नई दिल्ली | [कोर्ट बुलेटिन] | पेंशन से जुड़े एक मामले में सुप्रीम कोर्ट ने हिमाचल हाईकोर्ट का फैसला रद्द कर दिया है। चतुर्थ श्रेणी कर्मचारियों को 8 वर्ष सेवाकाल पर भी अब पेंशन मिलेगी। नियमित सेवा में दिहाड़ी का 20 फीसदी कार्यकाल जुड़ेगा। हिमाचल हाईकोर्ट ने सर्वोच्च न्यायालय के निर्णय का गलत व्याख्यान किया था। मामला सुप्रीम कोर्ट पहुंचने पर इसे रद्द कर दिया है। सुप्रीम कोर्ट ने इस फैसले को रद्द करते हुए प्रार्थी बालों देवी को उसके पति की ओर से सरकार को दी गई सेवाओं की एवज में पेंशन देने का आदेश जारी किया।

 

पेंशन का बकाया 8 सप्ताह के भीतर देने के आदेश भी जारी किए गए हैं। सुप्रीम कोर्ट ने सुंदर सिंह नामक मामले में पारित फैसले की व्याख्या करते हुए स्पष्ट किया कि नियमित सेवा के साथ अगर दिहाड़ीदार सेवा का 20 फीसदी सेवाकाल जोड़कर 8 वर्ष भी पूरे होते हैं तो भी सरकारी कर्मी पेंशन का हक रखेगा। इसे न्यूनतम पेंशन के लिए 10 साल के बराबर मान लिया जाएगा।

 

सुप्रीम कोर्ट के इस फैसले को लेकर हाईकोर्ट की एकल पीठ व खंडपीठों के फैसलों में विरोधाभास उत्पन्न हो गया था। इस कारण मामले को 3 जजों की पीठ के समक्ष सुनवाई के लिए रखा गया। एकल पीठ व एक खंडपीठ का यह मत था कि अगर नियमित सेवा के साथ दिहाड़ीदार सेवा का लाभ देते हुए 8 वर्ष की सेवा का कार्यकाल पूरा हो जाता है तो उस स्थिति में सरकारी कर्मी पेंशन का हक रखेगा।

 

सुंदर सिंह के फैसले में 8 साल की सेवा को 10 वर्ष आंकने का भी जिक्र किया है, जबकि अन्य खंडपीठ का यह मत था कि नियमित सेवा के साथ दिहाड़ीदार सेवा का लाभ देते हुए अगर 10 वर्ष की सेवा का कार्यकाल पूरा होता है, तभी सरकारी कर्मी नियमित पेंशन लेने का हक रखेगा। हाईकोर्ट के तीन जजों की पीठ के फैसले को सुप्रीम कोर्ट के समक्ष चुनौती दी थी।

प्रार्थी का पति सिंचाई एवं जन स्वास्थ्य विभाग में चतुर्थ श्रेणी दिहाड़ीदार कार्यरत था। 10 साल के बाद एक जनवरी 2000 से उसे नियमित किया गया था। 6 साल 2 महीने की नियमित सेवा पूरी करने के बाद वह सेवानिवृत्त हो गया। 6 साल 2 महीने की नियमित सेवा के चलते उसे विभाग ने पेंशन देने से मना कर दिया।

Orders have also been issued to clear the arrears of pension within 8 weeks. The Supreme Court, while interpreting the decision passed in the Sundar Singh case, clarified that even if the daily wage earner completes eight years of service by adding 20 percent of the service to the regular service, then the government employee will be entitled to pension. This will be taken as equal to 10 years for the minimum pension.

 

There was a contradiction between the decisions of the single bench and division benches of the High Court regarding this decision of the Supreme Court. Due to this the matter was put up for hearing before a bench of 3 judges. The single bench and a division bench were of the view that if the tenure of 8 years of service is completed by giving the benefit of daily wage service with regular service, then in that case the government employee will be entitled to pension.

 

In Sundar Singh’s decision, 8 years of service has also been referred to as 10 years, while the other bench was of the opinion that giving the benefit of daily wager service along with regular service, if the tenure of 10 years of service is completed, then only the government The employee will be entitled to get regular pension. The decision of a three-judge bench of the High Court was challenged before the Supreme Court.

The husband of the applicant was working as a fourth class daily wage earner in the Department of Irrigation and Public Health. After 10 years, he was regularized from January 1, 2000. He retired after completing 6 years 2 months regular service. Due to regular service of 6 years 2 months, the department refused to give him pension.
