जोधपुर | [कोर्ट बुलेटिन] | राजस्थान हाईकोर्ट से नाबालिग छात्रा के यौन उत्पीड़न मामले में आजीवन कारावास की सजा काट रहे आसाराम बापू को झटका लगा है। राजस्थान हाईकोर्ट ने 9 साल और 7 महीने से जेल में बंद आसाराम की तरफ से पेश सजा स्थगन याचिका को खारिज कर दिया है। आसाराम की अब तक 3 बार सजा स्थगन याचिका खारिज की जा चुकी है। इसके अलावा आसाराम करीब 15 बार जमानत याचिका भी दायर कर चुका है, लेकिन उसे जमानत नहीं दी गई।
न्यायाधीश संदीप मेहता और न्यायाधीश विनीत कुमार माथुर की खंडपीठ के समक्ष सीनियर एडवोकेट देवदत्त कामत ने कहा, आसाराम 9 साल और 7 महीने से जेल में बंद है। 83 साल के आसाराम को कई बीमारियां भी हैं। जिन आरोपों के आधार पर उसे उम्र कैद की सजा दी गई है वह सही नहीं हैं। ऐसे में आसाराम को राहत मिलनी चाहिए।
इस जवाब में सरकारी वकील अतिरिक्त महाधिवक्ता अनिल जोशी ने कहा, इस मामले में आसाराम के वकील कई सुनवाई में नहीं आए। इस कारण सुनवाई भी स्थगित करनी पड़ी। अपीलार्थी का यह देरी स्वीकार्य नहीं है। हाईकोर्ट अगर आसाराम को राहत देती है तो उसे कोई लाभ नहीं होने वाला। जेल से बाहर निकलते ही गुजरात पुलिस उसे गिरफ्तार कर लेगी। वहां उसके खिलाफ दर्ज दुष्कर्म केस में ट्रायल चल रहा है।
दोनों पक्षों की दलीलें सुनने के बाद खंडपीठ ने कहा, पिछले सुनवाई में हमने गुजरात में चल रहे केस की रिपोर्ट मांगी थी। जिसमें बताया गया है कि ट्रायल कोर्ट में गवाहों के बयान चल रहे है। हमें नहीं लगता कि आसाराम जमानत का हकदार है। ऐसे में उसकी सजा स्थगन याचिका खारिज की जाती है।
जानें क्या है मामला?
आसाराम के गुरुकुल में पढ़ने वाली एक नाबालिग छात्रा ने उस पर दुष्कर्म का आरोप लगाया था। छात्रा ने कहा था कि 15 अगस्त 2013 को आसाराम ने जोधपुर के निकट मणाई गांव के एक फार्म हाउस में उसका यौन उत्पीड़न किया। 20 अगस्त 2013 को पीड़िता ने दिल्ली के कमला नगर पुलिस थाने में आसाराम के खिलाफ केस दर्ज कराया। दिल्ली पुलिस ने प्राथमिकी दर्ज कर केस की जांच जोधपुर पुलिस को दे दी। 31 अगस्त 2013 को पुलिस ने मप्र के इंदौर से आसाराम को गिरफ्तार किया और जोधपुर लेकर आई। अप्रैल 2018 में कोर्ट ने उसे दोषी मानते हुए उम्रकैद की सजा सुना दी थी।
Adjournment petition dismissed; Asaram will remain in jail, has applied so many times

The Rajasthan High Court has dismissed the adjournment plea filed by Asaram, who has been in jail for 9 years and 7 months. Asaram’s adjournment plea has been rejected thrice so far. Apart from this, Asaram has also filed bail petition about 15 times, but he was not granted bail.
Senior advocate Devdutt Kamat said before a division bench of Justice Sandeep Mehta and Justice Vineet Kumar Mathur, Asaram is in jail for 9 years and 7 months. Asaram, 83, also has many diseases. The allegations on the basis of which he was sentenced to life imprisonment are not correct. In such a situation, Asaram should get relief.
In response to this, Public Prosecutor Additional Advocate General Anil Joshi said, “Asaram’s counsel did not appear in many hearings in this matter. Due to this the hearing also had to be adjourned. This delay of the appellant is not acceptable. If the High Court gives relief to Asaram, then it will not be of any benefit to him. The Gujarat Police will arrest him as soon as he comes out of jail. Trial is going on in the rape case registered against him there.
After hearing the arguments of both the sides, the bench said, “In the last hearing, we had sought the report of the ongoing case in Gujarat. In which it has been told that the statements of the witnesses are going on in the trial court. We don’t think Asaram deserves bail. As such, his adjournment petition is dismissed.
Know what is the matter?
A minor student studying in Asaram’s Gurukul had accused him of rape. The student had said that on August 15, 2013, Asaram sexually assaulted her at a farm house in Manai village near Jodhpur. On 20 August 2013, the victim filed a case against Asaram at the Kamla Nagar police station in Delhi. Delhi Police registered an FIR and handed over the investigation of the case to Jodhpur Police. On 31 August 2013, the police arrested Asaram from Indore in MP and brought him to Jodhpur. In April 2018, the court convicted him and sentenced him to life imprisonment.
