पटना | [कोर्ट बुलेटिन] | हाईकोर्ट ने सरकारी संपत्ति के हुए नुकसान की भरपाई उपद्रवियों से करने की मांग करने वाली जनहित याचिका को खारिज कर दिया है। यानी कि राज्य में उपद्रवियों से जुर्माना वसूलने की फिलहाल कोई कार्रवाई नहीं होने वाली है। याचिका में छात्रों को भड़काने और अराजकता फैलाने वाले तत्वों की मदद करने वाले लोगों की जांच करने की भी मांग की गई थी। बिहार में अग्निपथ योजना के विरोध के नाम पर बीते महीने प्रदर्शनकारियों ने जमकर उत्पात मचाया।

 

पटना हाईकोर्ट के मुख्य न्यायाधीश न्यायमूर्ति संजय करोल और न्यायमूर्ति एस कुमार की खंडपीठ ने शुक्रवार को इस मामले पर सुनवाई की। कोर्ट को बताया गया कि जिम्मेदार अधिकारी उग्र आंदोलन को रोकने में नाकामयाब रहे। इस कारण कई सौ करोड़ रुपये की सरकारी संपत्ति को नष्ट किया गया। उनका कहना था कि इस आंदोलन में क्षतिग्रस्त संपत्ति का आकलन कर आंदोलनकारियों से पैसों की वसूली की जाए। साथ ही इस आंदोलन में भाग लेने वाली राजनीतिक पार्टियों पर भी जुर्माना लगाया जाए।

 

याचिकाकर्ता के मुताबिक इस घटना को समय रहते नहीं रोक पाने वाले सरकारी अधिकारियों पर भी कानूनी कार्रवाई की जाए और उनपर जुर्माना लगाया जाए। कोर्ट को बताया गया कि इस उग्र और हिंसक आंदोलन के कारण न सिर्फ रेलवे को काफी नुकसान हुआ, बल्कि आम नागरिकों की सुरक्षा भी खतरे में पड़ गई। दानापुर रेल मंडल को करीब 260 करोड़ रुपये का नुकसान हुआ।

 

वहीं, महाधिवक्ता ललित किशोर ने कोर्ट को बताया कि इस आंदोलन से निपटने के लिए राज्य सरकार पूरी तरह मुस्तैद थी। सरकार ने आंदोलन को रोकने के लिए सख्त इंतजाम किए थे लेकिन गलत नीयत से सरकार को बदनाम करने के लिए इस प्रकार की लोकहित याचिका दायर की गई है।

 

राज्य सरकार ने अराजक तत्वों पर कार्रवाई की है। सरकारी संपत्ति की रक्षा के लिए बड़ी संख्या में पुलिस बल तैनात किए गए थे। महाधिवक्ता की ओर से दी गई जानकारी के बाद कोर्ट ने लोकहित याचिका को खारिज कर दिया।

He said that after assessing the property damaged in this movement, money should be recovered from the agitators. Along with this, the political parties participating in this movement should also be fined.

 

According to the petitioner, legal action should also be taken against the government officials who could not stop this incident in time and fine should be imposed on them. The court was told that due to this violent and violent agitation, not only did the railways suffer a lot, but the safety of the common citizens was also endangered. The Danapur Railway Division suffered a loss of about Rs 260 crore.

 

At the same time, Advocate General Lalit Kishor told the court that the state government was fully prepared to deal with this movement. The government had made strict arrangements to stop the agitation, but this type of public interest litigation has been filed to defame the government with wrong intentions.

 

The state government has taken action against the chaotic elements. A large number of police forces were deployed to protect government property. After the information given by the Advocate General, the court dismissed the public interest litigation.
