नई दिल्ली | [कोर्ट बुलेटिन] | ईडब्ल्यूएस (आर्थिक रूप से पिछड़े वर्ग) के बच्चों को निर्धारित सीटों पर दाखिला नहीं देना निजी स्कूलों को महंगा पड़ा है। उच्च न्यायालय ने सभी निजी स्कूलों को अगले 5 साल तक ईडब्ल्यूएस श्रेणी के लिए आरक्षित 25 फीसदी सीटों के अलावा अतिरिक्त 20 फीसदी सीटों पर दाखिला देने का आदेश दिया है। यानी स्कूलों को 45 फीसदी सीटों पर गरीब बच्चों को दाखिला देना होगा।

 

जस्टिस नज्मी वजीरी और विकास महाजन की पीठ ने मंगलवार को आदेश को प्रभावी रूप से लागू करने के लिए दिल्ली सरकार को सभी जरूरी कदम उठाने का निर्देश दिया है। पीठ ने कहा, ऐसे कई उदाहरण हैं, जहां स्कूलों ने ईडब्ल्यूएस श्रेणी के छात्रों के दाखिले की आवश्यकताओं का पालन नहीं किया है।

 

सरकारी भूमि का कोई लाभार्थी आवंटन की शर्तों के तहत अपने दायित्व की न तो अनदेखी कर सकता है और न ही इससे बच सकता है। न्यायालय ने कहा, सरकार को यह सुनिश्चित करने का आदेश दिया जाता है कि सरकारी व निजी भूमि पर बने सभी निजी स्कूलों में खाली सीटों को पांच वर्षों में चरणबद्ध तरीके से भरा जाए। साथ ही सरकार को आदेश पालन कर रिपोर्ट देने का आदेश दिया।

 

पीठ ने गैर सरकारी संगठन जस्टिस फॉर ऑल की ओर से दाखिल याचिका पर यह आदेश दिया है। संगठन की ओर से अधिवक्ता खगेश झा ने याचिका में निजी स्कूलों द्वारा पिछले कई सालों से ईडब्ल्यूएस श्रेणी के बच्चों को कम सीटों पर दाखिला देने का आरोप लगाया है।

 

132 स्कूलों को जारी किया नोटिस

 

सरकार की ओर से अधिवक्ता संतोष त्रिपाठी ने कोर्ट को बताया कि कुछ स्कूलों ने दाखिला नियमों की अनदेखी की है। शिक्षा निदेशालय ने इस पर 132 स्कूलों को नोटिस जारी कर जवाब मांगा है।

 

कुल सीटों के आधार पर होगा दाखिला

 

उच्च न्यायालय ने कहा है कि निजी स्कूलों में एंट्री लेवल की कक्षा में ईडब्ल्यूएस श्रेणी में दाखिला सामान्य श्रेणी में हुए दाखिले के आधार पर नहीं बल्कि कक्षा में घोषित कुल सीटों के 25 फीसदी के आधार पर होगा।

New Delhi | [Court Bulletin] | Not giving admission to the EWS (Economically Backward Class) children in the prescribed seats has cost the private schools dearly. The High Court has ordered all private schools to admit an additional 20 per cent seats in addition to the 25 per cent seats reserved for the EWS category for the next five years. That is, schools will have to admit poor children in 45 percent of the seats.

 

A bench of Justices Najmi Waziri and Vikas Mahajan on Tuesday directed the Delhi government to take all necessary steps for effective implementation of the order. “There are many instances where schools have not followed the admission requirements of EWS category students,” the bench said.

 

A beneficiary of government land can neither ignore nor evade his liability under the terms of the allotment. The court said, the government is directed to ensure that the vacant seats in all private schools built on government and private land are filled in a phased manner over a period of five years. Along with this, ordered the government to follow the order and submit the report.

 

The bench gave this order on a petition filed by NGO Justice for All. Advocate Khagesh Jha, appearing for the organization, has alleged in the petition that private schools have been admitting children of EWS category in less seats for the last several years.

 

 Notice issued to 132 schools

 

Advocate Santosh Tripathi, appearing for the government, told the court that some schools have ignored the admission rules. The Directorate of Education has issued notices to 132 schools on this and sought answers.

 

 Admission will be done on the basis of total seats

 

The High Court has said that admission in EWS category in entry level classes in private schools will not be on the basis of admission in general category but on the basis of 25 per cent of the total seats declared in the class.
