मुंबई | [कोर्ट बुलेटिन] | कांग्रेस सांसद राहुल गांधी को प्रधानमंत्री नरेंद्र मोदी के खिलाफ उनकी कथित टिप्पणी पर मानहानि की शिकायत में एक स्थानीय अदालत में पेश होने से दी गई राहत बॉम्बे हाईकोर्ट ने सोमवार को 28 जुलाई तक बढ़ा दी।
न्यायमूर्ति पीडी नाइक की एकल पीठ ने मुंबई की एक मजिस्ट्रेट अदालत को मानहानि की सुनवाई 28 जुलाई तक के लिए आगे टालने का निर्देश दिया।
पीएम मोदी को बताया था ‘कमांडर-इन-थीफ’
खुद के भाजपा कार्यकर्ता होने का दावा करने वाले शिकायतकर्ता महेश श्रीश्रीमल ने कहा था कि राहुल गांधी ने 2018 में राफेल लड़ाकू विमान सौदे को लेकर प्रधानमंत्री के खिलाफ ‘कमांडर-इन-थीफ’ टिप्पणी का इस्तेमाल किया था।
स्थानीय अदालत ने जारी किया समन तो हाईकोर्ट का रुख किया
स्थानीय अदालत ने पूर्व कांग्रेस अध्यक्ष को मानहानि शिकायत के संबंध में पिछले साल 25 नवंबर को पेश होने का समन जारी किया था। इसके बाद राहुल गांधी ने बॉम्बे हाईकोर्ट का दरवाजा खटखटाकर जारी समन को चुनौती दी थी।
हाईकोर्ट ने पिछले नवंबर में मजिस्ट्रेट को मानहानि शिकायत पर सुनवाई स्थगित करने का निर्देश दिया था। जिसका मतलब था कि कांग्रेस नेता को मजिस्ट्रेट के सामने पेश होने की आवश्यकता नहीं है।
28 जुलाई तक मामले पर सुनवाई टालने का निर्देश
न्यायमूर्ति पीडी नाइक की एक पीठ के समक्ष सोमवार को याचिका सुनवाई के लिए आई। हाईकोर्ट ने याचिका पर सुनवाई स्थगित कर दी और मजिस्ट्रेट की अदालत को सुनवाई 28 जुलाई तक आगे टालने का निर्देश दिया।
Relief from High Court to Rahul Gandhi in the remark case against PM Modi
Mumbai | [Court Bulletin] | The Bombay High Court on Monday extended till July 28 the relief granted to Congress MP Rahul Gandhi from appearing in a local court in a defamation complaint over his alleged remarks against Prime Minister Narendra Modi.
A single bench of Justice PD Naik directed a magistrate court in Mumbai to adjourn the defamation hearing till July 28.
Told PM Modi as ‘commander-in-thief’
Complainant Mahesh Srisrimal, who claims to be a BJP worker himself, had said that Rahul Gandhi had used the ‘commander-in-the-fief’ remark against the prime minister in 2018 over the Rafale fighter jet deal.
Local court issued summons then moved High Court
The local court had summoned the former Congress president to appear on November 25 last year in connection with the defamation complaint. After this, Rahul Gandhi challenged the summons issued by knocking on the door of the Bombay High Court.
The High Court had last November directed the magistrate to adjourn the hearing on the defamation complaint. Which meant that the Congress leader need not appear before the magistrate.
Instructions to postpone hearing on the matter till July 28
The petition came up for hearing on Monday before a bench of Justice PD Naik. The High Court adjourned the hearing on the petition and directed the magistrate’s court to adjourn the hearing till July 28.
