मुंबई | [कोर्ट बुलेटिन] | Salman Khan: बॉलीवुड अभिनेता सलमान खान (Salman Khan) उनके पनवेल फार्महाउस के पड़ोसी केतन कक्कड़ के खिलाफ बॉम्बे हाई कोर्ट पहुंच गए हैं। सलमान खान का कहना है कि केतन द्वारा उनके बारे में शेयर किया गया वीडियो न सिर्फ मानहानिकारक है बल्कि साम्द्रायिक रूप से भड़काने वाला भी है।
सलमान के वकील ने बताया है कि वीडियो में केतन ने सलमान खान की तुलना बाबर और औरंगजेब से की है। बता दें कि सलमान खान ने सेशन कोर्ट के मार्च 2022 के आदेश को चुनौती देते हुए यह अपील दायर की है।
क्या है पूरा मामला
न्यायमूर्ति सी. वी.भडांग की एकल पीठ खान की एक अपील पर सुनवाई कर रही है। बता दें कि सलमान ने एक दीवानी अदालत के मार्च 2022 के आदेश को चुनौती देते हुए यह अपील दायर की है। दीवानी अदालत ने केतन कक्कड़ के खिलाफ अभिनेता की ओर से दायर मानहानि के मुकदमे में उन्हें (सलमान खान को) राहत देने से इनकार कर दिया था।
दरअसल केतन कक्कड़ के खिलाफ दायर मुकदमा उनके द्वारा सोशल मीडिया पर अपलोड किये गए वीडियो से जुड़े हैं, जो सलमान खान के पनवेल स्थित फार्महाउस में खान की अवैध गतिविधियों के बारे में हैं। सलमान खान ने अदालत से कक्कड़ को मानहानिकारक वीडियो हटाने और आगे इस तरह की टिप्पणी करने से रोकने का निर्देश देने का भी अनुरोध किया था। वहीं जब दीवानी अदालत ने जब ऐसा कोई आदेश जारी करने से इनकार कर दिया, तब सलमान ने उच्च न्यायालय का रुख किया।
सलमान के खिलाफ भड़काता है वीडियो
शुक्रवार को सलमान खान के वकील रवि कदम ने दलील दी कि दीवानी अदालत का आदेश त्रुटिपूर्ण था। कदम ने कहा, ‘कक्कड़ द्वारा अपलोड वीडियो अटकलबाजी वाले हैं। वे न सिर्फ मानहानिकारक हैं, बल्कि वे इसे देखने वालों को सलमान खान के खिलाफ साम्प्रदायिक रूप से भड़काते भी हैं।’ वीडियो की पटकथा पढ़ते हुए कदम ने कहा कि कक्कड़ ने इस बारे में बोला था कि खान कैसे एक गणेश मंदिर (अपने फार्महाउस के पास पनवेल में) को हड़पने की कोशिश कर रहे हैं।
सलमान की तुलना बाबर और औरंगजेब से
कदम ने कहा, ‘वीडियो में प्रतिवादी (कक्कड़) ने सलमान खान की तुलना बाबर और औरंगजेब से की। उन्होंने (कक्कड़ ने) कहा कि अयोध्या में मंदिर बनने में 500 वर्षों का समय लगा और यहां सलमान खान एक गणेश मंदिर को बंद करने की कोशिश कर रहे हैं।
इन वीडियो को लाखों लोगों ने देखा, जिन्होंने इसके बाद सलमान खान के खिलाफ अपनी टिप्पणी पोस्ट की। यह स्पष्ट रूप से सलमान के खिलाफ दर्शकों को भड़काना है। वीडियो ने हर चीज को साम्प्रदायिक रंग दे दिया और इसे हिंदू बनाम मुस्लिम बना दिया।’
केतन कक्कड़ का क्या था कहना
केतन कक्कड़ ने कई टिप्पणी करते हुए यह आरोप भी लगाया है कि खान का अंडरवर्ल्ड डॉन दाउद इब्राहिम से संबंध है। इस पर कदम ने कहा, ‘कक्कड़ ने आरोप लगाया है कि सलमान अपने फार्महाउस से मादक पदार्थों की तस्करी, मानव अंगों की तस्करी और बच्चों की तस्करी का धंधा कर रहे हैं।’
मामले में संक्षिप्त दलीलें सुनने के बाद पीठ ने इसकी आगे की सुनवाई के लिए 22 अगस्त की तारीख निर्धारित कर दी। कक्कड़ ने अपनी वकील आभा सिंह और आदित्य सिंह के मार्फत निचली अदालत में दावा किया था कि अभिनेता ने उनके खिलाफ मानहानि का मुकदमा अपनी (कक्कड़ की) जमीन छोड़ने के लिए दबाव बनाने के वास्ते दायर किया था।

A single bench of Justice CV Bhadang is hearing an appeal by Khan. Let us tell you that Salman has filed this appeal challenging the March 2022 order of a civil court. The civil court had refused to grant relief to him (Salman Khan) in the defamation suit filed by the actor against Ketan Kakkar.
The lawsuit filed against Ketan Kakkar pertains to a video uploaded by him on social media about Khan’s illegal activities at Salman Khan’s Panvel farmhouse. Salman Khan had also requested the court to direct Kakkar to remove the defamatory video and stop making such remarks any further. On the other hand, when the civil court refused to issue any such order, Salman moved the High Court.
Video instigates against Salman
On Friday, Salman Khan’s counsel Ravi Kadam argued that the civil court order was erroneous. Kadam said, “The videos uploaded by Kakkar are speculative. They are not only defamatory, but they also communally provoke those who watch it against Salman Khan. Reading the script of the video, Kadam said that Kakkar had spoken about how Khan was trying to grab a Ganesh temple (in Panvel near his farmhouse).
Comparison of Salman with Babur and Aurangzeb
Kadam said, “In the video, the respondent (Kakkar) compared Salman Khan with Babar and Aurangzeb. He (Kakkar) said that it took 500 years to build a temple in Ayodhya and Salman Khan is trying to shut down a Ganesh temple here.
These videos were viewed by lakhs of people who then posted their comments against Salman Khan. This is clearly to incite the audience against Salman. The video gave communal color to everything and made it Hindu vs Muslim.
What Ketan Kakkar had to say
Ketan Kakkar has also made several remarks alleging that Khan has links with underworld don Dawood Ibrahim. To this, Kadam said, “Kakkar has alleged that Salman is involved in drug smuggling, human organ smuggling and child smuggling from his farmhouse.”
After hearing brief arguments in the matter, the bench fixed August 22 for further hearing. Kakkar, through his lawyers Abha Singh and Aditya Singh, had claimed in the trial court that the actor had filed a defamation suit against him to pressurize him to give up his (Kakkar’s) land.
