नई दिल्ली | [कोर्ट बुलेटिन] | जैविक पिता की मृत्यु के बाद दूसरी शादी करने वाली मां बच्चे का उपनाम तय कर सकती है। कोर्ट ने यह भी कहा कि महिला बच्चे को अपने नए परिवार में शामिल भी कर सकती है। सुप्रीम कोर्ट जस्टिस दिनेश माहेश्वरी और जस्टिस कृष्ण मुरारी की पीठ ने गुरुवार को एक अहम फैसला सुनाते हुए आंध्र प्रदेश हाईकोर्ट के फैसले को दरकिनार करते हुए यह फैसला सुनाया।

 

इससे पहले हाईकोर्ट ने एक मां को बच्चे का उपनाम बदलने और अपने नए पति का नाम केवल सौतेले पिता के रूप में रिकॉर्ड में दिखाने का निर्देश दिया था। सुप्रीम कोर्ट ने कहा कि इस तरह का निर्देश एक मायने में क्रूर और नासमझी वाला है।

 

यह बच्चे के मानसिक स्वास्थ्य और आत्मसम्मान को प्रभावित करता है। यह अपील पति की मृत्यु के बाद दूसरी शादी करने वाली मां द्वारा बच्चे को दिए जाने वाले उपनाम को लेकर विवाद से संबंधित थी।

 

बच्चे के उपनाम को बहाल करने के लिए मां ने आंध्र प्रदेश हाईकोर्ट द्वारा जारी निर्देश को सुप्रीम कोर्ट में चुनौती दी थी। हाईकोर्ट ने कहा था कि जहां तक बच्चे के पिता के नाम का संबंध है, जहां कहीं भी रिकॉर्ड की अनुमति हो, प्राकृतिक पिता का नाम दिखाया जाएगा और ऐसी अनुमति नहीं हो तो मां के नए पति के नाम का सौतेले पिता के रूप में उल्लेख किया जा सकता है।

The mother had challenged in the Supreme Court the direction issued by the Andhra Pradesh High Court to restore the child’s surname. The High Court had held that so far as the name of the father of the child is concerned, wherever the record permits, the name of the natural father shall be shown and if such permission is not allowed, the name of the mother’s new husband shall be mentioned as that of the stepfather. can go.
