नैनीताल | [कोर्ट बुलेटिन] | यूथ बार एसोसिएशन ऑफ इंडिया ने मुस्लिम पर्सनल लॉ में 18 वर्ष से कम उम्र की लड़कियों की शादी की अनुमति को गैर कानूनी घोषित करने को लेकर हाईकोर्ट में याचिका दायर की है। मुख्य न्यायाधीश विपिन सांघी एवं न्यायमूर्ति आरसी खुल्बे की खंडपीठ ने मामले में केंद्र और राज्य सरकार से जवाब दाखिल करने को कहा है।
याचिका में कहा गया है कि 18 वर्ष से कम उम्र में शादी के बावजूद नवविवाहितों को पुलिस सुरक्षा दी जा रही है, क्योंकि मुस्लिम पर्सनल लॉ ऐसे विवाह की अनुमति देता है।
याचिका में कहा गया है कि, नाबालिग की शादी को मान्यता, पॉक्सो कानून का भी उल्लंघन है।
याचिका में लड़कियों की उम्र 18 से बढ़ाकर 21 करने वाले विधेयक को पास किए जाने तक ऐसी शादियों को अमान्य घोषित करने की मांग की गई है।
Marriage of minor Muslim girls declared invalid, petition filed by Youth Bar Association of India
Nainital | [Court Bulletin] | The Youth Bar Association of India has filed a petition in the High Court to declare the marriage of girls below the age of 18 years illegal under the Muslim Personal Law. A division bench of Chief Justice Vipin Sanghi and Justice RC Khulbe has asked the central and state governments to file their replies in the matter.
The petition states that police protection is being given to newlyweds even if they are married under the age of 18, as Muslim personal law permits such marriages.
It has been said in the petition that recognition of the marriage of a minor is also a violation of the POCSO Act.
The petition has sought to declare such marriages void till the passage of a bill raising the age of girls from 18 to 21.
