जबलपुर | [कोर्ट बुलेटिन] | मध्य प्रदेश के जबलपुर संभाग कमिश्नर बी चंद्रशेखर ने ब्रिटिश कालीन व्यवस्था को बदलकर नई नजीर पेश की है। जबलपुर संभाग कमिश्नर बी चंद्रशेखर ने अपनी कोर्ट में सुनवाई के दौरान पक्षकार और अधिकारी दोनों को बराबरी से बैठने की व्यवस्था की है। मध्य प्रदेश सहित देशभर में इस प्रकार की यह पहली व्यवस्था है जिसे कमिश्नर ने बदल दिया है।
दरअसल अभी तक न्यायालयों में पीठासीन अधिकारी एक उच्च स्थान पर बैठता था और वकील या पक्षकार निचले स्थान पर बैठकर या खड़े होकर पैरवी करने थे। हालांकि यह प्रावधान किसी क़ानून में नहीं था लेकिन ब्रिटिशकालीन यह व्यवस्था सालों से चली आ रही थी।
इस ब्रिटिशकालीन साम्राज्यवादी व्यवस्था को जबलपुर कमिश्नर ने अपने कार्यालय से ख़त्म कर दिया है। कमिश्नर ने अपने न्यायालय के सभी उच्च स्थान को हटाकर पीठासीन अधिकारी, वकील और पक्षकारों के लिए एक समान बैठने की व्यवस्था की है।
वकीलों और पक्षकारों को होती थी परेशानी
जबलपुर कमिश्नर बी चंद्रशेखर द्वारा ब्रिटिश कालीन चली आ रही व्यवस्था में किये गए परिवर्तन को क्रांतिकारी माना जा रहा है। सिविल न्यायालय हो, दाण्डिक न्यायालय हो या राजस्व न्यायालय हो, सभी न्यायालयों में पीठासीन अधिकारी एक उच्च स्थान पर बैठते हैं और पक्षकार, वकील, आदि निचले स्तर पर बैठते हैं। साथ ही पक्षकारों को एवं वकीलों को खड़े रहकर ही अपनी बात रखनी होती है।
कभी-कभी साक्ष्यों के परीक्षण, प्रतिपरीक्षण या बहस के दौरान वकीलों को घंटों खड़े रहना पड़ता है। विशेषकर बुजुर्ग पक्षकार एवं वकीलों के लिए यह काफी कठिन होता है। इन सबके बीच जबलपुर कमिश्नर का फैसला काफी महत्वपूर्ण माना जा रहा है।

This British imperial system has been abolished by the Jabalpur Commissioner from his office. The commissioner has made a common seating arrangement for the presiding officer, lawyer and the parties by removing all the high places of his court.
Lawyers and litigants had trouble
The change made by Jabalpur commissioner B Chandrashekhar in the British rule is being considered revolutionary. Be it a civil court, a criminal court or a revenue court, in all courts the presiding officers sit at a higher position and the parties, lawyers, etc., sit at a lower level. Along with this, the parties and the lawyers have to stand and make their point.
Sometimes lawyers have to stand for hours during the trial, cross-examination or argument of evidence. It is especially difficult for the elderly parties and lawyers. In the midst of all this, the decision of the Jabalpur commissioner is considered very important.
