जस्टिस जसमीत सिंह की बेंच ने एक मुस्लिम जोड़े के मामले में यह टिप्पणी की, जिसने बीते 11 मार्च को लड़की के माता-पिता की इच्छा के खिलाफ जाकर शादी कर ली थी। युवक की उम्र 25 साल है, जबकि उसके परिवार और पुलिस के मुताबिक लड़की मार्च में 15 साल की थी। हालांकि लड़की के वकील द्वारा बेंच के समक्ष पेश किए गए आधार कार्ड के अनुसार, उसकी उम्र 19 वर्ष से अधिक है।

 

इस पर बेंच ने कहा कि यह स्पष्ट है कि मुस्लिम कानून के अनुसार, जो लड़की यौवन की आयु प्राप्त कर चुकी है वह अपने माता-पिता की सहमति के बिना शादी कर सकती थी और उसे अपने पति के साथ रहने का अधिकार था, भले ही वह 18 वर्ष से कम उम्र की हो।

 

बेंच ने टिप्पणी करते हुए कहा कि पंजाब और हरियाणा हाईकोर्ट के उस आदेश पर भरोसा किया, जिसमें अदालत ने सर दिनशाह फरदुनजी मुल्ला की पुस्तक ”मोहम्मडन कानून के सिद्धांत” का संदर्भ दिया था। जस्टिस सिंह ने आगे कहा कि अगर लड़की ने जानबूझकर और अपनी खुशी से शादी की सहमति दी है, तो राज्य उसके निजी स्थान में प्रवेश करने और जोड़े को अलग करने वाला कोई नहीं है। बेंच ने आदेश में कहा कि ऐसा करना राज्य द्वारा व्यक्तिगत स्थान का अतिक्रमण करने के समान होगा।

 

दरअसल, इस दंपती ने अप्रैल में पुलिस सुरक्षा और यह सुनिश्चित करने का निर्देश देने के लिए हाईकोर्ट का दरवाजा खटखटाया था कि कोई भी उन्हें एक-दूसरे से अलग न करे। लड़की के माता-पिता ने 5 मार्च को द्वारका जिले के थाने में मामला दर्ज करा नाबालिग के अपहरण का आरोप लगाया था। बाद में मामले में आईपीसी की धारा 376 (बलात्कार) और यौन अपराधों से बच्चों के संरक्षण (पॉक्सो) एक्ट की धारा 6 (बढ़ी हुई यौन हमला) को जोड़ा गया।

 

हालांकि, लड़की ने हाईकोर्ट को बताया कि घर पर उसके माता-पिता उसे नियमित रूप से पीटते थे और उन्होंने जबरन उसकी शादी किसी और से करने की कोशिश की। पुलिस ने 27 अप्रैल को लड़की को उस व्यक्ति के कब्जे से “बरामद” किया और उसे बाल कल्याण समिति (सीडब्ल्यूसी) के समक्ष पेश किया।

 

सीडब्ल्यूसी के निर्देश पर उसे हरि नगर के निर्मल छाया कॉम्प्लेक्स में रखा गया था। लड़की का प्रतिनिधित्व करने वाले वकील ने बेंच को यह भी बताया कि वह गर्भवती है और अपनी मर्जी और सहमति से उस व्यक्ति के साथ भाग गई थी।

 

जस्टिस सिंह ने आदेश में कहा कि इस मामले के तथ्य पहले के एक फैसले से अलग हैं, जिसमें यह माना गया था कि यह मामला पॉक्सो से अलग है जिसमें 18 साल से कम उम्र के बच्चों को यौन शोषण से बचाने के लिए एक कानून बनाया गया है, लेकिन यहां मामला मुस्लिम कानून का लागू होगा।

 

बेंच ने कहा कि यह मामला शोषण का मामला नहीं है, बल्कि एक ऐसा मामला है जहां याचिकाकर्ता प्यार में थे, उन्होंने मुस्लिम कानूनों के अनुसार शादी कर ली और उसके बाद शारीरिक संबंध बनाए। दंपती पति-पत्नी के रूप में एक साथ रह रहे थे और उन पर शादी से पहले यौन संबंध रखने का कोई आरोप नहीं है।

 

अदालत ने आगे कहा कि याचिकाकर्ताओं को कानूनी रूप से एक-दूसरे से शादी करने से इनकार नहीं किया जा सकता है क्योंकि यह “विवाह का सार” है और अगर वे अलग हो जाते हैं, तो यह केवल लड़की और उसके अजन्मे बच्चे को और अधिक आघात पहुंचाएगा। आदेश में कहा गया कि यह भी ध्यान में रखा जाना चाहिए कि वर्तमान मामले में याचिकाकर्ता नंबर 1 (लड़की) के घर का माहौल उसके और उसके पति के प्रति शत्रुतापूर्ण है।

A bench of Justice Jasmeet Singh made this observation in the case of a Muslim couple who got married on March 11 against the wishes of the girl’s parents. However, as per the Aadhar card produced before the bench by the girl’s counsel, she is above 19 years of age.

 

To this the Bench said that it is clear that according to Muslim law, a girl who has attained the age of puberty could marry without the consent of her parents and had the right to live with her husband, even if She must be under 18 years of age.

 

The bench, while remarking, relied upon the order of the Punjab and Haryana High Court in which the court had referred to Sir Dinshah Fardunji Mulla’s book “Principles of Mohammedan Law”. Justice Singh further observed that if the girl has intentionally and voluntarily consented to the marriage, the state is no one to enter her private space and separate the couple. The bench said in the order that doing so would amount to encroachment on personal space by the state.

 

In fact, the couple had approached the High Court in April seeking police protection and directions to ensure that no one separates them from each other. The girl’s parents had on March 5 lodged a case with the police station in Dwarka district alleging kidnapping of a minor. Later, Section 376 (rape) of the IPC and Section 6 (aggravated sexual assault) of the Protection of Children from Sexual Offenses (POCSO) Act were added in the case.

 

However, the girl told the High Court that her parents used to beat her regularly at home and they forcibly tried to get her married to someone else. The police “recovered” the girl from the man’s possession on April 27 and produced her before the Child Welfare Committee (CWC).

 

On the instructions of CWC, he was kept at Nirmal Chhaya Complex in Hari Nagar. The counsel representing the girl also told the bench that she was pregnant and had eloped with the man of her own free will and consent.

 

Justice Singh said in the order that the facts of the case are different from an earlier judgment, which held that this case is different from POCSO, which made a law to protect children below 18 years of age from sexual exploitation. But here the case of Muslim law will apply.

 

The Bench said that this case is not a case of exploitation, but a case where the petitioners were in love, got married as per Muslim laws and then had physical relations. The couple were living together as husband and wife and there is no allegation against them of having sex before marriage.

 

The court further observed that the petitioners cannot be denied legally marrying each other as it is the “essence of marriage” and if they are separated, it will only further harm the girl and her unborn child.
