लॉ स्टूडेंट ने दाखिल की है याचिका
दरअसल, सोमवार को मुख्य न्यायाधीश दीपांकर दत्ता और न्यायमूर्ति एम एस कार्णिक की खंडपीठ लॉ की छात्रा निकिता गोर और वैष्णवी घोलवे द्वारा दायर एक याचिका पर सुनवाई कर रही थी। इस याचिका में प्रभावी मासिक धर्म स्वच्छता प्रबंधन को लागू करने में केंद्र और राज्य सरकारों की विफलता पर चिंता व्यक्त की गई थी। इसके चलते महिलाओं और विशेष रूप से किशोर लड़कियों को परेशानी हो रही थी।
16 शहरों के स्कूलों में किया था सर्वेक्षण
इस याचिका में सरकारी स्कूलों में लड़कियों के लिए गंदे और अस्वच्छ शौचालयों और शौचालयों के मुद्दे के बारे में भी कहा गया है। लॉ की छात्रा निकिता गोर ने इस मुद्दे को लेकर महाराष्ट्र के सात जिलों के 16 शहरों के स्कूलों में एक सर्वेक्षण किया था। उसके बाद मिले निष्कर्षों के आधार पर निकिता ने हाईकोर्ट का दरवाजा खटखटाया।
अतिरिक्त सरकारी वकील भूपेश सामंत ने सोमवार को पीठ को बताया कि ऐसे 7 स्कूलों के खिलाफ कार्रवाई की गई है। उन्होंने कार्रवाई के संबंध में अदालत को दस्तावेज भी सौंपा। दस्तावेज देखने के बाद अदालत ने पिन किया कि दस्तावेज एक दिन पहले यानी 24 जुलाई, 2022 की थी।
अदालत ने लगाई फटकार
जिसके बाद फटकार लगाते हुए मुख्य न्यायाधीश दत्ता ने कहा कि कार्यपालिका हमारे बारे में क्या सोचती है? क्या हम छोटे बच्चों की तरह हैं जिन्हें आप लॉलीपॉप दे सकते हैं और हम शांत हो जाएंगे? पीठ ने आगे कहा कि जब कार्रवाई की जाती है, तब तो एक महीने के लिए शौचालयों का रखरखाव किया जाएगा, लेकिन बाद में चीजें पहले की तरह हो जाएंगी।
इसके बाद अदालत ने एमडीएलएसए (महाराष्ट्र जिला कानूनी सेवा प्राधिकरण) को ऐसे स्कूलों की निगरानी और औचक निरीक्षण करने का निर्देश दिया है। पीठ ने कहा कि हम सभी डीएलएसए को निर्देश देते हैं कि वे प्राचार्य सीट के भीतर आने वाले प्रत्येक जिले के 15 ऐसे स्कूलों का औचक निरीक्षण करें और अपनी रिपोर्ट हमारे सामने रखें। पीठ ने याचिका पर अगली सुनवाई के लिए 15 अगस्त की तारीख दी है।

Survey was done in schools of 16 cities
The petition also talked about the issue of dirty and unhygienic toilets and toilets for girls in government schools. Nikita Gor, a law student, conducted a survey on this issue in schools in 16 cities across seven districts of Maharashtra. After that, on the basis of the findings, Nikita approached the High Court.
Additional public prosecutor Bhupesh Samant told the bench on Monday that action has been taken against seven such schools. He also handed over documents to the court regarding the action. After perusing the document, the court pinned that the document was dated a day earlier i.e. July 24, 2022.

Following this, the court has directed the MDLSA (Maharashtra District Legal Services Authority) to conduct surveillance and surprise inspections of such schools. The bench said that we direct all DLSAs to conduct surprise inspection of 15 such schools in each district falling within the principal seat and place their report before us. The bench has fixed August 15 for next hearing on the petition.
