उच्च न्यायालय की इंदौर पीठ के न्यायमूर्ति सुबोध अभ्यंकर ने सरपंच पद के लिए पराजित उम्मीदवार राजल बाई की याचिका पर राज्य चुनाव आयोग और मध्य प्रदेश सरकार को मंगलवार को नोटिस जारी कर जवाब तलब किया है।
याचिका में कहा गया है कि राजगढ़ जिले की भीलखेड़ा ग्राम पंचायत के जुलाई में संपन्न चुनावों में विनीता (28) ने दस्तावेजों की कथित जालसाजी के जरिये खुद को अनीता (30) के रूप में पेश करते हुए पर्चा तथा हलफनामा भरा और चुनाव जीत गईं।
याचिकाकर्ता के वकील मनीष कुमार विजयवर्गीय ने संवाददाताओं से कहा, ‘ग्रामीण क्षेत्रों में आज भी प्रचलित घूंघट प्रथा का बेजा फायदा उठाते हुए विनीता ने अनीता के नाम पर घूंघट में सरपंच पद की शपथ भी ले ली।’
याचिका के मुताबिक राजस्थान के झालावाड़ जिले में 10 साल से ज्यादा वक्त से रह रही अनीता पढ़-लिख नहीं पातीं और उनके नाम पर कथित चुनावी फर्जीवाड़े की खबर मिलने पर उन्होंने राजगढ़ के जिला प्रशासन को शिकायत की, लेकिन इस पर प्रशासन की ओर से कोई कदम नहीं उठाया गया।
एसटी के लिए आरक्षित थी सीट
याचिका में यह भी कहा गया कि सरपंच पद के चुनावों में आधिकारिक रूप से विजयी घोषित अनीता दरअसल अन्य पिछड़ा वर्ग (ओबीसी) में शामिल रुहेला समुदाय से ताल्लुक रखती हैं, जबकि भीलखेड़ा ग्राम पंचायत के चुनावों में सरपंच का पद अनुसूचित जनजाति (ST) की महिला के लिए आरक्षित था।

The petition said that in the elections to the Bhilkheda gram panchayat of Rajgarh district held in July, Vinita (28) filed a form and affidavit, projecting herself as Anita (30), through alleged forgery of documents and won the election.
Petitioner’s lawyer Manish Kumar Vijayvargiya told reporters, “Taking undue advantage of the veil practice prevalent in rural areas even today, Vineeta also took oath as sarpanch in the name of Anita in a veil.”
According to the petition, Anita, who has been living in Jhalawar district of Rajasthan for more than 10 years, is unable to read and write and after receiving the news of alleged electoral fraud in her name, she complained to the district administration of Rajgarh, but no response from the administration. The petition also said that Anita, who was officially declared victorious in the elections to the post of Sarpanch, actually belongs to the Ruhela community, which is included in the Other Backward Classes (OBC), while the post of Sarpanch in the elections to the Bhilkheda Gram Panchayat belongs to the Scheduled Tribes (ST). was reserved for women.
