शिमला | [कोर्ट बुलेटिन] | हिमाचल प्रदेश के उच्च न्यायालय ने राजनैतिक पार्टियों को शिमला नागरिक निकाय के अधिकार क्षेत्र की सीमा के भीतर विज्ञापन और होर्डिंग लगाने के संबंध में दिशानिर्देशों का पालन करने का आदेश बुधवार को दिया। हिमाचल प्रदेश के उच्च न्यायालय का यह आदेश प्रधानमंत्री नरेंद्र मोदी की शिमला में रैली के एक दिन बाद आया है। प्रधानमंत्री मोदी की रैली के दौरान शिमला का माल रोड और रिज मैदान होर्डिंग्स, पोस्टर, झंडे और बैनर से पटा हुआ था।
न्यायमूर्ति तरलोक सिंह चौहान और न्यायमूर्ति चंद्र भूषण बरोवालिया की खंडपीठ ने अनिल कुमार नाम के एक व्यक्ति द्वारा दायर याचिका पर ये आदेश पारित किए। याचिकाकर्ता ने आरोप लगाया कि (प्रतिवादियों) राज्य के मुख्य सचिव, और एमसी शिमला के उपायुक्त ने राजनीतिक दलों को 2007 के नियम 9 का पूर्ण उल्लंघन करने दिया और उनके होर्डिंग लगाने की अनुमति दी, जबकि यह नियम शहर के विरासत क्षेत्र में विज्ञापनों की अनुमति नहीं देता है।
नगर निगम शिमला के नियम 9 के मुताबिक राष्ट्रपति भवन से लेकर छोटा शिमला व माल रोड क्षेत्र में किसी भी तरह के होर्डिंग्स लगाने की मनाही है। इसी तरह से रिज मैदान पर विज्ञापन होर्डिंग लगाने पर पूर्ण प्रतिबंध है।
याचिकाकर्ता ने उच्च न्यायालय के आदेशों का जानबूझकर उल्लंघन करने के लिए एमसी शिमला और भारतीय जनता पार्टी के खिलाफ अवमानना की कार्यवाही शुरू करने की भी प्रार्थना की है।
याचिका पर सुनवाई करते हुए हिमाचल हाईकोर्ट ने कोर्ट में उपस्थित एसपी शिमला और आयुक्त को आदेश दिए कि वे शिमला शहर से विज्ञापन और होर्डिंग्स तुरंत हटाएं और इसकी अनुपालना रिपोर्ट 16 जून तक शपथ पत्र के माध्यम से अदालत को सोंपे।
सुनवाई के दौरान हाईकोर्ट ने एसपी शिमला को फटकार लगाई जिसके बाद पुलिस प्रशासन हरकत में आया और मामले को लेकर अज्ञात लोगों के खिलाफ तीन एफआईआर दर्ज की गई हैं।
साथ ही प्रतिवादियों को भी निर्देश दिया गया है कि वे हिमाचल प्रदेश खुले स्थान (विरूपण निवारण) अधिनियम, 1985 के तहत की गई कार्रवाई के पूर्ण विवरण के साथ अनुपालन हलफनामा/स्थिति रिपोर्ट दो सप्ताह के भीतर दाखिल करें। मामले को 15 जून 2022 के लिए सूचीबद्ध किया गया है।
High Court reprimanded after PM’s rally, ‘Parties should follow hoarding rules’
Shimla | [Court Bulletin] | The Himachal Pradesh High Court on Wednesday ordered political parties to adhere to guidelines with regard to putting up advertisements and hoardings within the limits of the Shimla civic body’s jurisdiction. The Himachal Pradesh High Court’s order comes a day after Prime Minister Narendra Modi’s rally in Shimla. Shimla’s Mall Road and Ridge Maidan were lined with hoardings, posters, flags and banners during Prime Minister Modi’s rally.
A division bench of Justice Tarlok Singh Chauhan and Justice Chandra Bhushan Barowalia passed these orders on a petition filed by a person named Anil Kumar. The petitioner alleged that (Respondents) the Chief Secretary of the State, and the Deputy Commissioner of MC Shimla allowed political parties to put up their hoardings in complete violation of Rule 9 of 2007, while this rule allowed advertisements in the heritage area of the city. does not give
According to Rule 9 of Municipal Corporation Shimla, hoardings of any kind are prohibited from Rashtrapati Bhavan to Chhota Shimla and Mall Road area. Similarly, there is a complete ban on advertising hoardings on the Ridge ground.
The petitioner has also prayed for initiation of contempt proceedings against MC Shimla and Bharatiya Janata Party for willfully violating the orders of the High Court.
Hearing the petition, the Himachal High Court ordered the SP Shimla and the commissioner present in the court to immediately remove the advertisements and hoardings from Shimla city and submit its compliance report to the court through affidavit by June 16.
During the hearing, the High Court reprimanded the SP Shimla, after which the police administration swung into action and three FIRs have been registered against unknown people regarding the matter.
Further, the respondents have also been directed to file compliance affidavit/status report with full details of action taken under Himachal Pradesh Open Space (Prevention of Deformation) Act, 1985 within two weeks. The matter has been listed for June 15, 2022.
