जस्टिस चंद्रधारी सिंह ने अपने फैसले में सीआरपीसी की धारा 160 के प्रावधानों का विस्तार से हवाला देते हुए कहा कि एफआईआर दर्ज किए बिना जांच शुरू होने की बात नहीं कही जा सकती।

 

उन्होंने कहा है कि जांच को कानूनी और वैध होने के लिए पुलिस अधिकारी को सीआरपीसी के प्रावधानों के अनुसार कार्य करना होगा। इतना ही नहीं, हाईकोर्ट ने कहा है कि पुलिस अधिकारी मजिस्ट्रेट को रिपोर्ट किए बिना प्रारंभिक जांच करके अपनी शक्तियों से बाहर जाकर कार्य नहीं कर सकता है।

 

अदालत ने कहा है कि सीआरपीसी की धारा 160 के तहत उस पुलिस अधिकारी की ओर से समन/नोटिस जारी किया जा सकता है, जो सीआरपीसी के प्रावधानों के तहत शिकायत की जांच कर रहा है, लेकिन इस तरह की जांच को गति देने के लिए पहले एफआईआर दर्ज करने की आवश्यकता है।

सभी तथ्यों पर गौर करने के बाद हाईकोर्ट ने कुलविंदर सिंह कोहली के खिलाफ 25 जनवरी, 25 फरवरी और 9 मार्च 2022 को सीआरपीसी की धारा 160 के तहत जारी समन को रद्द कर दिया है। दिल्ली हाईकोर्ट ने कुलविंदर सिंह की ओर से दाखिल याचिका पर यह आदेश दिया है। उन्होंने एसएएस नगर, मोहाली स्थित पंजाब पुलिस की साइबर सेल की ओर से जारी समन को चुनौती देते हुए इसे रद्द करने की मांग की थी।

He has said that for the investigation to be legal and valid, the police officer has to act as per the provisions of CrPC. Not only this, the High Court has said that a police officer cannot act beyond his powers by conducting a preliminary inquiry without reporting to the magistrate.

 

The court has held that summons/ notices under section 160 of CrPC can be issued on behalf of the police officer who is investigating the complaint under the provisions of CrPC, but before such investigation has been initiated. FIR needs to be registered.
