प्रयागराज | [कोर्ट बुलेटिन] | पति-बच्चों को छोड़ किसी और के साथ रह रही एक शादीशुदा महिला की याचिका पर सुनवाई के बाद लिव इन रिलेशनशिप में रहने के कारण संरक्षण देने से इलाहाबाद हाईकोर्ट ने इनकार कर दिया। इलाहाबाद हाईकोर्ट ने कहा कि देश संविधान से चलता है। लिव इन की इजाजत है लेकिन लिव इन को भारतीय समाज स्वीकार नहीं करता। कोर्ट ने कहा कि यह याचिका अवैध संबंधों पर हाईकोर्ट की मुहर लगवाने के अलावा कुछ नहीं है। कोर्ट ने कहा कि देश संविधान से चलता है। कोर्ट अवैधानिकता की अनुमति नहीं दे सकती।
यह आदेश न्यायमूर्ति डॉ. केजे ठाकर और न्यायमूर्ति अजय त्यागी की खंडपीठ ने सुनीता देवी की याचिका पर दिया है। कोर्ट ने कहा कि यह याचिका अवैध संबंधों पर हाईकोर्ट की मुहर लगवाने के अलावा कुछ नहीं है। कोर्ट ने कहा कि देश संविधान से चलता है। लिव इन की अनुमति है लेकिन याचियों के बारे में नहीं कहा जा सकता कि वे पति-पत्नी हैं।
वे सामाजिक नैतिकता के विपरीत लिव इन रिलेशनशिप में रह रहे हैं। हालांकि कोर्ट समान लिंग के लोगों के साथ रहने के अधिकार पर विचार करती है। लिव इन को भारतीय समाज स्वीकार नहीं करता। कोर्ट अवैधानिकता की अनुमति नहीं दे सकती।
मामले के तथ्यों के अनुसार याची ने पति का घर छोड़ दिया। उसके बच्चे भी हैं। उसका आरोप है कि पति अपने दोस्तों से संबंध बनाने को कहता है। इसलिए वह दूसरे के साथ रह रही है। उसने पुलिस व पति पर परेशान करने व धमकाने का आरोप लगाया लेकिन पुलिस से शिकायत दर्ज नहीं कराई। कोर्ट ने कहा कि वह नियमानुसार पुलिस से शिकायत कर सकती है।

That’s why she is living with another. She accused the police and husband of harassing and threatening her but did not lodge a complaint with the police. The court said that she can file a complaint with the police as per the rules.
