नई दिल्ली | [कोर्ट बुलेटिन] | केंद्र बनाम दिल्ली सरकार की लड़ाई एक बार फिर सुप्रीम कोर्ट पहुंच चुकी है। केंद्र और राष्ट्रीय राजधानी क्षेत्र की सरकार के बीच दिल्ली में प्रशासनिक सेवाओं के नियंत्रण के विवाद से जुड़े मामले पर सुनवाई के लिए 5 न्यायाधीशों की एक संविधान पीठ का गठन करने के लिए उच्चतम न्यायालय मंगलवार को सहमत हो गया। केंद्र सरकार और दिल्ली सरकार के बीच इस बात को लेकर विवाद है कि राष्ट्रीय राजधानी में प्रशासनिक सेवाएं किसके नियंत्रण में रहेंगी।
प्रधान न्यायाधीश एन.वी. रमण, न्यायमूर्ति कृष्ण मुरारी और न्यायमूर्ति हिमा कोहली की एक पीठ आप (आम आदमी पार्टी) की ओर से पेश हुए वरिष्ठ अधिवक्ता ए.एम. सिंघवी के मामले पर तत्काल सुनवाई के अनुरोध पर भी सहमत हुई। सिंघवी ने कहा, ” यह बेहद महत्वपूर्ण मामला है। कृपया इसे सूचीबद्ध करें।” इस पर प्रधान न्यायाधीश ने कहा, ” हम करेंगे।”
सर्वोच्च न्यायालय ने केंद्र और दिल्ली के बीच राष्ट्रीय राजधानी क्षेत्र में प्रशासनिक सेवाओं के नियंत्रण के विवाद से जुड़ा मामला 6 मई को ‘आधिकारिक फैसले’ के लिए पांच न्यायाधीशों की एक संविधान पीठ को स्थानांतरित कर दिया था। इससे पहले शीर्ष अदालत ने मामले को 5 सदस्यीय पीठ के पास भेजने के संबंध में 28 अप्रैल को अपना फैसला सुरक्षित रख लिया था।
यह याचिका 14 फरवरी 2019 के उस विभाजित फैसले को ध्यान में रखते हुए दायर की गई है, जिसमें न्यायमूर्ति ए. के. सीकरी और न्यायमूर्ति अशोक भूषण की दो सदस्यीय पीठ ने भारत के तत्कालीन प्रधान न्यायाधीश को उनके विभाजित फैसले के मद्देनजर राष्ट्रीय राजधानी में सेवाओं के नियंत्रण के मुद्दे पर अंतिम फैसला लेने के लिए तीन सदस्यीय पीठ का गठन करने की सिफारिश की थी।
दोनों न्यायाधीश अब सेवानिवृत्त हो गए हैं। न्यायमूर्ति भूषण ने तब कहा था कि दिल्ली सरकार के पास प्रशासनिक सेवाओं पर कोई अधिकार नहीं हैं। हालांकि, न्यायमूर्ति सीकरी की राय उनसे अलग थी।

Chief Justice N.V. Raman, a bench of Justice Krishna Murari and Justice Hima Kohli, appearing for AAP (Aam Aadmi Party), senior advocate A.M. It also agreed to the request for an urgent hearing on Singhvi’s case. Singhvi said, “This is a very important matter. Please list it.” To this the Chief Justice said, “We will.”
The Supreme Court had on May 6 transferred a five-judge Constitution Bench for “official decision” the matter relating to the dispute over control of administrative services in the National Capital Territory between the Center and Delhi. Earlier, on April 28, the apex court had reserved its order regarding sending the matter to a 5-member bench.
This petition has been filed keeping in view the divided judgment of 14 February 2019 in which Justice A.K. Of. Sikri and Justice Ashok Bhushan had recommended setting up of a three-judge bench to the then Chief Justice of India to take a final call on the issue of control of services in the national capital in view of their split verdict.
Both the judges are now retired. Justice Bhushan had then said that the Delhi government had no authority over the administrative services. However, Justice Sikri’s opinion differed from his.
