बिलासपुर | [कोर्ट बुलेटिन] | छत्तीसगढ़ हाईकोर्ट में एक युवती ने गर्भपात (अबॉर्शन) की अनुमति मांगी है। अबॉर्शन के लिए हाईकोर्ट पहुंची पीड़िता ने न्यायालय से गुहार लगाई कि वह बिन ब्याही मां नहीं बनना चाहती। शादी का झांसा देकर एक युवक ने उसके साथ दुष्कर्म किया, जिसके चलते वह गर्भवती हो गई। युवक ने विश्वासघात किया और उसका साथ छोड़ दिया है। युवती महासमुंद जिले की निवासी है।
याचिका पर हाईकोर्ट के जस्टिस पी सेम कोशी की अदालत ने सीएमएचओ (मुख्य चिकित्सा एवं स्वास्थ्य अधिकारी) को विशेष डॉक्टरों की टीम बनाकर जांच कराने और मेडिकल रिपोर्ट सौंपने को कहा है।
हाईकोर्ट में दायर याचिका में युवती ने बताया कि बसना थाना क्षेत्र में रहने वाले एक युवक ने उसे पहले प्यार में फंसाया। उसने शादी करने का विश्वास दिलाया और दुष्कर्म करने लगा। युवक ने उसे धोखा दे दिया और शादी से मुकर गया।
युवक द्वारा छोड़े जाने से परेशान होकर युवती पुलिस के पास गई। पुलिस ने शिकायत पर 23 मई को आरोपी युवक के खिलाफ दुष्कर्म और एट्रोसिटी एक्ट के तहत अपराध दर्ज कर लिया। दुष्कर्म पीड़िता युवती गर्भपात कराने अस्पताल गई, लेकिन डॉक्टरों ने नियमों का हवाला देकर गर्भपात करने से इनकार कर दिया।
सीएमएचओ से हाईकोर्ट ने मांगी रिपोर्ट
हाईकोर्ट के जस्टिस पी सेम कोशी की अदालत में मामले की सुनवाई हुई। याचिकाकर्ता युवती के वकीलों ने कानूनी तर्कों के साथ हाईकोर्ट के पुराने आदेश का हवाला भी दिया। युवती का पक्ष सुनने के बाद कोर्ट ने कहा कि गर्भपात के पहले गर्भ की डॉक्टर जांच करेंगे।
न्यायालय ने युवती को 30 जून को महासमुंद के मुख्य चिकित्सा एवं स्वास्थ्य अधिकारी के पास जाने का आदेश दिया है। साथ ही मुख्य चिकित्सा अधिकारी को आदेश दिया है कि विशेषज्ञ डॉक्टरों की टीम बनाकर युवती के गर्भ की जांच कराएं और 4 जुलाई को रिपोर्ट हाईकोर्ट में प्रस्तुत करें।
Does not want to become an unmarried mother, petition of rape victim seeking permission for abortion

The victim, who reached the High Court for abortion, pleaded with the court that she does not want to become an unmarried mother. A young man raped her on the pretext of marriage, due to which she became pregnant. The young man betrayed and left her side. The girl is a resident of Mahasamund district.
On the petition, the court of Justice P Sem Koshi of the High Court has asked the CMHO (Chief Medical and Health Officer) to conduct an investigation by forming a team of special doctors and submit the medical report.
In the petition filed in the High Court, the girl told that a young man living in Basna police station area first implicated her in love. He promised to marry her and started raping her. The young man cheated on her and reneged on the marriage.
Disturbed by the young man’s abandonment, the girl went to the police. On 23 May, the police registered an offense under the Rape and Atrocity Act against the accused youth on the complaint. The rape victim girl went to the hospital to get an abortion, but the doctors refused to do the abortion citing the rules.
High Court sought report from CMHO
The matter was heard in the court of Justice P Sem Koshi of the High Court. The lawyers of the petitioner girl also cited the old order of the High Court along with legal arguments. After hearing the girl’s side, the court said that the doctor will examine the pregnancy before the abortion.
The court has ordered the girl to go to the Chief Medical and Health Officer of Mahasamund on June 30. Along with this, the Chief Medical Officer has been ordered to make a team of specialist doctors and get the pregnancy of the girl examined and submit the report to the High Court on July 4.
