The Division Bench of the High Court, after hearing both the sides, clarified that under the Hindu Marriage Act, after the death of the woman’s husband, the responsibility of the daughter-in-law lies with the father-in-law and in-laws. In such a situation, even if the daughter-in-law is separated or thrown out of the house, she is entitled to maintenance.
