वाराणसी | [कोर्ट बुलेटिन] | ज्ञानवापी मस्जिद- श्रृंगार गौरी प्रकरण की मेरिट पर मुस्लिम पक्ष की तरफ से मंगलवार को दलीलें पूरी हो गईं। इसके बाद हिन्दू पक्ष की ओर से भी दलील पेश की गई। हाई कोर्ट ने अगली सुनवाई के लिए कल यानी 13 जुलाई की तारीख लगा दी है। जिला जज डॉ. अजय कृष्ण विश्वेश की अदालत में दोपहर 2 बजे से सुनवाई शुरू हुई। पहले मुस्लिम पक्ष ने अपनी दलील जारी रखी। इसके बाद हिन्दू पक्ष की ओर से अधिवक्ता ने दलीलें रखीं। सुनवाई के दौरान कोर्ट के बाहर और अंदर सख्त सुरक्षा व्यवस्था रखी गई। 60 लोगों को कोर्ट में प्रवेश की अनुमति मिली।

 

गौरतलब है कि इस केस में वादी पक्ष ने श्रृंगार गौरी समेत ज्ञानवापी परिसर में स्थित विग्रहों की पूजा का अधिकार मांगा है। सुप्रीम कोर्ट के आदेश पर जिला जज की अदालत में हो रही सुनवाई में सबसे पहले सिविल प्रक्रिया संहिता आदेश 7 नियम 11 पर मुस्लिम पक्ष को दलील पेश करने का मौका मिला है।

 

इसमें तय होना है कि हिन्दू पक्ष की ओर से दायर मामला सुनवाई योग्य है या नहीं। पिछली 3 सुनवाई से दलील देने के बाद मंगलवार को मुस्लिम पक्ष ने मामले पर कानूनी नजीरें पेश कीं। इससे पहले 30 मई और 4 जुलाई को मुस्लिम पक्ष ने अपनी दलीलें पेश की थीं।

 

अभी तक क्या-क्या हुआ

 

सुप्रीम कोर्ट से निर्देश मिलने के बाद जिला जज ने दोनों पक्षों को सुनने के बाद पहले केस की मेरिट पर सुनवाई का आदेश दिया था। 26 मई की सुनवाई में मुस्लिम पक्ष अंजुमन इंतजामिया मसाजिद के वकील अभयनाथ यादव ने वादी महिलाओं की ओर से दाखिल दावे को विरोधाभासी बताते हुए करीब 12 बिंदुओं पर दलील दी थी।

 

30 मई को प्रतिवादी अधिवक्ता अभयनाथ यादव ने 1937 के दीन मुहम्मद केस का जिक्र करते हुए वाद खारिज करने का तर्क दिया। मूल वाद को खारिज करने के लिए 26 बिंदुओं पर दलीलें पेश की गईं। जिला जज ने बहस जारी रखते हुए सुनवाई की अगली तारीख 4 जुलाई तय कर दी थी। 4 जुलाई को भी मुस्लिम पक्ष की ओर से दलीलें जारी रखी गईं और मामला 12 जुलाई के लिए टाल दिया गया था।

 

 

Muslim side’s debate on merit of Gyanvapi case completed, adjourned till tomorrow hearing

 

 

Varanasi | [Court Bulletin] | On the merit of the Gyanvapi Masjid-Sringar Gauri episode, the arguments on behalf of the Muslim side were completed on Tuesday. After this, arguments were also presented on behalf of the Hindu side. The High Court has fixed the date of tomorrow i.e. July 13 for the next hearing. The hearing began at 2 pm in the court of District Judge Dr. Ajay Krishna Vishwesh. First the Muslim side continued its argument. After this, the advocate argued on behalf of the Hindu side. During the hearing, strict security arrangements were kept inside and outside the court. 60 people were allowed to enter the court.

 

It is worth mentioning that in this case, the plaintiff has sought the right to worship the Deities located in the Gyanvapi complex including Shringar Gauri. In the hearing being held in the court of the District Judge on the order of the Supreme Court, first of all, the Muslim side has got an opportunity to present an argument on the Code of Civil Procedure Order 7 Rule 11.

 

It has to be decided whether the case filed by the Hindu side is maintainable or not. After giving arguments from the last 3 hearings, on Tuesday, the Muslim side presented legal precedents on the matter. Earlier on May 30 and July 4, the Muslim side presented its arguments.

After getting directions from the Supreme Court, the District Judge, after hearing both the sides, ordered a hearing on the merits of the first case. In the hearing of 26 May, Abhaynath Yadav, counsel for Muslim side Anjuman Inazaniya Masajid, argued on about 12 points, calling the claim filed by the plaintiff women contradictory.

 

On May 30, the respondent advocate Abhaynath Yadav argued for dismissal of the suit referring to the Din Muhammad case of 1937. Arguments were presented on 26 points to dismiss the original contention. Continuing the arguments, the district judge fixed July 4 as the next date of hearing. On July 4 also, arguments were continued on behalf of the Muslim side and the matter was adjourned for July 12.
